Records indicate that you received this letter on February 12, 2010. Subsequent to receipt of this letter, a Plan of Action was received by Mike Lawyer with this office via e-mail correspondence. Accordingly, an engineer was hired by you to assess the conditions of the associated BMPs, oversee any necessary work to ensure the BMPs met their permitted design and provide the Designer's Certification upon completion. To date, our office has not received the applicable certification. The purpose of this letter is to inform you that our office will move forward with the assessment of a civil penalty as indicated in the January 8, 2010 letter if the Designer's Certification is not received by our office on or before January 27, 2012. I must have this in order to renew the permit that was originally issued back in 1998. Th'e renewal package (minus the certification) has been in-house since November 2008 and its long past the point of returning the application as incomplete. If I do not get the certification by the last working day of this month (February 27, 2009), I will return the application; which means it will have to be resubmitted along with another fee. If an extension is needed beyond this date, it must be requested in writing. Although the renewal is past due, I am committed to completing the necessary renewal and certifications in a timely manner. I have contracted with LandDesign, Inc. (Civil Engineer will be Nate Doolittle, PE) to provide certification of the ponds as the original engineer is unwilling to facilitate my needs in the timeframe required. LandDesign has already completed a review of the "as builts" and has recommended a few minor construction adjustments in order to certify the pond as designed (these modifications are attached). These modifications, along with LandDesign certification and renewal, will be completed by May 1s`, 2009. This will provide sufficient time to contract and complete the work. It appears that the 6:1 slope still needs some work to meet that slope. In addition when I measure at the top of that slope I found some distances short by 10 feet. In previous discussions with Ken Averette he told me specifically that I was to certify that the volumes were correct. Since it does not meet the dimensions I would say that it does not meet the volumes required by the State and I cannot provide that certification. My recommendation (which is still the same as originally recommended) is that the contractor regrade the 6.1 area to comply with the plans. If he would set a stake at each corner at the top and bottom of the b: l slope area and put the grades on them he could easily check where he is out. It would take 16 stakes per pond to do this. In addition a stake is recommended in the control section of the spillway and between the sediment storage and main pond to check that elevation. He should use the rim of the riser as the benchmark with the elevation the same as the rim elevation shown on the plans. A sediment marker must be set in the sediment storage area of both ponds at the same elevation as the spillway between the storage and main pond. Any riprap must be in place. The problem with the pond grading was observed on my first trip and must be resolved. I cannot continue to reinspect the ponds at no charge to you. I wig matte one trip to finalize both the ponds and the water "as builts" at the same time at no additional charge. Any additional trips will be at cost to you. I will complete the "as builts" drawings on the water when the property comers are set. All valves and meters must be visible. In addition the contractor was keeping measurements of the crossings. Please provide those measurements to me. I will make the final trip when I have assurances form you that the contractor has completed his work as specified and recommended in this letter and the water is ready to finalize. Is the forebay required, or is that negotiable? The forebay is a rule requirement and is non-negotiable [2H .1008(e)(6)). The 20% forebay volume is a guideline from the BMP manual and is pretty strictly upheld. 2. Is a trash rack required? Yes, the trash rack reduces maintenance and more than pays for itself in the long run. The discharge structure that is proposed is, pardon the terra, two-bit. The overflow is directed to a spillway instead of discharged through the structure. This is not a typical configuration. The elbows on the riser may effectively serve as a trash rack since they will remain submerged and a trash rack is seldom required on a spillway. I would prefer to see a more conventional discharge structure which consists of a large riser with drawdown orifice(s) and an overflow with trash rack. 3. Can I use the 20 foot long vegetated spillway as part of the required vegetated buffer? I told him I'd look at that, but my call would be no. The vegetated filter should be located to treat all the discharged stormwater, not just the overflow. He said he wrote you a letter addressing the items in the info•i faxed out yesterday.
