REQUEST FOR MORE INFORMATION
Dear Mr. Mikesh:
On March 16, 2007, the Division of Water Quality (DWQ) received your application dated March 16, 2007, to
fill or otherwise impact 0.058 acres of 404/wetland and 1,846 square feet of Zone 1 Neuse River basin
protected riparian buffers and 368 square feet of Zone 2 Neuse River basin protected riparian buffers to
construct the proposed residential subdivision. The DWQ has determined that your application was incomplete
and/or provided inaccurate information as discussed below. The DWQ will require additional information in
order to process your application to impact protected wetlands and/or streams on the subject property.
Therefore, unless we receive five copies of the additional information requested below, we will have to move
toward denial of your application as required by 15A NCAC 2H .0506 and will place this project on hold as
incomplete until we receive this additional information. Please provide the following information so that we
may continue to review your project.
Additional Information Requested:
Please provide documentation that DWQ or Forest Resources has made intermittent/perennial stream
determinations on the site or contact DWQ to schedule intermittent/perennial stream determinations on
the site.
2. You have proposed a bridge for one of the proposed road crossings. Please verify that you are
proposing a bridge and not a bottomless culvert at this location
3. Please indicate proposed lot layout as overlays on the site plan at a scale of no smaller than 1 "=50' for
all parts of the site, including "the Park At Summerwind Medical", all multifamily areas; and the activity
center and Senior Center so we can be certain that these areas can be built without buffer impact.
4. Please provide diffuse flow provision measures, applicable worksheets and a signed and notarized
Operations and Maintenance agreement for the site.
5. Please indicate all stormwater outfalls on the site plan and a stormwater routing plan for the entire
development.

6. Based on recent communication with EEP, that agency will now require written confirmation of their
willingness to be responsible for buffer mitigation. Please contact Ms. Kelly Williams with EEP to
receive this written approval.
7. In our February 1, 2007, letter, you were asked to provide "detail for the stormwater management
practices". This information was not provided in your March 16, 2007 submittal. Please submit this
information along with calculations and worksheets for these BMPs.
Also, we noted in your March 16, 2007, letter (page 2, paragraph 2), that you believe that there are no
regulated Waters on site since you believe that "the definition of ephemeral (stormwater) stream is so
broad that virtually any project in the Neuse River basin would be required to obtain written
concurrence." As you know, the Neuse River buffer rules apply to intermittent and perennial streams
and not to ephemeral channels. Since you have chosen to buffer all streams shown on the USGS or
Johnston County soil survey, there is no need to field identify ephemeral versus intermittentlperennial
channels. If you are unclear as to the technical distinction between ephemeral and intermittent/perennial
channels, we suggest you attend the four-day stream identification class taught by NCSU and DWQ
where the difference between ephemeral and intermittent/perennial streams is taught.
Please contact the DWQ within three weeks of the date of this letter to verify that you have received this letter
and to provide us with a date that we may expect to receive this requested information. If we do not receive
this requested information within one week of the date you indicate it will be forthcoming, your project will be
withdrawn and you will need to reapply with a new application and a new fee. Please contact me in writing
and Lauren Cobb of the DWQ Raleigh Regional Office. If we do not hear from you within three weeks, we
will assume that you no longer want to pursue this project and we will consider the project as withdrawn.
This letter only addresses the application review and does not authorize any impacts to wetlands, waters or
protected buffers. Please be aware that any impacts requested within your application are not authorized (at
this time) by the DWQ. Please call Ms. Cyndi Karoly or Mr. Ian McMillan at 919-7~3-1786 if you have any
