Staff review of the plans and specifications has determined that the project, as proposed, will comply with the Stormwater Regulations set forth in Title 15A NCAC 2H.1000. We are forwarding Permit No. SW70020602 dated August 2, 2002 to JDH Capital, LLC for three infiltration basins to serve Eckerd Drugs/Pier 1 Imports located in Kitty Hawk, NC. This permit shall be effective from the date of issuance until August 2, 2012 and shall be subject to the conditions and limitations as specified therein. Please pay special attention to the Operation and Maintenance requirements in this permit. Failure to establish an adequate system for operation and maintenance of the stormwater management system will result in future compliance problems. If any parts, requirements, or limitations contained in this permit are unacceptable, you have the right to request an adjudicatory hearing upon written request within thirty (30) days following receipt of this permit. This request must be in the form of a written petition, conforming to Chapter 150B of the North Carolina General Statutes, and filed with the Office of Administrative Hearings, P.O. Approved plans and specifications for this project are incorporated by reference and are enforceable parts of the permit. No homeowner/lot owner/developer shall be allowed to fill in, alter, or pipe any vegetative practices (such as swales) shown on the approved plans as part of the 'stormwater management system without submitting a revision to the permit and receiving approval from the Division. 5. The following items will require a modification to the permit: a.. Any revision to the approved plans, regardless of size b. Project name change C. Transfer of ownership. d. Redesign or addition to the approved amount of built - upon area e. Further subdivision of the project area. In addition, the Director may determine that -other, revisions to the project should require a modification to'the permit. t 6. The Director may notify the permittee when the permitted site does not meet one or more of the minimum requirements of the permit. Within- the time frame specified in the notice, the permittee shall submit a written time schedule to -the Director for modifying the site to meet minimum requirements. The permittee shall provide copies -of revised plans and certification in writing to the Director that the changes have been made. II. SCHEDULE OF COMPLIANCE 1. The permittee will comply with the following schedule for construction and maintenance of the stormwater management system. a. The stormwater management system shall be constructed in its entirety, vegetated and operational for its intended use prior to the construction of any built -upon surfaces except roads. b. During construction,. erosion shall be kept to a minimum and any eroded areas of the system will be repaired immediately. 2. The facilities must be properly maintained and operated at all times. The approved Operation and Maintenance Plan must be followed in its entirety and maintenance must occur at the scheduled intervals. 3. The permittee shall at all times provide the operation and maintenance necessary to assure the permitted stormwater system functions at optimum efficiency including, but not limited to: a. Semi-annual scheduled inspections (every 6 months) b. Sediment removal C. Mowing and revegetation of side slopes d. Immediate repair.of eroded areas e. Maintenance of side slopes in accordance with approved plans and specifications f. Debris removal and unclogging of outlet structure, orifice device .and catch basins and piping. 4. Records of maintenance activities must 'be kept and •made available upon request to authorized personnel of DWQ. The records will indicate the date, activity, name of person performing the work and what actions were taken. 5. This permit shall become voidable unless the facilities are constructed' it: accordance;. with the. conditions.. of this permit, the'-- approved plans. and' -specifications, and other supporting data. 6. Upon completion of construction and prior to operation of this permitted facility, a certification must be received from an appropriate designer for the system installed certifying that the permitted facility has been installed in accordance with this permit, the approved plans and specifications, and other supporting documentation. A copy of the approved plans and specifications shall be maintained on file by the Permittee for a minimum of five years from the date of the completion of construction. III. GENERAL CONDITIONS 1. This permit- is not transferable. In the event there is a desire for the facilities to change ownership, or there is a name change of the Permittee, a'formal permit -request must be submitted to the Division of Water Quality accompanied by an application fee, documentation from the parties involved, and other supporting materials as may be appropriate. The approval of this request will be considered on its merits and may or may not be approved. 2. Failure to abide by the conditions and limitations contained in this permit may subject the Permittee to enforcement -action by the Division of Water Quality, in accordance with North Carolina General Statute 143-215. 6 (a) � to 143-215. 6 (c) . 3. The issuance of this permit does not preclude the Permittee from complying with any and all statutes, rules, regulations, or ordinances which may be imposed by other government agencies (local, state, and federal) which have jurisdiction. 4. In the event that the facilities fail to perform satisfactorily, including the creation of nuisance conditions, the Permittee shall take immediate corrective action, including those as may be required by this Division, such as the construction of additional or replacement stormwater management systems. 5. The permit may be modified, revoked and reissued or terminated for cause. The filing of a request for a permit modification, revocation and reissuance or termination does not stay any permit condition. Permit issued this the 2 nd-day of August, 2002. This permit can only be modified by a request from JDH Capital, LLC unless you are authorized in writing to act on their behalf. The infiltration basins required by permit SV 7020602 have been constructed and placed in operation. Permit SW7020602 required that upon completion of construction and prior to operation a certification must be received from an appropriate designer for the system installed certifying that the permitted facility has been installed in accordance with the permit, the approved plans and specifications, and other supporting documentation. We have no record of this certification. One will need to be submitted prior to modifying the permit. The system must be located in a recorded drainage easement for the purposes of operation and maintenance and have recorded access easements to the nearest public right-of-way. These easements should be shown on the plans. INFILTRATION BASIN OPERATION AND MAINTENANCE AGREEMENT 1. After every runoff producing rainfall event and at least monthly inspect the infiltration system for erosion, trash accumulation, vegetative cover, and general condition. 2. Repair eroded areas immediately, re -seed as necessary to maintain adequate vegetative cover, mow vegetated cover to maintain a maximum height of six inches, and remove trash as needed. 3. After every runoff producing rainfall event and at least monthly inspect the bypass, inflow and overflow structures for blockage and deterioration. Remove any blockage and repair the structure to approved design specifications. 4. Remove accumulated sediment from the pretreatment system and infiltration basin annually or when depth in the pretreatment unit is reduced to 75% of the original design depth. The system shall be restored to the original design depth without over -excavating. Fonn 5WU-103 Rev 3.99 Page 2 of' 3 IV. INFILTRATION BASIN OPERATION AND MAINTENANCE AGREEMENT l . After every runoff producing rainfall event and at least monthly inspect the infiltration system for erosion, trash accumulation, vegetative cover, and general condition. 2. Repair eroded areas immediately, re -seed as necessary to maintain adequate vegetative cover, mow vegetated cover to maintain a maximum height of six inches, and remove trash as needed. 3. After every runoff producing rainfall event and at least monthly inspect the bypass, inflow and overflow structures for blockage and deterioration. Remove any blockage and repair the structure to approved design specifications. 4. Remove accumulated sediment from the pretreatment system and infiltration basin annually or when depth in the pretreatment unit is reduced to 7 S% of the original design depth. The system shall be restored to the original design depth without over -excavating. Over -excavating may cause the required water table separation to be reduced and may compromise the ability of the system to perform as designed. Removed sediment shall be disposed of in an appropriate manner and shall not be handled in a manner that will adversely impact water quality (i.e. stockpiling near a stormwater treatment device or stream, etc.). A benchmark shall be established in the pretreatment unit. The benchmark will document the original design depth so that accurate sediment accumulation readings can be taken. The measuring device used to determine the depth at the benchmark shall be such that it will give an accurate depth reading and not readily penetrate into accumulated sediments. When the design depth reads feet in the pretreatment unit, the sediment shall be removed from both the pretreatment unit and the infiltration basin. 5. If the Division determines that the system is failing, the system will immediately be repaired to original design specifications. If the system cannot be repaired to perform its design function, other stormwater control devices as allowed by NCAC 2H .1000 must be designed, approved and constructed. PROJECT DESCRIPTION: A 4.25 acre Commercial/ Retail Site 4. NEAREST RECEIVING STREAM; Currituck Sound 5. CLASSIFICATION OF RECEIVING STREAM: SC 6. IMPERVIOUS AREA: 2.36 acres 7. BMP Devices: 3 Infiltration Basins B. SITE DESCRIPTION: This 4,25 acre parcel is located at the intersection of U.S. 158 and N.C. 12 and is currently a miniature golf course and retail center. . The topography of the site ranges from 8 feet to 20 feet with 3 small ponds (PVC lined, Non 404 Jurisdictional) being used for aesthetic/ golf course purposes. These ponds will be abandoned and filled to allow for the new BMP devices to be installed. Two Swales (see plans and calculations) will be used to direct water to the proposed BMP Infiltration basin #1 and #2. Infiltration Basin #3 will not have a Swale system do to site constraints. All basins use concrete flumes to prevent high runoff velocities from eroding basin slopes. C. SOILS: Site soils consist of Newhan fine sand throughout the parcel. Newhan fine sands are excessively drained with very rapid permeability; therefore, drainage measures have been engineered to accommodate such conditions. A soils report of the site was submitted to NCDENR DCDWQ with the Kroger, Kitty Hawk stormwater application in the summer of 2001 if verification of soil conditions is required. D. PROJECT DESCRIPTION: This project will consist of the transformation of a miniature golf course into a commercial/ retail site. The site has uneven topography and contains elevations of 8-20 feet above mean sea level. Most existing impervious surfaces will be removed to allow for construction of the new buildings, parking areas and BMP devices. Three infiltration basins will be constructed as per plans along with any recommendations from the Division of Water Quality. E. STORMWATER NARRATIVE: Site generated stormwater will be directed to three BMP Infiltration devices constructed per the plans attached. The site stormwater devices will utilize site soil infiltration rates of >20 inlhr to treat and control stormwater. The impervious surfaces will be separated into three drainage areas (one per each infiltration basin) for stormwater and sediment and erosion control purposes. Impervious surfaces will be graded to sheet flow to the drainage features as per the plans attached. Calculations for the infiltration basins and swales are included with this application package. Sedimentation and Erosion Control measures will be implemented before and during the grading and construction phases of the project to minimize impacts to the adjoining surface waters. • All stormwater control and sedimentation and erosion control practices shall be in accordance with the North Department of Environment and Natural Resources Regulations and recommendations. CONSTRUCTION SEQUENCE.' 1. Install all sedimentation and erosion control practices prior to any land clearing, grubbing or earth disturbing activities. 2. Critical erosion areas will be given special attention throughout the entire project 3. Clear and grub roadway areas removing trees, vegetation, root and other material that may affect final roadway stability. 4. Install all culverts, stormwater piping and drop inlets. Construct all swales and ditches. Maintain minimum slopes as indicated on plans and details. The contractor is responsible to protect all the above - mentioned appurtenances prior to and upon completion of construction and prior to commencement of any new task especially inlet protection. S. Construct stone silt dam as required to break high velocity flows. Place class "A" stone rip -rap at all culvert outlets. 6. Provide temporary stabilization vegetation as outlined by "Section B" of the Sedimentation and Erosion Control Notes. 7. Construct roadway, undercutting and replacing unsuitable soils as encountered. 8. Perform all grading and apply permanent vegetation as outlined in "Section B" of the Sedimentation and Erosion Control Notes. STABIUZATION AND LANDSCAPING: Final slopes in all graded areas shall not exceed 3:1. All seeding and sodding shall be in place within 30 days of land disturbance and/or project completion. 1. Fertilizer: Apply 3,000 Ib per acre ground agriculture limestone and 500 lb per acre 20-20-20- fertilizer. Top dress 50 lb, per acre nitrogen. 2. Mulch: Apply 4,000 lb. per acre straw. Anchor straw by tacking with asphalt, netting, or a mulch anchoring tool. 3. Seeding: A., Temporary Vegetation: If temporary seeding occurs during winter, early spring, or fall, apply 120 lb per acre rye grain. If temporary seeding occurs during summer, apply 40 lb. per acre centipeed grass. Temporary vegetation must be applied within 30 days of land disturbing activity. B. Permanent Vegetation: Apply coastal mix consisting of 50 lb. per acre Pensacola Bahia grass and 10 lb. per acre German Millet. Apply permanent seeding between April 1, and July 15. Refertiiize the following April with 50 lb. per acre nitrogen. C. Sodding: (If Required) Permanent vegetation- select compatible species to permanent seeded type; install with longest dimension perpendicular to the slope and staple if necessary; roll sod immediately and water to 4". MAINTENANCE. 1. Check temporary erosion devices after each significant rainfall and/or biweekly. Repair and remove sediment buildup as necessary. 2. Check stabilized areas after each significant rainfall event. Rills and gullies must be repaired, re- seeded and mulched as soon as possible. Temporary diversions may be necessary until new plants develop. Bare spots must be relimed, fertilized, mulched and reseeded as promptly as possible. Yearly refertilization may be required to maintain productive stands.
