Dear Mr. Bagneli:
The Washington Regional Office received a complete NPDES Phase II Stormwater
Management Permit Modification Application for ECU — Health Sciences Campus Student
Services Center on April 21, 2015. Staff review of the plans and specifications has
determined that the project, as proposed, will comply with the Stormwater Regulations set
forth in Session Law 2006-246, and Title 15A NCAC 2H.1000. We are forwarding Permit
No. 5W7091018 MOD dated May 1, 2015, for the construction of the subject project. This
Modification is to include the Student Services Center to already permitted Dental School.
This permit shall be effective from the date of issuance until December 31, 2019, shall void
permit SW7091018 issued on January 14, 2010 and shall be subject to the conditions and
limitations as specified therein. Please pay special attention to the Operation and
Maintenance requirements in this permit. Failure to establish an adequate system for
operation and maintenance of the stormwater management system will result in future
compliance problems.
If any parts, requirements, or limitations contained in this permit are unacceptable, you
have the right to request an adjudicatory hearing upon written request within thirty (30)
days following receipt of this permit. This request must be in the form of a written petition,
conforming to Chapter 150B of the North Carolina General Statutes, and filed with the
Office of Administrative Hearings, 6714 Mail Service Center, Raleigh, NC 27699-6714.
Unless such demands are made this permit shall be final and binding.

construction, operation and maintenance of a wet detention pond and a bioretention
cell in compliance with the provisions of Session Law 2006-246, and 15A NCAC 2H
.1000 (hereafter referred to as the "stormwater rules') and the approved stormwater
management plans and specifications and other supporting data as attached and on file
with and approved by the Division of Energy, Mineral, and Land Resources (Division)
and considered a part of this permit.
This permit shall be effective from the date of issuance until December 31, 2019, and
shall be subject to the following specified conditions and limitations:
I. DESIGN STANDARDS
1. This permit is effective only with respect to the nature and volume of stormwater
described in the application and other supporting data.
2. This stormwater system has been approved for the management of stormwater
runoff as described in Section 1.7 on page 3 of this permit. The stormwater
control within wet detention basin has been designed to handle the runoff from
823,589 square feet of impervious area and within bioretention cell has been
designed to handle the runoff from 14,590 square feet of impervious area. .
3. The tract will be limited to the amount of built -upon area indicated in Section 1.7
on page 3 of this permit, and per approved plans.
4. All stormwater collection and treatment systems must be located in either
dedicated common areas or recorded easements. The final plats for the project
will be recorded showing all such required easements, in accordance with the
approved plans.
5. The runoff from all built -upon area within the permitted drainage area of this
project must be directed into the permitted stormwater control system.

6. The built -upon areas associated with this project shall be located at least 50 feet
landward of all perennial and intermittent surface waters.
7. The following design criteria have been provided in the wet detention pond and
the bioretention cell and must be maintained at design condition:

II. SCHEDULE OF COMPLIANCE
1. The stormwater management system shall be constructed in its entirety,
vegetated and operational for its intended use prior to the construction of any
built -upon surface.
2. During construction, erosion shall be kept to a minimum and any eroded areas of
the system will be repaired immediately.

3. The permittee shall at all time provide the operation and maintenance necessary
to assure the permitted stormwater system functions at optimum efficiency. The
approved Operation and Maintenance Plan must be followed in its entirety and
maintenance must occur at the scheduled intervals including, but not limited to:
a. Semiannual scheduled inspections (every 6 months).
b. Sediment removal.
C. Mowin.9 and re -vegetation of slopes and the vegetated filter strip.
d. Immediate repair of eroded areas.
e. Maintenance of all slopes in accordance with approved plans and
specifications.
f. Debris removal and unclogging of outlet structure, orifice device, level
spreader, filter strip, catch basins and piping.

4. Records of maintenance activities must be kept for each permitted BMP. The
records will indicate the date, activity, name of person performing the work and
what actions were taken.
5. The permittee shall submit to the Division an annual summary report of the
maintenance inspection records for each BMP. The report shall summarize the
inspection dates, results of the inspections, and the maintenance work
performed at each inspection.
6. Access to the stormwater facilities shall be maintained via appropriate
easements at all times.
7. The facilities shall be constructed as shown on the approved plans. This permit
shall become void unless the facilities are constructed in accordance with the
conditions of this permit, the approved plans and specifications, and other
supporting data.
8. Upon completion of construction, prior to issuance of a Certificate of Occupancy,
and prior to operation of this permitted facility, a certification must be received
from an appropriate designer for the system installed certifying that the permitted
facility has been installed in accordance with this permit, the approved plans and
specifications, and other supporting documentation. Any deviations from the
approved plans and specifications must be noted on the Certification. A
modification may be required for those deviations.
9. If the stormwater system was used as an Erosion Control device, it must be
restored to design condition prior to operation as a stormwater treatment device,
and prior to occupancy of the facility.
10. The permittee shall submit to the Director and shall have received approval for
revised plans, specifications, and calculations prior to construction, for any
modification to the approved plans, including, but not limited to, those listed
below:
a. Any revision to any item shown on the approved plans, including the
stormwater management measures, built -upon area, details, etc.
b. Project name change.
C. Transfer of ownership.
d. Redesign or addition to the approved amount of built -upon area or to the
drainage area.
e. Further subdivision, acquisition, lease or sale of all or part of the project
area. The project area is defined as all property owned by the permittee,
for which Sedimentation and Erosion Control Plan approval or a CAMA
Major permit was sought.
f. Filling in, altering, or piping of any vegetative conveyance shown on the
approved plan.

11. The Director may notify the permittee when the permitted site does not meet one
or more of the minimum requirements of the permit. Within the time frame
specified in the notice, the permittee shall submit a written time schedule to the
Director for modifying the site to meet minimum requirements. The permittee
shall provide copies of revised plans and certification in writing to the Director
that the changes have been made.
12. The permittee shall submit final site layout and grading plans for any permitted
future areas shown on the approved plans, prior to construction.
13. A copy of the approved plans and specifications shall be maintained on file by
the_P_ermittee_for_a_minimum_of ten_years_from_the_date_o.f_the_completion_of __—
construction.
III. GENERAL CONDITIONS
This permit is not transferable except after notice to and approval by the Director.
In the event of a change of ownership, or a name change, the permittee must
submit a completed Name/Ownership Change form, to the Division, signed by
both parties, and accompanied by supporting documentation as listed on page 2
of the form. The project must be in good standing with the Division. The approval
of this request will be considered on its merits and may or may not be approved.
2. The permittee is responsible for compliance with all permit conditions until such
time as the Division approves the transfer request.
3. Failure to abide by the conditions and limitations contained in this permit may
subject the Permittee to enforcement action by the Division, in accordance with
North Carolina General Statute 143-215.6A to 143-215.6C.
4. The issuance of this permit does not preclude the Permittee from complying with
any and all statutes, rules, regulations, or ordinances, which may be imposed by
other government agencies (local, state, and federal) having jurisdiction.
5. In the event that the facilities fail to perform satisfactorily, including the creation
of nuisance conditions, the Permittee shall take immediate corrective action,
including those as may be required by this Division, such as the construction of
additional or replacement stormwater management systems.
6. The permittee grants DENR Staff permission to enter the property during normal
business hours for the purpose of inspecting all components of the permitted
stormwater management facility.
7. The permit issued shall continue in force and effect until revoked or terminated.
The permit may be modified, revoked and reissued or terminated for cause. The
filing of a request for a permit modification, revocation and re -issuance or
termination does not stay any permit condition.
8. Unless specified elsewhere, permanent seeding requirements for the stormwater
control must follow the guidelines established in the North Carolina Erosion and
Sediment Control Planning and Design Manual.
9. Approved plans and specifications for this project are incorporated by reference
and are enforceable parts of the permit.

10. The issuance of this permit does not prohibit the Director from reopening and
modifying the permit, revoking and reissuing the permit, or terminating the permit
as allowed by the laws, rules and regulations contained in Session Law 2006-
246, Title 15A NCAC 2H.1000, and NCGS 143-215.1 et.al.
11. The permittee shall notify the Division of any name, ownership or mailing
address changes at least 30 days prior to making such changes.

The applicable state stormwater management permit supplement and operation and maintenance (O&M) forms
must be submitted for each 13MP specified for this project. The latest versions of the forms can be downloaded

The Stormwater Permitting Unit received a complete Stormwater Management Permit Application for the
East Carolina University Dental School on January 4, 2010. Staff review of the plans and specifications
has determined that the project, as proposed, will comply with the Stormwater Regulations set forth in
Title 15A NCAC 2H.1000 and Session Law 2006-246. We are forwarding Permit No. SW7091010, dated
January 14, 2010, for the construction, operation and maintenance of (lie subject project and the
storrnwater BMPs.
This permit shall be effective from the date of issuance until January 13, 2018, and shall be subject to the
conditions and limitations as specified therein. Please pay special attention to the Operation and
Maintenance requirements in this permit. Failure to establish an adequate system for inspection and
maintenance of the stormwater management system will result in future compliance problems.
If any parts, requirements, or limitations contained in this permit are unacceptable, you have the right to

1. This permit is effective only with respect to the nature and volume of stormwater
described in the application and other supporting data.
2. This stormwater system has been approved for the management of stormwater
runoff as described in this permit. The stormwater control has been designed to
handle the runoff from 823,589 square feet of impervious area.
3. The tract will be limited to the amount of built -upon area indicated on page 3 of
this permit, and per approved plans.
4. All stormwater collection and treatment systems must be located in either
dedicated common areas or recorded easements. The final plats for the project
will be recorded showing all such required easements, in accordance with the
approved plans.
5. The runoff from all built -upon area within the permitted drainage area of this
project must be directed into the permitted stormwater control system.

II. SCHEDULE OF COMPLIANCE
1. The stormwater management system shall be constructed in its entirety,
vegetated and operational for its intended use prior to the construction of any
built -upon surface.
2. During construction, erosion shall be kept to a minimum and any eroded areas of
the system will be repaired immediately.
3. The permittee shall at all times provide the operation and maintenance
necessary to assure the permitted stormwater
system functions at optimum
efficiency. The approved Operation and
Maintenance Plan must be followed in
its entirety and maintenance must occur
at the scheduled intervals including, but
not limited to:
a. Semiannual scheduled inspections (every 6 months).
b. Sediment removal.
C. Mowing and revegetation of slopes and the vegetated filter.
d. Immediate repair of eroded areas.
e. Maintenance of all slopes in accordance with approved plans and
specifications.
f. Debris removal and unclogging of outlet structure, orifice device, flow
spreader, catch basins and piping.
g. Access to the outlet structure must be available at all times.
4. Records of maintenance activities must be kept and made available upon
request to authorized personnel of DWQ. The records will indicate the date,
activity, name of person performing the work and what actions were taken.
5. The facilities shall be constructed as shown on the approved plans. This permit
shall become voidable unless the facilities are constructed in accordance with.
the conditions of this permit, the approved plans and specifications, and other
supporting data.

6. Upon completion of construction, prior to issuance of a Certificate of Occupancy,
and prior to operation of this permitted facility, a certification must be received
from an appropriate designer for the system installed certifying that the permitted
facility has been installed in accordance with this permit, the approved plans and
specifications, and other supporting documentation. Any deviations from the
approved plans and specifications must be noted on the Certification. A
modification may be required for those deviations.
7. If the stormwater system was used as an Erosion Control device, it must be
restored to design condition prior to operation as a stormwater treatment device,
and prior to occupancy of the facility.
8. Access to the stormwater facilities shall be maintained via appropriate
easements at all times.
9. The permittee shall submit to the Director and shall have received approval for
revised plans, specifications, and calculations prior to construction, for any
modification to the approved plans, including, but not limited to, those listed
below:
a. Any revision to any item shown on the approved plans, including the
stormwater management measures, built -upon area, details, etc.
b. Project name change.
C. Transfer of ownership.
d. Redesign or addition to the approved amount of built -upon area or to the
drainage area.
e. Further subdivision, acquisition, lease or sale of all or part of the project
area. The project area is defined as all property owned by the permittee,
for which Sedimentation and Erosion Control Plan approval or a CAMA
Major permit was sought.
f. Filling in, altering, or piping of any vegetative conveyance shown on the
approved plan.
10. The permittee shall submit final site layout and grading plans for any permitted
future areas shown on the approved plans, prior to construction.
11. A copy of the approved plans and specifications shall be maintained on file by
the Permittee for a minimum of ten years from the date of the completion of
construction.
12. The Director may notify the permittee when the permitted site does not meet one
or more of the minimum requirements of the permit. Within the time frame
specified in the notice, the permittee shall submit a written time schedule to the
Director for modifying the site to meet minimum requirements. The permittee
shall provide copies of revised plans and certification in writing to the Director
that the changes have been made.
Ill. GENERAL CONDITIONS
This permit is not transferable except after notice to and approval by the Director.
In the event of a change of ownership, or a name change, the permittee must
submit a completed Name/Ownership Change form, to the Division of Water
Quality, signed by both parties, and accompanied by supporting documentation
as listed on page 2 of the form. The project must be in good standing with the
Division. The approval of this request will be considered on its merits and may or
may not be approved.
2. The permittee is responsible for compliance with all permit conditions until such
time as the Division approves the transfer request.

3. Failure to abide by the conditions and limitations contained in this permit may
subject the Permittee to enforcement action by the Division of Water Quality, in
accordance with North Carolina General Statute 143-215.6A to 143-215.6C.
4. The issuance of this permit does not preclude the Permittee from complying with
any and all statutes, rules, regulations, or ordinances, which may be imposed -by
other government agencies (local, state, and federal) having jurisdiction.
5. In the event that the facilities fail to perform satisfactorily, including the creation
of nuisance conditions, the Permittee shall take immediate corrective action,
including those as may he required by this Division, such as the construction of
additional or replacement stormwater management systems.
6. The permittee grants DENR Staff permission to enter the property during normal
business hours for the purpose of inspecting all components of the permitted
stormwater management facility.
7. The permit issued shall continue in force and effect until revoked or terminated.
The permit may be modified, revoked and reissued or terminated for cause. The
filing of a request for a permit modification, revocation and re -issuance or
termination does not stay any permit condition.
8. Unless specified elsewhere, permanent seeding requirements for the stormwater
control must follow the guidelines established in the North Carolina Erosion and
Sediment Control Planning and Design Manual.
9. Approved plans and pecifications for this project are incorporated by -reference .
and are enforceable parts of the permit.
10.The issuance of this permit does not prohibit the Director from reopening and
modifying the permit, revoking and reissuing the permit, or terminating the permit
as allowed by the laws, rules and regulations contained in Session Law.2006-
246, Title 15A NCAC 2H.1000, and NCGS 143-215.1 et.al.
11.The permittee shall notify the Division of any name, ownership or mailing
address changes at least'30 days prior to making such changes.

pollutant removal. Two existing stormwater basins will be removed as part of this development. The proposed
pond accept and treat the water from the two existing basins as well as the proposed development. _

Approval of 401 Water Quality Certification and Authorization Certificate per the Tar -
Pamlico River Buffer Protection Rules (15A NCAC 2B .0259) with Additional Conditions
Dear Mr. Koch:
You have our approval, in accordance with the attached conditions and those listed below, to
place fill within or otherwise impact 0.375 acres of wetlands, 398 linear feet of streams and 1,330
square feet (ft2) of protected riparian buffers for the purpose of parking lot and stormwater pond
construction at the subject property, as described within your application dated October 15, 2009
and received by the N.C. Division of Water Quality (DWQ) on October 16, 2009, After
reviewing your application, we have decided that the impacts are covered by General Water
Quality Certification Number(s) 3705 (GC3705). The Certification(s) allows you to use
Nationwide Permit(s) 39 when issued by the US Army Corps of Engineers (USACE). This letter
shall also act as your approved Authorization Certificate for impacts to the protected riparian
buffers per 15A NCAC 213 .0259. In addition, you should obtain or otherwise comply with any
other required federal, state or local permits before you go ahead with your project including (but
not limited to) Erosion and Sediment Control, and Non -discharge regulations. Also, this
approval to proceed with your proposed impacts or to conduct impacts to waters as
depicted in your application shall expire upon expiration of the 404 or CAMA Permit.
This approval is for the purpose and design that you described in your application. If you change
your project, you must notify us and you may be required to send us a new application. If the
property is sold, the new owner must be given a copy of this Certification and approval letter and
is thereby responsible for complying with all conditions. If total fills for this project (now or in
the future) exceed one acre of wetland or 150 linear feet of stream, compensatory mitigation may
be required as described in 15A NCAC 2H .0506 (h). This approval requires you to follow the
conditions listed in the attached certification and any additional conditions listed below.

Erosion & Sediment Control Practices
Erosion and sediment control practices must be in full compliance with all specifications
governing the proper design, installation and operation and maintenance of such Best
Management Practices in order to protect surface waters standards:
a. The erosion and sediment control measures for the project must be designed,
installed, operated, and maintained in accordance with the most recent version of the
North Carolina Sediment and Erosion Control Planning and Design Manual.
b. The design, installation, operation, and maintenance of the sediment and erosion
control measures must be such that they equal, or exceed, the requirements specified
in the most recent version of the North Carolina Sediment and Erosion Control
Manual. _The devices shall be maintained on all construction sites, borrow sites, and
waste pile (spoil) projects, including contractor -owned or leased borrow pits
associated with the project.
c. For borrow pit sites, the erosion and sediment control measures must be designed,
installed, operated, and maintained in accordance with the most recent version of the
North'Carolina Surface Mining Manual.
d. The reclamation measures and implementation must comply with the reclamation in
accordance with the requirements of the Sedimentation .Pollution Control Act.
No Waste, Spoil, Solids, or Fill of Any Kind
No waste, spoil, solids, or fill of any kind shall occur in wetlands, waters, or riparian areas
beyond the footprint of the impacts depicted in the Pre -Construction Notification. All
construction activities, including the design, installation, operation, and maintenance of
sediment and erosion control Best Management Practices, shall be performed so that no
violations of state water quality standards, statutes, or rules occur.
No Sediment & Erosion Control Measures w/n Wetlands or Waters
Sediment and erosion control measures shall not be placed in wetlands or waters to the
maximum extent practicable. if placement of sediment and erosion control devices in

wetlands and waters are unavoidable, they shall be removed and the natural grade restored
within six months of the date that the Division of Land Resources has released the project.
5. Certificate of Completion
Upon completion of all work approved within the 401 Water Quality Certification or
applicable Buffer Rules, and any subsequent modifications, the applicant is required to return
the attached certificate of completion to the 401 Oversight/Express Review Permitting Unit,
North Carolina Division of Water Quality, 1650 Mail Service Center, Raleigh, NC, 27699-
1650,
6. Any rip -rap placed for streambank stabilization should be limited.to the streambank below
the high water mark, and vegetation should be used for stabilization above the high water
elevation. Rip -rap should not be placed in stream channels in such a manner that it impedes
aquatic life passage. The rocks placed on the bank should be backed with filter cloth and
should be clean and sediment free.
7. Heavy equipment must be operated from the banks rather than in the stream channel in order to
minimize sedimentation and reduce the likelihood of introducing other pollutants into the
T stream.
8. All mechanized equipment operated near surface waters must be regularly inspected and
maintained to prevent contamination of stream waters from fuels, lubricants, hydraulic fluids,
or other toxic materials.
9. Piping of stream shall be installed in such a manner that the original stream profiles are not
.altered (i.e., the depth of the channel must not be reduced by a widening of the streambed).
Existing stream dimensions (including pattern and profile) are to be maintained above and
below locations of culvert. The structures shall be designed and installed to allow for fish
and other wildlife movement as well as prevent headcutting of the.stream. The applicant may
be required to provide evidence that the equilibrium has been maintained, ,if requested in
a. writing by the DWQ.
Violations of any condition herein set forth may result in revocation of this Certification and may
result in criminal and/or civil penalties. The authorization to proceed with your proposed impacts
or to conduct impacts to waters as depicted in your application and as authorized by this
Certification shall expire upon expiration of the 404 or LAMA Permit.
If you do not accept any of the conditions of this Certification (associated with the approved
wetland or stream impacts), you may ask for an adjudicatory hearing, You must act within 60
days of the date that you receive this letter, To ask for a hearing, send a written petition, which
conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative
Hearings, 6714 Mail Service Center, Raleigh, N.C. 27699-6714. This certification and its ,
conditions are final and binding unless you ask for a hearing.
Any disputes over determinations regarding this Authorization Certificate (associated with'the
approved buffer impacts) shall be referred in writing to the Director for a decision. The
Director's decision is subject to review as provided in Articles 3 and 4 of G.S. 15013.

ColeJenest & Stone has reviewed and revised the Construction Documents
for the ECU Dental School Design project to address the following comments
dated December 23, 2009.
1. Please resubmit C806, (drawing shows the permanent pool above the
10 vegetative shelf and the design for the orifice did not allow for
Adequate maintenance (i.e., a tee -type configuration as shown in the
BMP manual on page 10-18).
The tee -type configuration has been added to detail 1 and detail 2 on sheet
Wing C803. The tee will be 6" pipe with a 3.5" orifice located 1' below the
Architecture permanent pool elevation.

project for wetlands impacts and the EA. is completed. DWQ will not
issue a permit until the 401 group has reviewed the project and the
Environmental Assessment (EA) is completed.
Approved 401 Water Quality Certification is attached.
5. Does the 823,589 include the dental building? SWU-101 indicates On -
site buildings as 0 (cistern). The runoff from all BUA must be
controlled and treated unless the cistern meets the technical guidance
pursuant to Stormwater treatment credit for rainwater harvesting dated
September 22, 2008.

from the wetlands submittal and th"e EA until approximately that date. We will likely need additional time to resubmit
the stormwater application. We would like to request an extension of the resubmittal deadline to January 151h. This
extension will allow us to incorporate all comments into our resubmittal.

When I checked the calculations this morning, I noted a descrepency on Form SWU-101 Item 8 Table, page 2 of 4. The
impervious surfaces for the drainage area in the top portion of the table indicated 823,596. The bottom portion
indicated 683,021. They should match. Also the numbers in the lower portion of the table don't add up.
Also it appears that you have included the pond in the impervious surfaces, DWQ policy has always been to consider
ponds as pervious.
1 plan to finish my review tomorrow.

The Division of Water Quality received your Stormwater Management Permit
Application for the East Carolina University Dental School on October 14, 2009. A preliminary
review of that information has determined that the application is riot complete. The following
information is needed to continue the stormwater review:
1. The numbers reported on the supplement and what is drawn or detailed on the plans
is inconsistent. The cross section of the wet pond on sheet C806 shows the
permanent pool elevation well above the 10-foot wide vegetated shelf. The
supplement form appeared to have it correct. The inside edge of the shell'sliall be 6"
below the permanent pool elevation; the outside edge of the shelf shall be 6" above
the permanent pool elevation.
2. According to the supplement form the S14WT is well above the pennanent pool. The
permanent pool elevation shall be within 6 inches (plus or minus)'of the SHWT
elevation.
3. The numbers reported on the application and supplement form is inconsistent. Form
SWU-101 item 8 Table, page 2 of 4, indicates the impervious surfaces for the
drainage area in the top portion of the table indicated 823,596. The bottom portion
indicated 683,021. Also the numbers in the lower portion of the table. don't add up.
Further, the supplement form indicates 823,589 s£ They should matoli. Finally,
DWQ policy considers ponds as pervious.
4. The orifice configuration provided does not provide for adequate maintenance access.
With the "tee" type configuration, the small orifice opening should be provided at the
bottom of the "tee" underwater so that a rod may be used to unclog it.

5. The application form, Item 2 under the General Information, did not indicate title of
the person legally responsible for the facility and compliance. Also, Item 3 under the
General Information did not indicate the City (Greenville?)
Wetlands are impacted. The 401:w' etlands group will need to be contacted to determine
what, if anything, they need prior to me completing my review or issuing a permit. Also, DWQ
will not issue a permit until the Environmental Assessment (EA) is completed. DWQ-SPU in
Raleigh has submitted our comments -on the EA.
Please note that this request for additional information is in response to a preliminary
review. The requested information should be received by this Office prior to December 15, 2009,
or the application will be returned as incomplete. The return of a project will necessitate
resubmittal of all required items, including the application fee. If you need additional time to
submit the information, please mail or fax your request for a time extension to the Division at the
address and fax number at the bottom of this letter. The request must indicate the date by which
you expect to submit the required information. The Division is allowed 90 days from the receipt
of a completed application to issue the permit. Please reference the State assigned project number
SW7091018 on all correspondence. All original documents must be returned or new originals
must be provided.
The construction of any impervious -surfaces, other than a construction entrance under an
approved Sedimentation Erosion Control Plan, is a violation of NCGS 143-215.1 and is subject to
enforcement action pursuant to NCGS 143-215.6A.
