Stormwater Permit SW7060418 for a stormwater treatment system consisting of two
bioretention areas to serve a proposed Pointe Marina Condominiums project located
256 Old Lupton Road, Merritt, NC expires on June 1, 2020. This is a reminder that
permit renewal applications are due 180 days prior to expiration. We do not have a
record of receiving a renewal application.
To keep this permit active please submit a completed permit renewal application along
with a $505.00 fee for permit renewal. If this project was not constructed and you do not
wish to maintain the permit, please advise. Permit application forms for renewal can be

This office received a Coastal Stormwater permit application and plans for the subject project on
April 27, 2006. A preliminary review of your project indicates that before a State Stormwater permit can
be issued the following additional information is needed.
➢ Please note that the Stormwater narrative and the calculations refer to the infiltration rate as 2
inlhr but the supplement shows 6.0 in/hr. Please correct the supplement.
➢ Please include a level spreader in the infiltration basins.
D Please provide pretreatment.
➢ Please show drainage basins.
➢ Please put elevations on overflow structures.
The above requested information must be received in this office prior to June 22, 2006 or your
application will be returned as incomplete. The return of this project will necessitate resubmittal of all
required items including the application fee. If you need additional time to submit the required information,
please mail or fax your request for time extension to this office at the Letterhead address.
You should also be aware that the Stormwater Rules require that the permit be issued prior to
any development activity. Construction without a permit is a violation of 15A NCAC 2H.1000 and ?forth
Carolina General Statute 143-215.1 and may result in civil penalties of up to $10,000 per day.

Project Description
This project consists of the development of a twelve unit condominium complex on 2.86 acres of
land located at the end of Old Lupton Road, NCSR 1326 in Pamlico County, North Carolina.
The property is the location of the currently operating Pointe Marina.
The subject property is currently developed with a single-family residential dwelling, asphalt
parking areas, and a marina office/dockhouse. The existing marina consists of wooden dock
structures. The existing docking system is not proposed to be altered under this project.
Previous CAMA Major Permit Applications have been submitted and approved associated with
bulkhead replacement and marina renovations. (LAMA Permits Attached) The project permit
packages are associated with upland development that will occur on the property to construct the
condominium units.
It is proposed that twelve residential condominium units be constructed on the 2.86 acre parcel.
Paved access drives and parking areas will be extended into the project off of Old Lupton Road.
The existing marina dockhouse will be demolished and a new dockhouse will be constructed on
an existing concrete slab as shown on the project plans. As small manmade basin located on
land to be owned by Pamlico Consort, LLC and Mr. Joseph C. Avolis and Mr. John Kevin
Avolis will be filled to accommodate the proposed development.
The proposed condominium development will be served by public water service provided by
Pamlico County. Individual septic tank systems will be constructed to serve the proposed
development. The sewage disposal areas arc located remotely from the subject property near the:
corner of Old Lupton Road and Whortsonsville Road, approximately 1,800 feet northeast of the
subject property. Sewage effluent will be pumped from the subject property to these off' -site
disposal areas. Permits have been issued for these remote disposal facilities by the Pamlico
County Health Department.
The following permits are being secured associated with the upland development portion ol'the
proposed project:

All permitting efforts associated with the renovations of the existing marina facilities are being
completed independently of the permit packages for the upland development.
Find below a general description of the proposed development as it relates to each of these
permits.
A. CANIA Major Permit
A CAMA Major permit is beino sought in order to properly execute this project. CAMA
Areas of Environmental Concern (AEC) exist on the property. The limits of the 75 foot
AEC are delineated on the project plans. Limited development is proposed to occur
within these CAMA AEC areas as a part ofthe proposed upland development. The
proposed disturbance within the CAMA AEC area as part of'the upland development
includes the installation of limited impermeable surfaces within the CAMA AEC area
and the light fillinu and grading in the AEC areas to establish finish grades.
Additionally, a small man made basin will be filled as delineated on the project plans.
The basin areas to be filled covers a total of 4,096 SF. A total of�45 linear feet of
bulkheading will be installed to retain the fill in the mouth of the manmade basin to be
filled.
The total 75 foot CAMA AEC area on the subject property is 62,623 SF, 1.44 acres. It is
proposed that a total of 4,832 square feet of impermeable surfaces be created within the
75 Boot CAMA AEC. A total of-7.71% of the 75 foot CAMA AEC will be covered with
impermeable surfaces upon the completion of the proposed upland development. The
total area to be disturbed by the proposed development in the CAMA AEC is
approximately 23,500 square feet.
A 90 linear feet section ofvinyl bulkheading is proposed to be placed in the section of'
shoreline in the area the existing dockhouse to be demolished.
A six foot wide walkway is proposed to be constructed along the existing slip on Coffee
Creek.
Otherwise, no other land disturbing activities or construction are proposed to occur
within the CAMA AEC.
B. Coastal Stormwater Permit
The subject property is located adjacent to Broad Creek, Browns Creek and Coffee
Creek. Each of these creeks has a surface water classification of SA, HQW, NSW.
Stormwater runoff frorn the project will discharge to these surface waters. Since the
receiving surface waters are classified SA, an infiltration type system is required to
comply with the Coastal Stormwater Regulations.
The subject property covers a total area of2.86 acres of land. It is proposed that a total
of 0.89 acres of impermeable surfaces be created associated with upland development for
the project. The overall built -upon density of the project is 31.0% necessitating a High
Density Stormwater permit. Since the receiving waters for this project are classified SA,
an infiltration type system is required.
All stormwater runoff from the 1'/z-inch storm will be routed to one of two infiltration
basins designed for the project. Excess runoff from upland development will bypass
above the 11/2-inch design volume will bypass the infiltration systems and will discharge
to a vegetated Swale along Old Lupton Road and ultimately to the marsh areas adjacent to
Broad Creek.
A total of (2) drainage basins are located on the subject property. One infiltration basin
is proposed for each of these drainage basins. A discussion of the development in each
drainage basin follows:
Drainage Basin No. I covers a total area of 77,578 square feet. It is proposed that a total
of�27,843 square feet of impermeable surfaces be created within this drainage basin. The
final built -upon percentage for this drainage basin is 35.9%. Considering the
impermeable and permeable surfaces within this drainage basin, the 1'/2-inch desi�(In
storm volume was calculated to be 4,376 cubic feet.
All runoff from Drainaue Basin No. 1 discharges from the impermeable surfaces towards
the entrance road. The entrance road will be constructed with an inverted crown and all
runoff will discharge to Infiltration Basin No. 1 via one drop inlet. A weir structure is
being provided in this drop inlet to divert all excess storm volume above the I'/ -inch
storm volume to the vegetated swale located along the western side of Old Lupton Road.
Bypass stormwater runoffwill flow through a total of approximately 90 linear feet of
vegetated swale prior to entering a depressed basin area adjacent to the adjacent wetland
area. Runoff at this location will accumulate and will cap the back slope of the depressed
area creating non -erosive flow prior to entering the 50 foot Neuse Riparian Buffer area.
At this point the discharge will flow across the vegetated 50 foot Neuse Riparian Buffer
prior to entering the marsh area adjacent to Broad Creek.
Infiltration Basin No. i is proposed to be constructed to contain a maximum design depth
of 1.2 feet. The bottom of the infiltration basin will occur at elevation 3.8 or
approximately''/z feet above the existing grade in this area. The total calculated capacity
of Infiltration Basin No. I is 4,7 11 cubic feet, which is greater than the 4,376 cubic foot
design storm volume.
Drainage Basin No. 2 is located on the eastern side of Old Lupton Road. This drainage
basin covers a total area of 47,216 square feet. It is proposed that a total of 10,979 square
feet of impermeable surfaces be created within this drainage basin. Tile built -upon
percentage for this drainage basin is 23.3%. Considering the impermeable and permeable
surfaces within this drainage basin, a I %-inch design storm volume was calculated to be
2,141 cubic feet. The runoff from the newly created impermeable surfaces within this
drainage basin will be diverted to Infiltration Basin No. 2. All runoff will occur to a drop
inlet which will be constructed with an overflow weir to divert excess volume above the
1 1/2-inch design storm volume to the vegetated swales along Old Lupton Road. The
bypass stormwater at this location will accumulate with the bypass stormwater from
Infiltration Basin No. I and will ultimately discharge in the same fashion as that
occurring from Infiltration Basin No. 1.
Infiltration Basin No. 2 will be constructed to a maximum depth of 1.0 feet. The
calculated volume of Infiltration Basin No. 2 is 2,211 cubic feet. The capacity of this
basin exceeds the I %-inch design storm volume of 2,141 cubic feet.
A soils investigation was completed on the subject property as a part of the initial design
efforts. A series ofhand augers were advanced on the subject property in the vicinity of
the proposed infiltration basins. The soil profile encountered at each auger location can
be described as follows:

The augers advanced in the area of Infiltration Basin No. 1 revealed soil wetness
indicators at depths of approximately 18 inches below the surface. Groundwater was
present at a depth of 28 inches at this location. Considering the elevations in this area of
the site, soil wetness conditions were found to occur at an elevation of 1.7 feet.
Groundwater was found to occur at an elevation of'0.87 feet. The bottom of Infiltration
Basin No. 1 is proposed to occur at an elevation of 3.8 feet. A minimum of two feet of'
vertical separation between the bottom of the basin and the seasonal high water table is
proposed.
Hand augers advanced in the area of Infiltration Basin No. 2 revealed soil wetness
indicators at a depth of approximately 28 inches below the surface with groundwater
occurring at a depth of approximately 35 inches below the surface. Considering the
elevations in this area of the site, wetness conditions were found to occur at an elevation
of 1.47 feet and groundwater was found to occur at an elevation of 0.88 feet. The bottom
of Infiltration Basin No. 2 will occur at an elevation of 4.0 feet, or approximately 2.5 feet
above the seasonal high water table in this area.
�Q,,,,VConsidering the sandy characteristics of the soils present on the subject property, a
design permeability rate of 2.0 inches per hour was selected as the design permeability
C� rate for the project. Considering this rate, infiltration of the I %z-inch design storm will
occur within a time period of approximately 6 to 8 hours of a storm event.
C. Erosion and Sedimentation Control Permit
An Erosion and Sedimentation Control permit will be needed to properly execute the
project since in excess of one acre of land will be disturbed. It is proposed that all upland
areas of the subject property other than areas within the Zone 1 50 foot Neuse Riparian
Buffer area and portions of the Zone 2 area be disturbed to execute the project.
Additionally, it is proposed that the small inland basin present on the northwestern side
of the subject property be felled. These are the only activities that will occur below the
normal water level on the subject property.
In addition to the onsite activities, land disturbing activities will occur along the right-of-
way area ofOld Lupton Road and within the proposed remote sewage disposal area
located 1,800 feet northeast of the subject property along Florence Road. The areas of
disturbance are presented on the project plans. The total proposed disturbed area for this
project is 5.56 acres. A permit fee in the amount ofS300 is included with the permit
application.
Erosion and Sedimentation Control devices will be utilized on the subject property to
protect the abutting surface waters and surrounding properties. Permanent vegetation
will be established on the site in order to stabilize the finish surf -aces.
D. Pubic Water Supply Permit
A Public Water Supply permit will be sought to properly execute the project. An existing
6-inch water main is located adjacent to the property along Old Lupton Road.
Connections will be made to this water main. It is proposed that 6-inch water mains be
extended into the project area in order to provide individual water services for each of the
twelve condominium units and to replace the existing public water service to the marina
faciiity.
The existing water distribution system in this area is owned by Pamlico County. Projcct
plans and specifications for the water distribution system will be submitted to the State of
North Carolina through Pamlico County for approval.
E. On -Site Wastewater Permit
Sewage disposal for the project will occur to rewrote sewage disposal areas located
approximately 1,800 feet northeast of the subject property along Florence Road. The
Pamlico County Health Department has issued onsite septic permits for four b-bedroom
septic systems. A copy of the applicable permits are attached. It is proposed that a septic
tank and pump basin be constructed adjacent to each cluster of three residential units. All
sewage will flow to the septic tanks. Effluent will discharge from the septic tanks to
individual pump tanks, where the effluent will be pumped to the remote drain field areas.
F. NCDOT Driveway Permit
An NCDOT Driveway permit will be secured for the project to make drive connections
to Old Lupton Road.
C. NCDOT Encroachment Agreement
An NCDOT Encroachment Agreement will be secured for the project in order to install
the utility improvements presented on the project plans along Old Lupton Road.
H. Preconstruction Notification (PCN)
A PCN application form will be submitted to the U.S. Army Corps of* Engineers to secure
approval to till the small manmade basin depicted on the project plans. The same
application will be submitted to the North Carolina Division of Water Quality in order to
secure a 401 Water Quality Certification to fill the inland basin. Additionally, a Neuse
Riparian Buffer Variance will be sought with this sarne permit to construct a new marina
club house on the existing; concrete slab located partially in lone l and lone 2 of the
Neuse Buffer.

9. NARRATIVE DESCRIPTION:
Project Setting
The project site is located at. the terminus of SR1326 at 256 Old Lupton Road in the
community of Whortonsvllle, Pamlico County. The property is located at the confluence of
Broad, Brown, and Coffee Creeks. The project site is a 2.86 acre parcel with an elevation of
approximately 3.5' — 4.0' above NWL. A few scattered .pine and live oak trees populate the site
while the majority of the site is.vegetated'with sod. The tract has 1023 linear feet of shoreline
with several fringe areas containing cord grass, black needlerush, and salt reed grass along the
west and south side.of the.property.
The east side of the prop erty.borders Coffee Creek and has been stabilized with a vinyl
bulkhead. A boat ramp and 10 boat slips have been constructed adjacent -to the bulkhead. On the.
south side of the property, a dock house projects out over the water and leads to a 36-boat slip
dock which projects out into Broad Creek. The existing docks with a combined total of 46 slips
form Pointe Marina. Approximately twenty-two unmarked parking -spaces for the marina patrons
are provided in an asphalt parking lot located between the two sets of docks. The southern
shoreline is protected with a partial wood/partial vinyl bulkhead with -the exception of a 100' -
long section of wetlands located on the west side of the dockhouse. The northwestern portion of
the property is stabilized with a wooden bulkhead and terminates in a 39' wide x 105' long man
made basin that is accessed by a small boat ramp leading into the basin. An unoccupied single-
family dwelling is located on the western portion of the tract approximately 65' landward of the
NWL. Currently 9% of the area within the Estuarine Shoreline AEC and 13% of the entire lot is
covered with driveways and structures.
The neighboring lot to the north of the project site has a single-family dwelling but currently .
does not have a dock. The neighboring lot to the south also has'a. single-family dwelling on it
and does not.have a dock. The majority of the surrounding properties in the community are
developed with single-family dwellings. The Pamlico County Land Use Plan categorizes the
area of the project as Rural with Services, with all AEC's classified as Conservation.
The waters of Broad, Brown, and Coffee Creeks in the vicinity of the project are classified as
SA High Quality Waters and Nutrient Sensitive Waters by the EMC. Brown and Coffee Creeks
are classified by the Division of Marine Fisheries as a primary nursery area, but are closed to
shellfish harvesting by the Shellfish Sanitation Section of the Division of Environmental Health.
The waters in the project area are in the range of —3' to -6' below NLW. The bottom consists
of fine to course sand. No submerged aquatic vegetation was observed during the site visits,
however, it has been observed at other sites on Brown and Coffee Creeks.
Project Proposal
The applicant proposes to remove from the property the existing shed and single-family dwelling
and construct twelve condominium units. The condominiums are to be constructed in four groups of
three units. Each unit is to be 28' wide by 55' long and 47' in height with three floors. The first floor
elevation will be at +6' NGVD and will be used for storage space. The second floor will be at +16'
NGVD and will be the lowest floor with living space. The units will be placed a minimum of 54'
landward of the normal water level. An 18' x 125' paved driveway off the west side of SR1326 is
proposed to provide access to condominium units 1 thru 9. Six irregular shaped parking areas with a

total of approximately 6,765 square feet of parking surface are to branch off the driveway to
provide parking areas for units 1 thru 9. A 17' x 80' paved driveway: would extend to the east from
the terminus of SR1326 to provide access to units 10 thru 12. Parking for units 10-12 would.be
located.in three paved parking areas with a total of approximately 960 square feet of parking surface.
Nine additional parking spaces are proposed on the east side of the property adjacent to -the boat
ramp. The nine spaces would be a reinforced turf parking area 18' wide x 80' long. - To provide
.pedestrian access to the docks from the coridorniniums and parking areas, a 6' wide x 525':long
.wooden walkway is proposed to extend to the water and along the bulkhead between the two sets of
docks.
Six septic mounds have been constructed on a 215' x 398' offsite parcel on the south.side of
SR1327 approximately 500' east of its intersection with SR1326. Theassociated septic tanks are to
be installed adjacent to the proposed condominium structures. A 2" PVC force main will be
constructed to.connect the components. The sewer force main will be installed along the -right-of-
ways of SR1326 and SR1327 and will cross under the culvert where Coffee Creek flows under the
road.
A 6" water main from the -Pamlico County Public Water System. extends to within 40.' of the
applicant's property and is located on the east side of SR1326. The applicant proposes to construct a
6" PVC water main extension of the county's line for 25 linear feet under the road by directional
bore. The line would then continue to the west for 257 linear feet towards condominium unit 3. A
second 6" PVC water main would extend from the first line and parallel the west side of SR 1326 for
approximately 162 linear feet towards condominium unit 10.
The applicant requests to demolish the existing dock house that currently extends waterward of
the NWL and replace it with a new dock house. The new dock house would be constructed within
the footprint of an existing concrete slab attached to the current dock house and would allow the
structure to be located landward of its present position. The dock house as proposed would be 27'
wide x 63' long and would have a first floor elevation of +8.0' NGVD.
The project would require the 39' wide x 105' long man made boat basin on the west side of the
property be backfilled and stabilized so that the condominiums may meet the required setbacks of the
Neuse River Basin Riparian Buffer rules. This would involve the installation of 45 linear feet of
wooden bulkhead across the mouth.of the basin that would tie into the existing wooden bulkheads on
the outside of the basin. The existing bulkhead around the inside of the basin and the existing boat
ramp at the head of the basin will be removed. Approximately 4,100 square feet of area within the
basin would then be filled with 750 cubic yards of sand and brought up to the level of the high
ground surrounding basin. The applicant also requests to install 90 linear feet of vinyl bulkhead
landward of the N WL in the area of the proposed dock house to stabilize the shoreline and reduce the
risk of erosion of the dock house foundation.
An engineered stormwater system is required for this project as it exceeds the threshold for low -
density development. The stormwater from the site will flow into two infiltration basins. Infiltration
basin #1 will be centrally located between condominium units 1-9. It will have a total volume of
4,711 cubic feet. Infiltration basin #2 will be located on the north side of condominium units 10-12.
It will have a total volume of 2,211. cubic feet. A portion of the existing pavement on the east side
of the property between the boat ramp and the dock house would be removed for the construction of
infiltration basin #2. The property will be graded to drain into the infiltration basins and associated

piping will be installed to convey. stormwater to the existing 3''x 120' vegetated swale along
SR1326 which will discharge to the marsh adjacent to Broad Creek.
Anticipated Impacts
The construction of the project will result in the disturbance of 204,564 square feet of high
ground, of which 4,832 sq. ft. within DCM's 75' Estuarine Shoreline would be made impervious -
surface for the condominiums, road, parking areas, and other infrastructure. This equates to
approximately 8% inipervious'surface within DCM's 75' Estuarine Shoreline AE.C, and a 3 1 %.
impervious surface for'the entire. tract. The filling of the elan made boat basin will result in the
.usurpation and filling of 4,095 sq. ft. of public trust area. and shallow water habitat. All proposed
development is located outside of any Coastal or Section 404 Wetlands... The wooden walkway
will result in 2,328 sq. ft. of additional covered surface within the N.C. Division of Water
Quality's Neuse River Basin Riparian Buffer Zone. Sedimentation and stormwater control
techniques have been planned for which should minimize any impact from the development of
the site. A localized and temporary increase in turbidity can be expected during the in -water
portions of the construction of.the bulkhead.
The existing marina will continue to serve as a. commercial marina, however, twelve of the
slips on the main pier will serve the owners of the coridorniniums.
