A review of our files shows that state stormwater permit SW7051110 was issued for this project to Day Beacon 49, LLC on December 19, 2005, followed with a minor modification on February 21, 2008. This site was permitted as a redevelopment type project with a stormwater infiltration system. I am enclosing a copy of the state stormwater permit for your review. You will see that this permit does not automatically transfer to subsequent owners; therefore, you will need to request a state stormwater permit for this proposed development. PROJECT SUMMARY: The applicant proposes to modify the existing authorized project proposal to include an additional ten slips for a total of20 slips, by increasing the width and length of the authorized pier structure from 6' x 125' to 8' x 262'. Major Modification of Major CAMA Permit No. 195-07 Belhaven Fish and Oyster Town of Belhaven Beaufort County Project Setting The .88 acre project site is located south of the intersection of Pamlico and Water Streets in downtown Belhaven adjacent Pantego Creek and Wynnes Gut, Beaufort County, North Carolina. The site was formerly developed as a seafood processing business known locally as the Belhaven Fish and Oyster Company. The site was developed with buildings adjacent and over the water and a single-+-250' long pier in Pantego Creek and a dock along Wynnes Gut. The derelict pilings from the long pier in Pantego Creek remain today. The site was eventually abandon and was purchased by the Town of Belhaven. In early 2001 the buildings were demolished by the Town of Belhaven. Significant amounts of broken concrete, resultant of the demolition work, was placed along the shoreline. Notice of Violation No. 01-20B was issued on t2 June 2001 for placement of this broken concrete without the proper permits. The broken concrete remains as it was placed in compliance with the standards Ior shoreline stabilization. There is an area of poured concrete forming a ±20' wide x ±60' concrete pad that intersects with the shoreline adjacent Pantego Creek. The site was filled and graded upon completion of the demo work. Minor CAMA permit no. 0 1 -0 1 was issued on 29 June 2001 authorizing the filling and grading work. The project site was subject of a Major CAMA permit review in 2007 submitted by the previous landowner Dixon Hoyle .Partnership LLC. Major CAMA Permit No. 195-07 was issued on 14 December 2007 to Dixon and Hoyle Partnership, LLC for the development of the property into a ten unit condominium with associated amenities including a 6' wide x 125' long ten slip pier. The property was subsequently sold by Dixon Hoyle to the current owner, a Mr. Murphy Moore. The aforementioned Major CAMA Permit No. 195-07 was transferred on 22 December 2010 to the current owner. None of the work authorized by this permit has been undertaken. The Town of Belhaven has an easement on the property along Wynnes Gut. The Town applied for and received Major CAMA Permit No, 122-09 on 17 September 2009 for the construction of a dock/boardwalk with 9 slips, some bulkhead work, parking and a picnic pavilion. This work was funded through a Boating Infrastructure Grant, administrated on behalf of the US Fish and Wildlife Service, by the North Carolina Division of Marine Fisheries. The dock/boardwalk and bulkhead have just been completed earlier this year. Other than these recent development activities the site remains vacant today consisting of bare compacted dirt and opportunistic, scattered.upland grasses. The adjacent riparian properties to the east are both commercial railways used to haul boats for maintenance and repair. The third property to the east is a condo and marina project "Day Beacon no.9". The next property to the west is a regional hospital. Major Modification of Major CAMA Permit No. 195-07 Belhaven Fish and Oyster Town of Belhaven Beaufort County Page Two The riparian area in Pantego Creek within 100' of the nonnal water level (NWI.) is generally shallow (3' to 4') and is full of debris from the previous, abandon industrial development. The creek bottom is littered with broken concrete rubble, tires, steel cable, relic pilings both above and below the surface, etc. The US Army Corps of Engineers, Navigation Branch, maintains a navigation channel offshore the project site. The navigation channel is 372' offshore the NWL. The channel setback is 52'. Water depths deepen gradually reaching 5' or greater beyond 200' from shore. The Wildlife Resources Commission classifies Pantego Creek as Inland Waters. This area is closed to shellfishing. Project Description The new owner request to modify Major CAMA Pen -nit No. 195-07 to construct a longer and wider pier from 6' x 125' to 8' wide x 262' long to accommodate ten more slips for a total 20 slips. The slips will be perpendicular to the main pier structure. The applicant is requesting more slips in order to provide dockage, fuel and a marine pump out to transient boats traveling the Intracoastal Waterway. The proposed slips will be shifted further offshore than originally proposed, to avoid the concrete and assorted debris and take advantage of slightly deeper water. There will be 10 slips with a dimension of 18' wide x 30' long, 6 slips with a dimensign of 16' wide x 30' long and 4 slips with a dimension of 14' wide x 30' long. Access to the slips will be provided by 10 - 3' wide x 16' long finger piers. The applicant is also proposing an 8' wide x 60' long T-Head platform at the end of the pier. Anticipated Impacts The proposed project will result in additional boat traffic in the project area and their associated impacts. The pier will shade 3,056 ft2 of Pantego Creek bottom. The slips will occupy 9,960 ft2 of Public Trust Area in Pantego Creek. There will be some localized short-term turbidity during construction of the proposed pier. The proposed pool installation results in minimal impervious area increases (208 sf for the pool house and 50 sf for the sidewalk 1 ADA ramp) and the existing interconnected infiltration basins have adequate capacity to handle the slight increase in runoff. The following narrative, application and calculations will demonstrate the parameters of the original design with the addition of the swimming pool improvements and will illustrate an effective stor nwater management system in full compliance with all state regulations. -iEIVED REC. Stormwater Collection, Treatment, Storage and .Disposal NOV 15 2007 DWQ Collection psoa # The stormwater runoff is collected and directed via site grading, curb and gutter, and drop inlets which convey runoff to the infiltration basins via storin sewer. The storm sewer consists of double -wall 24" I-IDPe pipe and also serves to interconnect the three basins such that the storage level in the basins will equalize during a storm event and during infiltration. Treatment The basins offer several methods of stornnwater runoff treatment prior to release. Runoff from paved areas sheet flows to drop inlets and is directed to the wet detention basin via a storm sewer system. Large particulates and debris accumulate at the drop inlet grates. Runoff discharges from the storm sewer system via upwelling within drop inlets placed within each basin. This upwelling also serves to trap large debris and sediment within the drop inlets (which will need to be cleaned periodically as part of the maintenance of the system). The basin bottonns are currently grassed. This plan proposes that the basin bottom under the pool deck be covered in a layer of clean sand. The basin side -slopes which are not covered with pool deck or walkway are to remain grassed. The basin side slopes which are to be covered with pool deck or walkway are to be lined with a 4" thick layer of #57 stone over filter fabric. The runoff undergoes filtration of fine particulates and pollutants by the vegetation within not only the basin and swale bottoms but also the basin and swale side walls. A second treatment method is also available when the stormwater runoff infiltrates into the subsurface. When the water passes through the void spaces between the particles of soil material particulates and pollutants that have a particle or grain size larger than the void size will be filtered out. In addition some pollutants will adsorb to the surface of the soil particles. The benefit of this adsorption will prevent the pollutants from reaching the water table and in some nutrient and microbe rich areas existing within the subsurface the pollutants will be consumed as food and undergo a natural biodegradation. if the weather yields precipitation that exceeds the storage capability of the basin system then the accumulated runoff will overflow the stone sewer via upwelling within a drop inlet located on the west side of the property which discharges to a 46' vegetated swale. Storage This infiltration basin system offers a portion of storage above the ground surface and a portion of storage within the void spaces available in the subsurface. The runoff generated by a 1 inch storm will require 4,010 ft' of storage. The storage available above the ground surface is 4,203 ft' (equivalent to runoff generated by 1.05 inch storm). Additional storage is available within the subsurface in the two (2) feet of separation between the basin bottom and the seasonal high water table and the additional separation between the submerged basin side -slopes and the seasonal high water table. A more detailed discussion of subsurface storage volume can be found within the soils section of this narrative. Disposal As discussed in previous sections the majority of stormwater runoff entering this management system will be infiltrated, therefore infiltration is the primary source of disposal. The system has been designed with storage so that this site will have the capability to handle in excess of a 1 inch storm event. At such time that the capacity were to be exceeded the system will then overflow into the adjacent grassed Swale (vegetated filter) via upwelling within a drop inlet structure. Soils At the time of the original permit, Quible & Associates performed on -site soil borings to verify soil type and determine elevation of mean high groundwater. Information collected on site indicated that the soils found throughout this site were composed of a mixture of sands, fied significantly over time through the urban development of silts, and clays which have been deposited and modi this area. These findings generally correlate with the description mapped and discussed in the United States Department of Agriculture, Soil Conservation Service, Soil Survey of Currituck County, North Carolina, which map the soil for this site as follows: Ur - Urban land, Urban areas which have generally been greatly altered by cutting, filling, grading and shaping. Infiltration rates can vary wildly within these soils. Pursuant to this variable condition, Quible & Associates performed multiple soils borings and slug tests to verify minimum adequacy of the soils with respect to infiltration. Soils boring logs are included in the appendix of this narrative. In order to address the variability in the in -situ soil, the entire infiltration basin footprints (below the 6' contour) were excavated to a depth of 5 feet below grade and backfilled with sand (SP Soils). As mentioned in the storage section of this narrative a more detailed description of the method of determining the subsurface storage volume available as a function of the soils would be discussed in this section. This value should be considered conservative. A distance of two vertical feet is to be maintained between the infiltration basin bottom and the seasonal high water table elevation. Soil borings indicate a seasonal high water table of approximately 2.0 feet MSL. The proposed infiltration basin bottom elevation was designed at an elevation of 4.5 MSL, providing for a vertical separation of 2.5 feet. Within this separation distance exists a volume of soil containing a minimum of approximately 20% void space. This void space will become filled with water and provides for an additional volume for stormwater runoff storage. Calculations A set of sample calculations can be found within appendix portion of this narrative. Conclusions The proposed pool addition is consistent with the original stormwater design, minimally increases the storage required for which the existing basins have adequate capacity, and maintains the affected basin in a stabilized, accessible configuration. The existing system will offer preliminary, primary and secondary methods of treatment as well as an alternate method of disposal should the capacity be exceeded. The soils on site have infiltration rates approximately 0.52 inches per hour, conditions ideal for an infiltration basin system. After every ntnoff producing rainfall event and at least monthly inspect the infiltration system for erosion, trash accumulation, vegetative cover, and general condition. 2. Repair eroded areas immediately, re -seed as necessary to maintain adequate vegetative cover, mow vegetated cover to maintain a maximum height of six inches, and remove trash as needed. 3. After every runoff producing rainfall event and at least monthly inspect the bypass, inflow and overflow structures for blockage and deterioration. Remove any blockage and repair the structure to approved design specifications. 4. Remove accumulated sediment from the pretreatment system and infiltration basin annually or when depth in the pretreatment unit is reduced to 75% of the original design depth. The system shall be restored to the original design depth without over -excavating. Over -excavating may cause the required water table separation to be reduced and may compromise the ability of the system to perform as designed. Removed sediment shall be disposed of in an appropriate manner and shall not be handled in a manner that will adversely impact water quality (i.e. stockpiling near a stormwater treatment device or stream, etc.). A benchmark shall be established in the pretreatment unit. The benchmark will document the original design depth so that accurate sediment accumulation readings can be taken. The measuring device used to determine the depth at the benchmark shall be such that it will give an accurate depth reading and not readily penetrate into accumulated sediments. When the design depth reads - 0, 9 feet in the pretreatment unit, the sediment shall be removed from both the pretreatment unit and the infiltration basin. 5. If the Division determines that the system is failing, the system will immediately be repaired to original design specifications. If the system cannot be repaired to perform its design function, other stormwater control devices as allowed by NCAC 2H .1000 must be designed, approved and constructed. PROJECT SUMMARY: The applicant proposes to construct two piers/docks with 42 slips, a bulkhead along portions of the shoreline and four buildings totaling 36 condominium units with associated roads, parking, walkways, and utilities. i Day Beacon 49 Town of Belhaven Beaufort County Project Setting The 2.2-acre project site is located in the Town of Belhaven at 386 East Water Street adjacent Pantego Creels in Beaufort County, North Carolina. This project and site was subject of a recent Environmental Assessment document. Review of this document was completed in early October 2005 and resulted in a Finding of No Significant Impact. The site was formerly known as Sea Safari Limited a blue crab processing business. The entire site while Sea Safari was in operation was covered ui impervious surface (90.6%). Impervious surfaces included several buildings, concrete and gravel. The shoreline along Pantego Creek was stabilized with both concrete rubble and a deteriorated wooden bulkhead. In some areas the wooden bulkhead is not evident, as it failed overtime it was buried in concrete rubble. In some areas, this rubble has migrated offshore. There exist two different sets of dilapidated pilings from previously existing piers in Pantego Creek. An intact pier exists within the riparian area of the project site. This pier/dock is used for permanent mooring of vessels patronizing the Belhaven Waterway Marina located adjacent to the project site on the north side. There is a federal channel with a project depth of 12' in Pantego Creek offshore of the project site. There is a rectangle shaped peninsula approximately 20' wide x 80' long located on the south/downstream side of the property. This area was stabilized with a bulkhead and covered with a open sided, tin roof structure. The bulkhead has failed along with the open sided tin roof. The bulkhead along the offshore end of the peninsula failed sometime ago as this area was covered with a wooden deck built on top of bulkhead pilings. Remnant boards exist that demonstrate the previously existing bulkhead alignment. Concrete rubble is present landward of the failed bulkhead under the wooden deck and along the peninsula shoreline. Water depths range from 3.5' to 10' within the project site's riparian area in Pantego Creek and 3.0' to 3.5' in the basin on the north side of the project site. There exist debris fields of concrete rubble in the project site's nearshore area, most likely deposited there by storms washing against the concrete rubble placed over the failed bulkhead. The current owner/applicant has cleared the property removing all the buildings and associated infrastructure, essentially clearing the site to bare ground. This work was undertaken in early 2005. CAMA General permit no. 40700-B was issued on 29 March 2005 for 500 linear feet of bulkhead that was subsequently built. The new bulkhead was built starting from the peninsula on the south side of the property to the basin adjacent the project on the north side. The entire site has been filled and rough graded in preparation for the proposed upland development. The owner has an approved erosion and sedimentation control plan for the demolition and removal of the buildings and for the fill and rough grade work. There is no vegetation present on the site. I . Pantego Creek in the vicinity of the project site is classified as SC -NSW by the Environmental Management Commission and Inland Waters by the Wildlife Resources Commission. This area is closed to shell fishing. Project Description The applicant proposes to develop the tract into condominiums and a private marina. Proposed are 4 - three story buildings housing 36 - two -bed room units and an open water marina in Pantego Creek consisting of two piers with a total of 40 slips. Proposed are 19, 5'wide x 15' long finger piers providing access to the slips. The proposed piers are 8' wide by 206' long and 10' wide x 199' long. The slips will be 15' wide x 30' long. There are two slips proposed side to the bulkhead in the basin on the north side. These slips will be 15' wide x 28' long. The total number of slips available at the marina will be 42. The applicant proposes to remove all derelict pilings and debris fields within the riparian area of the project site. The applicant has committed to remove the existing pier currently utilized by Belhaven Waterway Marina. An 8' wide concrete walkway is proposed adjacent to and landward of the existing bulkhead. The applicant also proposes to complete the remaining bulkhead work around the peninsula and in the basin on the north side of the project site. The bulkhead around the peninsula is to be constructed in it's original alignment. The applicant also proposes to reconstruct the roof that covered the peninsula. There will be 72 asphalt parking places. Also proposed are three stormwater ponds. Wastewater, from the condo units will be handled by the Town of Belhaven sewer system. The applicant also proposes to install a marine pump out system. Fuel services will not be offered at the marina or any vessel maintenance. Anticipated Impacts The proposed project will result in additional boat traffic in the project area and their associated impacts. The piers will shade 5,063 ft' of Pantego Creek bottom. The slips will occupy 19,033 ft' of Pantego Creek bottom. Replacement of the previously existing bulkhead will result in the filling of 580 ft' of Pantego Creek bottom. There will be some localized short-term turbidity during construction of the proposed bulkhead, piers, slips and debris removal. As a further reference the property lies at approximately 35*32 '9" N latitude x 76°37"20" W longitude. Existing feature on the tract include 500 linear feet of bulkhead constructed utilizing CAMA General Permit # 40700B, a deteriorated 95' long by 25' wide roofed, open side pavilion that extends into Pantego Creek and a large number of relic pilings in the public trust waters of Pantego Creek where an old dock system was located.. The application proposes to construct 36, two bedroom condominium units on the subject tract with 9 units per building in 4 separate buildings. The application also proposes the construction of 42 new boat slips within the public trust waters of Pantego Creek for the exclusive use of owners and guests of the condominium units, including construction and installation of associated roads, parking, walkways and utilities as depicted on Attachment C. Also proposed is the reconstruction of the bulkheaded and roofed, open sided pavilion located at the southeast corner of the tract. The facility will be used as an amenity for the owners. The bulkhead will be constructed in the same alignment and configuration of the existing deteriorated bulkhead.. As a part of the bulkhead construction, an area of open water that extends approximately 20' landward of the existing bulkhead that will be filled to facilitate the construction of the pavilion deck.. The roof line will be re -built utilizing the surveyed footprint of the existing structure. The pavilion will remain open sided. The application also requests permission to remove existing, deteriorated pilings and wooden and concrete debris that currently lies on the bottom in proximity to the tract. Attachment C depicts the general location of the materials requested for removal. Prior to the purchase of the property by Dixon/Hoyle, the subject tract operated as a blue crab processing plant known as Seafood Safari, Ltd. Attachment C provides an as -built drawing of the crab plant and associated infrastructure. Existing impervious surface on the site during that j- period was calculated to be 87,575 sq foot or 90.6% impervious surface coverage. Upon purchase of the tract by Dixon/Hoyle, and in coordination with the Town of Belhaven and Beaufort County, the owners contracted with Armstrong Construction to demolish the Seafood Safari site including the removal of all buildings, tanks, and impervious roads and parking from the property. At present that work has been accomplished and the site has been filled and rough graded to approximate final grade elevations. Also please note that a point source discharge of processing water into Pantego Creek associated with the crab cleaning and packing facility has been eliminated. The development as proposed in the enclosed application will have a total impervious surface coverage of 64.7%. Coverage with the 30' Tar -Pamlico, Zone 1 buffer totals 46.0% and within the 50' buffer the total is 40.6%. This is a reduction of impervious surface on the entire tract of 25.9%, a reduction within the 30' buffer of 42.6% and a 40.6% reduction in the 50' buffer. All proposed impervious surface within the 50' Tar -Pamlico buffer will be on areas that were previously covered with impervious surface. The proposed boat moorings include the construction of two wooden pile supported piers, designated as Pier 1 and 2 on Attachment C. Pier i is 8' wide x 206 feet long with a single row of dock boxes. Pier 2 is proposed at 10' wide x 199' long. (Note: the 10' in width is to accommodate dock boxes on both sides and allow for 6' of clearance in the center of the pier system.) Of the 42 boat slips indicated on the plan view plat, 40 are stern to, (15' wide by 30 ft long) with finger piers and mooring pilings. The remaining two slips are side -to and are 15' wide by 28' long. Depicted on the plan -view plat is the alignment of the federal channel in Pantego Creek. Per our discussion with Howard Vamum of the USACE the moorings need to be set a minimum of 52' from the near edge of the channel.
