expire until April 27, 2020 due to action taken by the North Carolina General Assembly a few years ago
which extended all stormwater permits by four years. We are returning to you your application and the
$505.00 check for renewal fees. Please resubmit at least 180 days prior to expiration of the permit.

In regards to the NC State Stormwater Permit Renewal/Modification
for T-1013 New Bern Target, please have Mike Bell send me an
authorization letter giving Marc Steadman the authority to sign
on Mike's behalf. (Please also include in the letter Mr. Steadman's position with the
company.)
The store is currently being expanded and the existing permit has expired,
the application for renewal and modification has been submitted into our
Express review program and in order to expedite this permit request please
have this letter sent as soon as possible, no later than April 25, 2006.
If more time is needed to send the authorization letter, please email me back
requesting an extension.

The forms provided as enclosures 2 and 34request renewal of the stormwater permit and advise of
the owner's corporate name change respectively: 'A .;vie:discussecl with"'l .Hodge via telephone April
7, the project owner, Dayton Hudson Corporation, has changed its name to Target Corporation.
Because the owner has not actually changed, and per Mr. Hodge's instructions, we have not enclosed
the supporting documents listed on'page two of enclosure 3 dnd typically required for a transfer of
ownership. We do, however, provide enclosure 4 in'support of the'indicated name change.
Enclosure 5 is a copy of the designer'scertification, for construction associated with stormwater
c permit SW795053, originally exeuted by Robert M.'Chiles, P.E. on August 21, 1996.
Enclosure 6 is a copy of the original stormwater'plan drawing that is modified to indicate a
proposed building expansion at the project'site. The propos-ed building expansion is essentially a
westward shift of the west wall and a reconfiguration of the adjacent portion of the existing parking area.
The building modification results in an approximate 2,100 square -foot reduction of impervious surfaces
within the project site. Because at the resulting impervious surface area decrease, no modification to the
existing stormwater management system is proposed.
Note, that enclosure 3 does not include an original signature. As we discussed via Telephone April
13, the signature page was delivered to us via email. A copy bearing originai signatures is being
submitted directly to you by CEI Engineering Associates, Inc. and should arrive sometime Monday.

The Division of Water Quality issued a Coastal Stormwater Management Permit, Number SW 7950503
to Dayton Hudson Corp. for Target Store on 11/1/1995. This permit expires on 111112005. Section
.1003(h) of 15 A NCAC 2H .1000 (the stormwaterrules) requires that applications for permit renewals
shall be submitted 180 days prior to the expiration of a permit and must be accompanied by a
processing fee, which is currently set at $420.00. If this is still an active project please complete and
submit the enclosed renewal application in a timely manner. If this project has not been constructed
and a permit is no longer needed, please submit a request to have the permit rescinded. If you have
sold the project, or are no longer the permittee, please provide the name, mailing address and phone
number of the person or entity that is now responsible for this permit. Enclosed is a form for change of
ownership, which should be completed and submitted if the property has changed hands.
Your permit requires that upon completion of construction and prior to operation of the permitted
treatment units a certification of completion be submitted to the Division from an appropriate designer
for the system installed. This is to certify that the permitted facility has been installed in accordance with
the permit, the approved plans, specifications and supporting documentation. Please include a copy of
the certification with your permit renewal request and processing fee. Enclosed is a copy of a sample
certification.
You should be aware that failure to provide the Designer's Certification and the operation of a
stormwater treatment facility without a valid permit, are violations of NC General Statute 143-215.1 and
may result in appropriate enforcement action including the assessment of civil penalties of up to
$10,000 per day.

4. No homeowner/lot owner/developer shall be allowed to fill in,
alter, or pipe any vegetative practices (such as swales) shown
on the approved plans as part of the stormwater management
system without submitting a revision to the permit and
receiving approval from the Division.
5. The following items will require a modification to the permit:
a. Any revision to the approved plans, regardless of size
b. Project name change
C. Transfer .of ownership
d. Redesign or addition to the approved amount of built -upon
area
e. Further subdivision of the project area.
In'addition, the Director may determine that other revisions
to the project should require a modification to the permit.
6. The Director may notify the permittee when the permitted site
does not meet one or more of the minimum requirements of the
permit. Within the time frame specified in the notice, the
permittee shall submit a written time schedule to the Director
for modifying the site to meet minimum requirements. The
permittee shall provide copies of revised plans and
certification in writing to the Director that the changes have
been made.
II. SCHEDULE OF COMPLIANCE
1. The permittee will comply with the following schedule for
construction and maintenance of the stormwater management
system.
a. The stormwater management system shall be constructed in
its entirety, vegetated and operational for its intended
use prior to the construction of any built -upon surfaces
except roads.
b. During construction, erosion shall be kept to a minimum
and any eroded areas of the system will be repaired
immediately.

2. The facilities must be properly maintained and operated at all
times. The approved Operation and Maintenance Plan must be
followed in its entirety and maintenance must occur at the
scheduled intervals.
3'. The permittee shall at all times provide the operation and
maintenance necessary to assure the permitted stormwater
system functions at optimum efficiency including, but not
limited to:
a. Semiannual scheduled inspections (every 6 months)
b. Sediment removal
C. Mowing and revegetation of side slopes
d. Immediate repair of eroded areas
e. Maintenance of side slopes in accordance with approved
plans and specifications
f. Debris removal and unclogging of outlet structure,
orifice device and catch basins and piping.
4. Records of maintenance activities must be kept and made
available upon request to authorized personnel of DEM. The
records will indicate the date, activity, name of person
performing the work and what actions were taken.
5. . This permit shall become voidable unless the facilities are
constructed in accordance with the conditions of this permit,
the approved plans and specifications, and other supporting
data.
6. Upon completion of construction and prior to operation of this
permitted facility, a certification must be received from an
appropriate designer for the system installed certifying that
the permitted facility has been installed in accordance with
this permit, the approved plans and specifications, and other
supporting documentation. Mail the Certification to the
Washington Regional Office, 1424 Carolina Avenue, Washington,
North Carolina, 27889, attention Water Quality Section.
7. A copy of the approved plans and specifications shall be
maintained on file, by the Permittee for a minimum of five
years from the date of the completion of construction.
III. GENERAL CONDITIONS
1. This permit is not transferable. In the event there is a
desire for the facilities to change ownership, or there is a
name change of the Permittee, a formal permit request must be
submitted to the Division of Environmental Management
accompanied by an application fee, documentation from the
parties involved, and other supporting materials as may be
appropriate. The approval of this request will be considered
on its merits and may or may not be approved.

2. Failure to abide by the conditions and limitations contained
in this permit may subject the Permittee to enforcement action
by the Division of Environmental Management, in accordance
with North Carolina General Statute 143-215.6(a) to 143-
215.6(c).
3=. The issuance of this permit does not preclude the Permittee
from complying with any and all statutes, rules, regulations,
or ordinances which may be imposed by other government
agencies (local, state, and federal) which have jurisdiction.
4. In the event that the facilities fail to perform
satisfactorily, including the creation of nuisance conditions,
the Permittee shall take immediate corrective action,
including those as may be required by this Division, such as
the construction of additional or replacement stormwater
management systems.
5. The permit may be modified, revoked and reissued or terminated
for cause. The filing of a request for a permit modification,
revocation and reissuance or termination does not stay any
permit condition.

NARRATIVE
PROJECT DESCRIPTION:
The purpose of this project is to construct a storm water retention pond to serve a
27 acre commercial development within the city limits of New Bern, Craven County, North
Carolina. The site will be developed by separate owners with the joint use of the. retention
pond.
The work proposed will include excavation of the retention pond, construction of on
site storm drainage for the Target Site with provisions for later connections by the two (2)
outlot parcels on Highway 17 in front of the Target store. The adjoining Webb property and
the Alcoke property northeast of the retention will also be developed laterto utilize the same
storm water retention pond. The retention pond has been sized and will be constructed to
collect the first one inch of runoff from the entire 27 acres.
A Sedimentation and Erosion Control Plan has been prepared, submitted and
approved previously for the Target site.
The site is located in the Northeaster quadrant of the U. S. Highway 17 and
Glenburnie Road intersection on the south side of New Bern, North Carolina and bounded
on the east by McCarthy Blvd. The Target/Alcoke site were previously undeveloped and
the Webb site is to be redeveloped from existing commercial use.
The topography of the site is basically flat with existing drainage passing to the west
along the abandoned railroad track bed beneath Glenburnie Road. The drainage outlet is
scheduled for improvements by the N. C. Department of Transportation.
The site is bounded on the south by U. S. Highway 17, on the west by Glenburnle
Road, on the east by McCarthy Blvd. Property to the north is owned by others and will not
be affected by the work.

The superficial soils are organic sandy topsoil with organic debris from previous
logging and clearing operations. The project site is located In the Coastal Plain
Physiographic Province. The Coastal Plain consists mainly of marine sediments which
were deposited during successive periods of fluctuating sea level and moving shoreline.
The near surface soils stratum is approximately seven (7) feet thick and consists of silty,
clean and clayey sands. (Law Engineering Report #472-10533-01.)
The storm water collection system described herein and on the attached drawings
will provide the following methods for control of sediments and for removal of pollutants
from the developed site runoff.
1. Collection of all runoff from the site during development of the retention pond
with controlled discharge.
2. Retention of the runoff resulting from the first one (1) inch of rainfall on the
parking and roof area in the wet pond. Subsequently this runoff will drain
over a 2-5 day period into the existing drainage outfall into a vegetated drain
west of Glenbumie Road.
3. The rainfall during a 20 year storm event will result in peak runoff flows of 73
cfs from the entire 27 acres with individual peak flows for each parcel shown
on the attached calculation sheets.
4. The retention time in the pond is set at 4 days with a total outflow of 0.29 cfs
from (3) 2 inch diameter orifices.
5. The stormwater runoff in excess of the first one (1) inch of rainfall will
discharge through the retention pond over a concrete weir. The lower section
of the weirwill discharge the excess runoff above elevation 19.5 ft. ABV MSL.
The upper section of the weir will provide additional discharge as an
emergency spillway. The weir discharge will be through a 50 foot long grass
lined swale thence to a graded ditch to the outfall. Additional emergency
discharge from the Target store site parking area will be over the open side
of the culvert junction box as shown on the plan.

6. Attached as part of the plan are hydrograph data for the entire site for rainfall
intensity of 5.8 in/hr. for a 10 year storm.
7. The entire runoff from the Target site and the two (2) outiots will be carried to
the wet pond through culvert along the west side of the site and enter the
pond at the southwest corner at the forebay section of the pond. The entire
runoff from the Webb site will also enter the pond at the same location.
8. The entire 27 acre site to be served by the wet retention pond is shown on
the attached sketchtitled " prepared
by Robert M. Chiles, P.E. dated 02-08-95.

10. The project site is located partially within area delineated as Section 404
wetlands. this project site has previously been permitted to be filled by the
U.S. COE under Section 404 of the Clean Water Act and by the N. C. DEM
under Section 401 of the Clean Water Act with provision for off site mitigation
approved.
11. The entire site will be developed for commercial use under the existing City
of New Bern Zoning regulations and impervious area will be less than 90%
of the entire site.
12. The agreements between Webb, Alcoke and Target for use and operation of
the joint stormwater management system for the site.
A
1. All erosion and sediment control practices shall be checked for stability and
operation following every runoff producing rainfall and in no case less than
once every week during construction. Inlet and outlet riprap shall be repaired
as necessary to assure protection from erosion at the pond.
2. Upon completion of earth disturbing activities and forthe 12 months following
completion of the work, the owner shall inspect the site following every runoff
producing rainfall. A written log shall be maintained of any needed repairs
noted at the inspection, the name of the Contractor completing the repairs
and the date such repairs are completed.
3. The retention pond shall be inspected during construction and when and if the
sediment layer within the pond exceeds 12 inches thick on the average, or 18
inches thick within the forebay, this sediment shall be removed. Upon
completion of construction stabilization, the pond shall be cleaned of excess
sediment and begin functioning as a storm water retention pond.
4. The grass lined swale at the pond overflow shall be mowed a minimum of two
(2) times annually and properly maintained to assure no erosion occurs and
to prevent woody vegetation from chocking the discharge from the pond. All
seeded areas will be maintained such as to sustain vegetation. All bare
areas will be replanted as necessary.
5. Periodic inspection of the discharge orifice header shall assure that the
system is not clogged.

Dear Bill:
The enclosed Stormwater Management Plan includes the revisions requested by you
during our previous meeting and telephone conversation. In particular, we have made the
following changes to the Plan:
1. Increased the pond depth to create a normal pool water depth of 4.5 feet.
The SAIDA ratio has been changed to reflect the new water depth.
2. The forebay to the pond has been altered to be the same depth as the
remainder of the pond.

NARRATIVE
PROJECT DESCRIPTION:
The purpose of this project is to construct a storm water retention pond to serve a
27 acre commercial development within the city limits of New Bern, Craven County, North
Carolina. The site will be developed by separate owners with the joint use of the retention
pond.
The work proposed will Include excavation of the retention pond, construction of on
site storm drainage for the Target Site with provisions for later connections by the two (2)
outlot parcels on Highway 17 In front of the Target store. The adjoining Webb property and
the Alcoke property northeast of the retention will also be developed later to utilize the same
storm water retention pond. The retention pond has been sized and will be constructed to
collect the first one inch of runoff from the entire 27 acres.
A Sedimentation and Erosion Control Plan has been prepared, submitted and
approved previously for the Target site.
The site is located in the Northeastern quadrant of the U. S. Highway 17 and
Glenbumie Road intersection on the south side of New Bern, North Carolina and bounded
on the east by McCarthy Blvd. The Target/Alcoke site were previously undeveloped and
the Webb site is to be redeveloped from existing commercial use.
The topography of the site is basically flat with existing drainage passing to the west
along the abandoned railroad track bed beneath Glenburnie Road. The drainage outlet is
scheduled for improvements by the N. C. Department of Transportation.
The site is bounded on the south by U. S. Highway 17, on the west by Glenburnie
Road, on the east by McCarthy Blvd. Property to the north Is owned by others and will not
be affected by the work.

The superficial soils are organic sandy topsoil with organic debris from previous
logging and clearing operations. The project site is located in the Coastal Plain
Physlographic Province, The Coastal Plain consists mainly of marine sediments which
were deposited during successive periods of fluctuating sea level and moving shoreline.
The near surface soils stratum is approximately seven (7) feet thick and consists of silty,
clean and clayey sands. (Law Engineering Report #472-10533-01.)
The storm water collection system described herein and on the attached drawings
will provide the following methods for control of sediments and for removal of pollutants
from the developed site runoff.
1. Collection of all runoff from the site during development of the retention pond
with controlled discharge.
2. Retention of the runoff resulting from the first one (1) inch of rainfall on the
parking and roof area in the wet pond. Subsequently this runoff will drain
over a 2-5 day period into the existing drainage outfall into a vegetated drain
west of Glenbumie Road.
3. The rainfall during a 20 year storm event will result in peak runoff flows of 73
cfs from the entire 27 acres with individual peak flows for each parcel shown
on the attached calculation sheets.
4. The retention time in the pond is set at 4 days with a total outflow of 0.29 cfs
from (3) 2 inch diameter orifices.
5. The stormwater runoff in excess of the first one (1) inch of rainfall will
discharge through the retention pond over a concrete weir. The lower section
of the weir will discharge the excess runoff above elevation 19.5 ft. ABV MSL.
The upper section of the weir will provide additional discharge as an
emergency spillway. The weir discharge will be through a 50 foot long grass
lined swale thence to a graded ditch to the outfall. Additional emergency
discharge from the Target store site parking area will be over the open side
of the culvert junction box as shown on the plan.

6. Attached as part of the plan are hydrograph data for the entire site for rainfall
Intensity of 5.8 In/hr. for a 10 year storm.
7. The entire runoff from the Target site and the two (2) outlots will be carried to
the wet pond through culvert along the west side of the site and enter the
pond at the southwest comer at the forebay section of the pond. The entire
runoff from the Webb site will also enter the pond at the same location.
8. The entire 27 acre site to be served by the wet retention pond Is shown on
the attached sketch titled "Sketch Plan for AlcokelTargetBgreement prepared
by Robert M. Chiles, P.E. dated 02-08-95.

10. The project site is located partially within area delineated as Section 404
wetlands. this project site has previously been permitted to be filled by the
U.S. COE under Section 404 of the Clean Water Act and by the N. C. DEM
under Section 401 of the Clean Water Act with provision for off site mitigation
approved.
11. The entire site will be developed for commercial use under the e)dsting City
of New Bern Zoning regulations and impervious area will be less than 90%
of the entire site.
12. The agreements between Webb, Alcoke and Target for use and operation of
the joint stormwater management system for the site.

1. All erosion and sediment control practices shall be checked for stability and
operation following every runoff producing rainfall and in no.case less than
once every week during construction.
2. Upon completion of earth disturbing activities and forthe 12 months following
completion of the work, the owner shall Inspect the site following every runoff
producing rainfall. A written log shall be maintained of any needed repairs
noted at the Inspection, the name of the Contractor completing the repairs
and the date such repairs are completed.
3. The retention pond shall be Inspected during construction and when and if the
sediment layer within the pond exceeds 18 inches thick on the average, this
sediment shall be removed. Upon completion of construction stabilization, the
pond shall be cleaned of excess sediment and begin functioning as a storm
water retention pond.
4. The grass lined swale at the pond overflow shall be properly maintained to
assure no erosion occurs and to prevent woody vegetation from chocking the
discharge from the pond. All seeded areas will be maintained such as to
sustain vegetation. All bare areas will be replanted as necessary.
5. .Periodic inspection of the discharge orifice header shall assure that the
system is not clogged.
