J. D. M of The Outer Banks, Inc. is proposing to construct a Sonic Drive -In and
small retail and office strip center in Grandy in the Poplar Branch Township of Currituck
County. Construction on the 13.22 acre site will include an entrance drive, connector
road, two proposed buildings with required parking, septic systems, a wet detention
basin, and a stormwater infiltration basin.
The site consists of four drainage areas. Drainage Area 1 contains 1.82 acres
along the Carotoke Highway frontage. This drainage area will contain 0.21 acres of
building and canopies and 0.8 acres of asphalt and concrete for a total impervious area of
1.01 acres or 55.49% of the drainage area. Stormwater will drain across the paved areas
to a grass lined swale that drains to the infiltration basin located across the front of the
site. Some of the stormwater will sheet flow across a grassed area directly to the
infiltration basin. The basin has been designed to store runoff from the first inch (I") of a
rain event. The required storage volume for Drainage Area 1 is 4,109 cf. The basin will
actually store 6,290 cf or the equivalent of runoff from 1.53" of rain. The basin bottom is
at elevation 9.0. This provides more than 24" of separation between the seasonal high
water table (estimated at 6.0) and the bottom of the basin. The storage elevation is 11.5.
Using an infiltration rate of 2 in/hr for the soils, the 2.5" water depth in the basin should
draw down in approximately 22 hours. Runoff in excess of the 1.53" will pass through
the pond and will discharge into the NC Dept. of Transportation drainage system that
currently drains this property and the highway. The drainage system discharges into a
tributary that drains into Poplar Branch Bay.
Drainage Area 2 contains 9.55 acres. This drainage area will contain the septic
systems and the vacant area between the site development and the septic systems and
detention pond. Impervious areas will include 0.13 acres of building and canopy area and
1.36 acres of asphalt and concrete for a total impervious area of 1.49 acres or 15.60% of
the drainage area. Stormwater from the impervious surfaces will be collected in grass
lined swales with 3:1 side slopes. The swales will drain to the proposed detention pond
located at the rear of the site. Stormwater runoff from the unimproved areas of the
drainage area will sheet flow across the natural grade of the site. The pond has been
designed for 90% TSS removal. The surface area provided is 2.6 times larger than
required to allow for potential future development and to reduce the stage elevation in the
basin.
Drainage Area 3 contains the 2.98 acres at the northern end of the tract. The only
development currently proposed for area is the connector road that ties to Grandy Road.
The impervious area is 0.18 acres or 6.04%. Stormwater treatment measures will be
designed for this for this portion of the site when specific development is planned.
Drainage Area 4 contains 0.81 acres at the southern end of the tract. Like
Drainage Area 3, the only development planned is the connector road that is being
required by Currituck County. The road will contribute 0.11 acres of impervious surface
or 13.58% of the drainage area. No future development anticipated on this portion of the
site. Anything planned in the future will require its own stormwater management.
Multiple soil borings were made on the site. In the area of the proposed
infiltration basin the existing grade ranges from 12.0 to 13.0. The soil was a sandy loam
for the first 18-22" where it changed to a brightly colored coarse sand. No soil wetness
had been encountered at the 72" depth of our auger. This corresponds to the soil
classification of CnA (Conetoe) as shown on the Currituck County Soils Map as prepared
by the U. S. Department of Agriculture, Soil Conservation Service. The permeability of
this soil is rapid (6-20 in/hr) at 0-23", moderately rapid (2.0-6.0 in/hr) at 23-43" and rapid
(6-20 in/hr) at 43-80". Given the permeability of this soil and the depth of the water
table, we feel that an infiltration basin will be the most appropriate method of stormwater
treatment for this portion of the site.
In the area of the proposed detention pond the soils were different from the front
of the site. The clay content was higher and we encountered soil wetness at
approximately 42". This is consistent with the soil classification of Pt (Portsmouth) as
shown on the Currituck County Soils Map as prepared by the U. S. Department of
Agriculture, Soil Conservation Service. With existing grade near 10.50, the seasonal
high water table is about 7.0. Given the higher water table, we feel that a wet detention
basin would be the most appropriate method of treatment in the rear portion of the site.
The disturbed area for development is approximately 11 acres. This area includes
the portions of the tract required to be disturbed for construction of the buildings, road,
parking and drives, drainage, detention basin, infiltration basin, and septic systems.

The Washington Regional Office received a completed Stormwater Application for the subject project on December
15, 2003. Staff review of the plans and specifications has determined that the project, as proposed, will comply with the
Stormwater Regulations set forth in Title 15A NCAC 2H.1000. We are forwarding Permit No. SW7031218 dated January 15,
2004 to JDM of The Outer Banks, Inc. for the construction and operation of grassed swales and a wet detention pond and an
infiltration basin to serve Sonic of Grandy located in Grandy, NC.
This permit shall be effective from the date of issuance until February 5, 2014 and shall be subject to the conditions
and limitations as specified therein. Please pay special attention to the Operation and Maintenance requirements in this
permit. Failure to establish an adequate system for operation and maintenance of the stormwater management system will
result in future compliance problems.
If any parts, requirements, or limitations contained in this permit are unacceptable, you have the right to request an
adjudicatory hearing upon written request within thirty (30) days following receipt of this permit. This request must be in the
form of a written petition, conforming to Chapter 150E of the North Carolina General Statutes, and filed with the Office of
Administrative Hearings, 6714 Mail Service Center, Raleigh, NC 27699-6714. Unless such demands are made this permit
shall be final and binding.

4. No homeowner/lot owner/developer shall be allowed to fill in, alter, or pipe any vegetative practices (such as swales)
shown on the approved plans as part of the stormwater management system without submitting a revision to the
permit and receiving approval from the Division.
5. The following items will require a modification to the permit:
a. Any revision to the approved plans, regardless of size
b. Project name change
C. Transfer of ownership
d. Redesign or addition to the approved amount of built -upon area
e. Further subdivision of the project area.
In addition, the Director may determine that other revisions to the project should require a modification to the permit
6. The Director may notify the permittee when the permitted site does not meet one or more of the minimum
requirements of the permit. Within the time frame specified in the notice, the permittee shall submit a written time
schedule to the Director for modifying the site to meet minimum requirements. The permittee shall provide copies of
revised plans and certification in writing to the Director that the changes have been made.
II. SCHEDULE OF COMPLIANCE
The permittee will comply with the following schedule for construction and maintenance of the stormwater
management system,
The stormwater management system shall be constructed in its entirety, vegetated and operational for its
intended use prior to the construction of any built -upon surfaces except roads.
b. During construction, erosion shall be kept to a minimum and any eroded areas of the system will be repaired
immediately.
2. The facilities must be properly maintained and operated at all times. The approved Operation and Maintenance Plan
must be followed in its entirety and maintenance must occur at the scheduled intervals.
3. The permittee shall at all times provide the operation and maintenance necessary to assure the permitted stormwater
system functions at optimum efficiency including, but not limited to:
a. Semiannual scheduled inspections (every 6 months)
.b. Sediment removal
C. Mowing and revegetation of side slopes
d. Immediate repair of eroded areas
e. Maintenance of side slopes in accordance with approved plans and specifications
f. Debris removal and unclogging of outlet structure, orifice device and catch basins and piping.
4. Records of maintenance activities must be kept and made available upon request to authorized personnel of DWQ.
The records will indicate the date, activity, name of person performing the work and what actions were taken.
This permit shall become voidable unless the facilities are constructed in accordance with the conditions of this
permit, the approved plans and specifications, and other supporting data.
6. Upon completion of construction and prior to operation of this permitted facility, a certification must be received from
an appropriate designer for the system installed certifying that the permitted facility has been installed in accordance
with this permit, the approved plans and specifications, and other supporting documentation. Mail the Certification to
the Washington Regional Office, 943 Washington Square Mall, Washington, North Carolina, 27889, attention Division
of Water Quality.
7. A copy of the approved plans and specifications shall be maintained on file by the Permittee for a minimum of five
years from the date of the completion of construction.
III. GENERAL CONDITIONS
This permit is not transferable. In the event there is a desire for the facilities to change ownership, or there is a name
change of the Permittee, a formal permit request must be submitted to the Division of Water Quality accompanied by
an application fee, documentation from the parties involved, and other supporting materials as may be appropriate.
The approval of this request will be considered on its merits and may or may not be approved.
2. Failure to abide by the conditions and limitations contained in this permit may subject the Permittee to enforcement
action by the Division of Water Quality, in accordance with North Carolina General Statute 143-215.6(a) to 143-
215.6(c).
The issuance of this permit does not preclude the Permittee from complying with any and all statutes, rules,
regulations, or ordinances which may be imposed by other government agencies (local, state, and federal) which
have jurisdiction.
4. In the event that the facilities fail to perform satisfactorily, including the creation of nuisance conditions, the Permittee
shall take immediate corrective action, including those as may be required by this Division, such as the construction of
additional or replacement stormwater management systems.
5. The permit may be modified, revoked and reissued or terminated for cause. The fling of a request for a permit
modification, revocation and reissuance or termination does not stay any permit condition.
