You received the Notice of Violation on September 10, 2009 regarding the issues with the
modifications at the Koestline Professional Center. To date, the plan revisions have been submitted,
but this office has not received the Name/Ownership Change Form to place the permit in the names of
all three property owners.
The Ownership Change is not required to close the NOV. However, you (Center 33, LLC/Norman
Koestline) will retain full responsibility for all of the terms and conditions of the State Stormwater
Permit regardless of property ownership until such time that the permit is transferred/modified.

6481 or amy.adams@ncdenr.gov. Please be advised that a civil penalty of not more than twenty-
five thousand dollars ($25,000) per violation may be assessed against a person who is required

III. 13ioretention Pond No. 2 as originally permitted and constructed contains sufficient capacity
to accommodate the additional construction that has occurred within this drainage area;
therefore, no modifications are required. The designer's certification provided with my
September 251" submittal was based upon the original construction completed in 2003, a new
certification should not be required.

You received the Notice of Violation on September 10, 2009 regarding the issues with the
modifications at the Koestline Professional Center. The original NOV required a response
by October 10, 2009. A response was received from Rivers & Associates on behalf of
Center 33 Properties LLC on September 28, 2009. This response indicated that the
Name/Ownership change form would be submitted within approximately 2 weeks and the
Plan revision within 30 days from the date of the letter. On November 13, 2009 an email
was sent to rivers@riversandassociates.com requesting an update to the status of the
submittals with no response. To date, the required paperwork submittals have not been
received by this Office.
Please provide the required paperwork submittals including name/ownership change
request form, O&M Agreement, and Stormwater Permit Modification request to this Office
by December 11st, 2009 to avoid any enforcement proceedings, including but not limited to
civil penalty assessments.

This stormwater management plan is a revision to Stormwatef Permit No. SW7020915,
issued January 24, 2003 to Mr. Norman Koestline.
Koestline Professional Center consists of two office buildings sited on a 1.16 acre tract of
land located at the intersection of NC Highway 33 and Bragaw Lane in Chocowinity,
North Carolina. Immediately adjacent to the Professional Center is an office building
that was constructed on a 0.8 Ac. site in 2000. For the purposes of Stormwater Permit
No. SW7020915, the office building constructed in 2000 was included when delineating
the drainage areas for each bioretention cell. However, limitations in the amount of
stormwater routed through the bioretention cells from that portion of the property were
incurred due to existing parking areas, building footprints, and matching existing grades.
Stormwater Permit No. SW7020915 included three bioretention cells to treat stormwater
runoff. Subsequent to issuance of this permit and construction completion of the project,
NCDOT acquired a portion of the property within drainage area number one (DA No. 1)
during right of way acquisition for the US Highway 17 Bypass project (NCDOT Project
R-21510B). As a result of property acquisition by NCDOT, Filter #1 no longer exists
and this portion of the storm drainage is now included as part of NCDOT Project R-
2151OB.
Additional building improvements have been constructed within drainage area number
two (DA No. 2) and have not been previously permitted. Listed as follows are the
permitted parameters included for Filter #2 in Stormwater Permit No. SW7020915.

have listed below responses to the observations and violations noted in your letter.
Design Standards Permit Condition #5 — Failure to Modify Plan
The following revisions have occurred since the project was originally constructed in 2003:
1) The project was originally permitted in the developer's name. Building I (GPIN 5664-85-
1298) is owned by his development company, Center 33 Properties, LLC. Building 2 (GPIN
5664-85-1457) has been sold PMC Inc. Building 3 (GPIN 5664-85-0329) has been sold to
Fishing Creek Properties.
2) Building 2 has been expanded and sidewalks added to connect the buildings.
3) NCDOT has purchased portions of the project for right of way associated with the US-17
project. Their project resulted in removal of Bioretention Cell #2, parking lot reconfiguration and
drainage modifications.
II. Schedule of Compliance Permit Condition #5 — Failure to Construct in Accordance with Plans
Bioretention Cell #1 and #2 were built in accordance with the approved plans (refer to `"Typical
Section — Bioretention Area Behind Curb and Gutter" on Sheet 1 of the approved site plan).
Bioretention Cell #2 was located within the area acquired by NCDOT. Storm drainage for this
portion of the project is now handled by NCDOT Project R-2151013 (US-17).
Revisions have occurred to the site with regards to building coverage, parking lots and pervious
areas. The attached Exhibit A shows the project as originally permited and Exhibit B shows the
project as is currently exists.

No designer's certification was previously submitted.

A State Stormwater Permit Name / Ownership Change Form has been completed and forwarded
to the Owners for their execution. This form will be forwarded to NCDENR upon signature by
the Permit Holder and the current Owners (approximately 2 weeks).
II. A revised Stormwater Management Plan will be provided to address the additional building and
sidewalk construction. This will be completed within 30 days of the date of this letter.
Ill. Attached is a designer's certification based upon the original construction completed in 2003. A
new certification will be provided after completion of any modifications that result from Item II
above.
I hope that this letter sufficiently addresses the items contained in the Notice of Violation, and the
additional information will be forwarded as outlined in the "Plan of Action". In the meantime, please do

This letter is to notify you are in violation of Title 15A North Carolina Administrative Code (NCAC) 21-1 .1003
for failing to comply with terms, conditions and limitations of a Stornnvater Management Permit No.
SW7020915.
Oil August 28, 2009, Amy Adams of the Washington Regional Office performed an inspection to determine the
status of compliance with Stormwater Permit SW7020915, Permit Number SW7020915 was issued to you on
January 24, 2003 for the Professional Center, located at the intersection of Bragaw Lane and Hwy 33 E,
Chocowinity, Beaufort County, North Carolina.
As a result of the site inspection and DWQ file review, the following observations and violations are noted:
I. Design Standards Permit Condition 95—Failure to Modib, Plan
DWQ observed that the building and parking lot area have been expanded, sidewalks have been added and
vegetated areas have been reduced without modification of the approved plans. This is a violation of' Pernlit
Number SW7020915 Condition #5 which states "The folio wing items will require a modifccrtron to the permit:

II. Schedule of Compliance Permit Condition #5—Failure to Construct in Accordance with Plans
DWQ observed that both Bioretention Cell 41 and 42 are substantially smaller than shown on the approved plans.
In addition, the impervious surfaces on the site have been increased from the approved plans. This is a violation
of Permit Number SW7020915 Condition #5 which states "This permit shall became voidable unless the facilities
are constructed in accordance with the conditions of this perinit, the approved plans and specifications and other
supporting data. "
II.I. Failure to Submit a Desi ner's Certification
Both permit condition -96 and Title 15A NCAC 2H .1008 0) require that upon completion of construction, the
designer/engineer for the type of stormwater system installed must certify that the system was inspected during
construction, was constructed in substantial conformity with plans and specifications approved by DWQ, and
complies with the requirements of this Section. As of the date of this letter, DWQ has not received this
certification.
Required Response
This Office requires that you respond to this letter in writing to the address listed at the bottom of the letterhead
within 30 calendar days of receipt of this Notice. Please provide a written "Plan of Action" which outlines the
actions you will take to correct the noted violation(s) and a time frame for completion of those actions.
Thank you for your immediate attention to this matter. This Office is considering an enforcement action including
the assessment of civil penalties regarding these violations and any continuing violations that may be
encountered. Your above -mentioned response to this correspondence will be considered in this process. Please
be advised, these violations and any continuing or future violations are subject to a civil penalty, assessment

This letter is to notify you are in violation of Title 15A North Carolina Administrative Code (NCAC) 2H .1003
for failing to comply with terms, conditions and limitations of a Stormwater Management Permit No.
SW7020915.
On August 28, 2009, Amy Adams of the Washington Regional Office performed an inspection to determine the
status of compliance with Stormwater Permit SW7020915. Permit Number SW7020915 was issued to you on
January 24, 2003 for the Professional Center, located at the intersection of Bragaw Lane and Hwy 33 E,
Chocowinity, Beaufort County, North Carolina. ,
As a result of the site inspection and DWQ file review, the following observations and violations are noted:
1. Design Standards Permit Condition #5LFailure to Modify Plan
DWQ observed that the building and parking lot area have been expanded, sidewalks have been added and
vegetated areas have been reduced without modification of the approved plans. This is a violation of Permit
Number SW7020915 Condition #5 which states "The following items vvill require a modification to the permit:
a. Any revision to the. approved plans, regardless of size
b. Project name change
c: Change of ownership

11. Schedule of Compliance Permit Condition #5—Failure to Construct in Accordance with Plans
DWQ observed that both Bioretention Cell 41 and #2 are substantially smaller than shown on the approved plans.
In addition, the impervious surfaces on the site have been increased from the approved plans. This is a violation
of Permit Number SW7020915 Condition 45 which states "This permit shall become voidable unless the facilities
(ire constructed in accordance with the conditions of this permit, the approved plans and specifications and other
supporting data. "
1II. Failure to Submit a Designer's Certification
Both permit condition 46 and Title 15A NCAC 2H .1008 0) require that upon completion of construction, the
designer/engineer for the type of stormwater system installed must certify that the system was inspected during
construction, was constructed in substantial conformity with plans and specifications approved by DWQ, and
complies with the requirements of this Section. As of the date of this letter, DWQ has not received this
certification__
Re uired Response
This Office requires that you respond to this letter in writing to the address listed at the bottom of the letterhead
within 30 calendar days of receipt of this Notice. Please provide a written "Plan of Action" which outlines the
actions you will take to correct the noted violation(s) and a time frame for completion of those actions.
Thank you for your immediate attention to this matter. This Office is considering an enforcement action including
the assessment of civil penalties regarding these violations and .any .continuing violations that may be
encountered. Your above -mentioned response to this correspondence will be considered in this process. Please
be advised, these violations and any continuing or future violations are subject to a civil penalty assessment
of up to $25,000.00 per day for each violation pursuant to North Carolina General Statute 143-215.6A.

IV. DEED RESTRICTIONS AND PROTECTIVE COVENANTS
The following italicized deed restrictions and protective covenants are required to be recorded for all
subdivisions, outparcels and future development prior to the sale of any lot. If lot sizes vary significantly, a table
listing each lot number, size and the allowable built -upon area for each lot must be provided as an attachment.
I. The following covenants are intended to ensure ongoing compliance with state stormwater management permit number
as Issued by the Division of Water Quality. These covenants may not be
changed or deleted without the consent of the State.
2. No more than square feet of any lot shall be covered by structures or impervious materials.
Impervious materials Include asphalt, gravel, concrete, brick, stone, slate or similar material but do not include wood
decking or the water surface of swimming pools.
3. Swales shall not be filled in, piped, or altered except as necessary to provide driveway crossings.
4. Built -upon area in excess of the permitted amount requires a state stormwater management permit modification prior to
construction.
5. All permitted runoff from outparcels or future development shall be directed into the permitted stormwater control
system. These connections to the stormwater control system shall be performed in a manner that maintains the integrity
and performance of the system as permitted.
By your signature below, you certify that the recorded deed restrictions and protective covenants for this project
shall include all the applicable items required above, that the covenants will be binding on all parties and persons
claiming under them, that they will run with the land, that the required covenants cannot be changed or deleted
without concurrence from the State, and that they will be recorded prior to the sale of any lot.

The proposed Professional Center will consist of two office buildings sited on a one acre
tract of land located at the intersection of NC Highway 33 and Bragaw Lane in
Chocowinity, North Carolina. The site is very flat with an approximately 4' deep
roadside ditch draining it. Soils consist of Craven fine sandy loam in hydrology group C.
According to the NCDENR "Stormwater Best Management Practices" Manual,
Bioretention cells achieve a removal rate of 85% for total suspended solids. Bioretention
areas are intended to address the spatial constraints that can be found in intensely
developed urban areas where the drainage areas are highly impervious. Bioretention is a
water quality practice using plants and soils for the removal of pollutants from
stormwater runoff. All retention areas for this project were sized according to the
NCDENR "Stormwater Best Management Practices" Manual, taking into account the
minimum required square footage of storage (15' x 40') and the use of underdrains to
collect the runoff after it has slowly filtered through the soil.
Three bioretention cells have been incorporated into this plan. The parking area drains to
two bioretention areas. They are both 15' x 85', with an a era e of ' of storage,
providing a total of 2 55 ubic feet of storage. A centrally located bioretention area
receives the runoff from the proposed buildings. It has a rectangular shape measuring
26.5' x 45.5' with a surface area of approximately 1,200 square feet and approximately 1'
of storage depth, providing 1,200 cubic feet of storage. Bioretention Areas #1 and #2
route the runoff through the onsite storm drainage system to respective roadside ditches.
Both retention areas have outlets set approximatelX 8 inches above the bioretention area,
which act as an overflow spillway, col ecting any runo in excess of the one inch storm.
Bioretention Area #3 empties into an existing drainage pipe onsite. An outlet structure
constructed on this existing pipe will serve as an overflow spillway.
Bioretention Area Maintenance
1. Vegetation shall be inspected twice annually. Remove/replace dead or diseased
plants. Also remove unwanted additional growth, such as weeds.
2. Remulch as necessary.

Once or twice annually, test the soil fo H and toxics Lime should be added as
needed to increase pH. Soil should be r 6placed if toxics exist.
4. Remove trash and debris as necessary.
