Dear Sirs:
The Fayetteville Regional Office received a Stormwater Management Permit Application
for Little River Golf Club - Phase 2, (POD A) Condominiums and Club Pool on January 21,
2005. Staff review of the plans and specifications has determined that the project, as proposed,
will comply with the Stormwater Regulations set forth in Title 15A NCAC 2.H.1000. We are
forwarding (Modified) Permit No. SW6030701, previously issued on November 17, 2003, for
the previous construction of stormwater treatment facilities associated with Little River Golf
Club - Phase I, (POD A) Clubhouse & Lodges and modified to include Phase 2, (POD A)
Condominiums and Club Pool.
This permit shall be effective from the original date of issuance until November 16, 2013,
and shall be subject to the conditions and limitations as specified therein. Please pay special
attention to the Operation and Maintenance requirements of Item II.4 of this permit. Failure to
establish an adequate system for operation and maintenance of the stormwater management
system will result in future compliance problems.
If any parts, requirements, or limitations contained in this permit are unacceptable, you
have the right to request an adjudicatory hearing upon written request within thirty (30) days
following receipt of this permit. This request must be in the form of a written petition,
conforming to Chapter 150B of the North Carolina General Statutes, and filed with the Office of
Administrative Hearings, 6714 Mail Service Center, Raleigh, N.C. 27699-6714. Unless such
demands are made, this permit shall be final and binding.

In accordance with the provisions of Article 21 of Chapter 143, General Statutes of North
Carolina as amended, and other applicable Laws, Rules, and Regulations
PERMISSION IS HEREBY GRANTED TO

construction, operation and maintenance of a wet detention pond in compliance with the
provisions of 15A NCAC 2H .1000 (hereafter referred to as the "storyrnt ater rules") and the
approved stornnvater management plans and specifications, and other supporting data as
attached and on file with and approved by the Division of Water Quality and considered a part of
this permit.
The Permit shall be effective from the date of issuance until November 16, 2013 and shall be
subject to the following specific conditions and limitations:
1. DESIGN STANDANDS
This permit is effective only with respect to the nature and volume of stormwater
described in the application and other supporting data.
This stormwater system has been approved for the management of stormwater runoff as
described on page 3 of this permit, the Project Data Sheet. One (1) Wet Detention basin
designed for 90% TSS removal efficiency without effluent filter. The stormwater wet
pond controls have been designed to handle the runoff from 2.50 acres for a total of
108,900 square feet of impervious area. In addition runoff from 0.8 acres associated with
constriction of sidewalks not associated with a designed collection system for a total of

908 square feet of impervious area. Combined total of 109,808 sq feet or 2.52 acres of
impervious area is approved. The 2.52 acres of impervious area equals 0.4165 %
imperviousness for this 604.96 acre phased low density (12%) cluster development.
3. The stormwater system has been approved for the management of stormwater runoff as
described on page 4 of this permit, the Project Data Sheet. Two (2) Bioretention areas
designed for 85% TSS removal efficiency. The stormwater bioretention area controls
have been designed to handle the runoff from 1.35 acre imperviousness for a total of
58,806 square feet of impervious area. The 58,806 square feet or 1.35 acres of
impervious area is approved. The 1.35 acres of impervious area equals 0.2231 %
imperiousness for this 604.96 acre phased low density (12%) cluster development.
4. Approved plans and specifications for this project are incorporated by reference and are
enforceable parts of the permit.
4. The tract will be limited to the amount of built -upon area indicated on pages 3 and 4 of
this permit, and per approved plans.
The runoff from all built -upon area within the permitted drainage area for the associated
collection system of this project must be directed into the permitted stormwater control
systems. A permit modification must be submitted and approved prior to the construction
of any additional built -upon area associated with any permitted controls.
6. The overall tract built -upon area percentage for this and including all future low density
Cluster development that is not included in this permit will be limited to 60.6169 acres or
10.02 %, but in no way can exceed 72.5952 acres or no greater than 12.0 %, as required
by Section .1006 (2) of the stormwater rules.
7. A minimum 30 foot wide vegetative buffer for development is required along all
perennial waters indicated on the most recent version of U.S.&S. 1:24,000 (7.5 minute)
scale topographic maps or as determined by local government studies.
The built -upon area for future development is limited to a remaining 68.7252 acres.

11. SCHEDULE OF COMPLIANCE
The stormwater management system shall be constructed in its entirety, vegetated and
operational for its intended use prior to the construction of any built -upon surface.
2. During construction, erosion shall be kept to a minimum and any eroded areas of the
system will be repaired immediately.
The permittee shall at all times provide the operation and maintenance necessary to
assure the permitted stormwater system functions at optimum efficiency. The approved
Operation and Maintenance Plan must be followed in its entirety and maintenance must
occur at the scheduled intervals including, but not limited to:
a. Semiannual scheduled Inspections (every 6 months).
b. Sediment removal.
C. Mowing, and revegetating of side slopes.
d. Immediate repair of eroded areas.
e. Maintenance of side slopes in accordance with approved plans and specifications.
f. Debris removal and unclogging of outlet structure, orifice device and catch basins
and piping.
g. Access to the outlet structure must be available at all times.
h. The wet detention pond for Little River Golf Club - Phase I, (POI) A) Clubhouse
& Lodges, Permit No. SW6030701 was designed to remove 90%, TSS, therefore a

vegetated filter was not required.
i. The (2) Bioretention areas for Little River Golf Club — Phase 2, (POD A)
Condominums and Club Pool, under Modified Permit No. SW6030701 was designed
to remove 85% TSS.
4. Records of maintenance activities must be kept and made available upon request to
authorized personnel of DWQ. The records will indicate the date, activity, name of
person performing the work and what actions were taken.
Decorative spray fountains will not be allowed in the stormwater treatment system.
6. The facilities shall be constructed as shown on the approved plans. This permit shall
become voidable unless the facilities are constructed in accordance with the conditions of
this permit, the approved plans and specifications, and other supporting data.
7. Upon completion of construction, prior to issuance of a Certificate of Occupancy, and
prior to operation of this permitted facility, a certification must be received from an
appropriate designer for the system installed certifying that the permitted facility has
been installed in accordance with this permit,,the approved plans and specifications, and
other supporting documentation. Any deviations from the approved plans Ind
specifications must be noted on the Certification.
If the stormwater system was used as an Erosion Control device, it must be restored to
design condition prior to operation as a stormwater treatment device, and prior to
occupancy of the facility.

9. A modification must be permitted prior to any construction. The following items will
require a modification to the permit. The Director may determine that other revisions to,
the project should require a modification to the permit:
a. Any revision to the approved plans, regardless of size.
b. Project name change.
C. Transfer of ownership.
d. Redesign or addition to the approved amount of built -upon area.
e. Further subdivision, acquisition, or sale of the project area. The project area is
defined as all property owned by the permittee, for which Sedimentation and
Erosion Control Plan approval was sought.
f. Filling in, altering, or piping of any vegetative conveyance shown on the
approved plan.
10. A copy of the approved plans and specifications shall be maintained on file by the
Permittee for a minimum of ten years from the date of the completion of construction.
11. The permittee shall submit final site layout and grading plans for any permitted future
areas shown on the approved plans, prior to construction. If the proposed BUA exceeds
the permitted amount, a modification to the permit must be submitted and approved prior
to construction.
12. Prior to the sale of any portion of the property, an access/maintenance easement to the
stormwater facilities shall be granted in favor of the permittee if access to the stormwater
facilities will be restricted by the sale of any portion of the property.
13. The permittee is responsible for verifying that the proposed built -upon area does not
exceed the allowable built -upon area.
14. The Director may notify the permittee when the permitted site does not meet one or more
of the minimum requirements of the permit. Within the time frame specified in the notice,
the permittee shall submit a written time schedule to the Director of modifying the site to
meet minimum requirements. The permittee shall provide copies of revised plans and
certification in writing to the Director that the changes have been made.
.15. The permittee shall notify'the Division of any name, ownership or mailing address
changes within 30 days.
II1. GENERA-1L CONDITIONS
This permit is not transferable. In the event there is a desire for the facilities to change
ownership, or there is a name change of the Permittee, a formal permit request must be
submitted to the Division of Water Quality accompanied by an application fee,
documentation from the parties involved, and other supporting materials as may be
appropriate. The approval of this request will be considered on its merits and may or may
not be approved.
2. Failure to abide by the conditions and limitations contained in this permit may subject the

Permittee to an enforcement action by the Division of Water Quality, in accordance with
North Carolina General Statutes 143-215.6A to 143-215.6C.
The issuance of this permit does not preclude the Permittee from complying with any and
all statutes, rules, regulations, or ordinances which may be imposed by other government
agencies (local, state, and federal) which have jurisdiction.
4. In the event that the facilities fail to perform satisfactorily, including the creation of
nuisance conditions, the Permittee shall take immediate corrective action, including those
as may be required by this Division, such as the construction of additional or replacement
stormwater management systems.
5. The permittee grants DENR Staff permission to enter the property for the purpose of
inspecting all components of the permitted stormwater management facility.
6. The permit may be modified, revoked and reissued or terminated for cause. The filing of
a request for a permit modification, revocation and reissuancc or termination does not
stay any permit condition.
Unless specified elsewhere, permanent seeding requirements for the stormwater control
must follow the guidelines established in the North Carolina Erosion and Sediment
Control Planning and Design Manual.

On or after December 20, 2004, the Fayetteville Regional Office received a copy of the Approved Erosion Control Plan for Little River
Farm Golf Club Ph 2 Condo & Club Pool. State regulations 15A NCAC 2H.1000 requires any project that is required to obtain an Erosion and
Sedimentation Control Plan approval, to apply for a Stormwater Management Permit. In order to determine if a Stormwater Management Permit
will be required for this project, the classification of and distance from the receiving waters must be verified by this Office. Please return the
attached classification request form with a copy of that portion of the USGS quad sheet with the project and the closest downslope named
receiving waters clearly noted.
A Stormwater Management Permit Application, fee, and supporting information will be required if this project is either draining to an
Outstanding Resource Water or within 1 mile of and draining to a High Quality Water. Projects that drain to Water Supply Watersheds must be
reviewed and/or receive approval for impervious surface allocations to be signed by the local governing authority for compliance.
Please be advised that construction of any built -upon areas prior to receipt of a Stormwater Management Permit (if required) will be a
violation of North Carolina General Statutes.

This office has reviewed the subject erosion and sedimentation control plan. We find the
plan to be acceptable with modifications and hereby issue this letter of Approval With
Modifications. The Modifications Required for Approval are listed on the attached page. This
plan approval shall expire three (3) years following the date of approval, if no land -disturbing
activity has been undertaken, as is required by Title 15A NCAC 4B .0129.

The Fayetteville Regional Office received a Stormwater Management Permit Application
for Little River Golf Club - Phase I, (POD A) Clubhouse & Lodges on July 30, 2003. Additional
information requested was received on October 20, 2003. Staff review of the plans and
specifications has determined that the project, as proposed, will comply with the Stonnwater
Regulations set forth in Title 15A NCAC 2H.1000. We are fonvarding Permit No. SW6030701,
dated November 17, 2003, for the construction of stortnwater treatment facilities associated with
Little River Golf Club - Phase 1, (POD A) Clubhouse & Lodges.
This permit shall be effective from the date of issuance until November 16, 2013, and

approved stonnwater management plans and specifications, and other supporting data as attached
and on file with and approved by the Division of Water Quality and considered a part of this
permit.
The Permit shall be effective from the date of issuance until November 16, 2013 and shall be
subject to the following specific conditions and limitations:
I. DESIGN STANDANDS
This permit is effective only with respect to the nature and volume of stormwater
described in the application and other supporting data.
This stormwater system has been approved for the management of stormwater runoff as
described on page 3 of this permit, the Project Data Sheets. One (1) Wet Detention basin
designed for 90% TSS removal efficiency without effluent filter. The stormwater wet
pond controls have been designed to handle the runoff from 2.50 acres for a total of
108,900 square feet of impervious area. In addition runoff from 0.8 acres associated with
construction of sidewalks not associated with a designed collection system for a total of
908 square feet of impervious area. This equals a combined total of 109,808 square feet
or 0.4165 % impervious area associated with Phase 1, (POD -A) of this 604.96 acre site

enforceable parts of the permit.
4. The tract will be limited to the amount of built -upon area indicated on page 3 of this
permit, and per approved plans.
The runoff from all built -upon area within the permitted drainage area for the associated
collection system of this project must be directed into the permitted stormwater wet pond
control systems.A permit modification must be submitted and approved prior to the
construction of any additional built -upon area associated with the wet pond.
6. The overall tract built -upon area percentage for this and including all future low density
cluster development that is not included in this permit will be limited to 60.6169 acres or
10.02 %, but in no way can exceed 72.5952 acres or no greater than 12.0 %, as required
by Section .1006 (2) of the stormwater rules.
A minimum 30 foot wide vegetative buffer for development is required along all
perennial waters indicated on the most recent version of U.S.G.S. 1:24,000 (7.5 min1.ste)
scale topographic maps or as determined by local government studies.
The built -upon area for future development is limited to a remaining 72.1787 acres.

it. SCHEDULE OF COMPLIANCE
The stormwater management system shall be constructed in its entirety, vegetated and
operational for its intended use prior to the construction of any built -upon surface.
During construction, erosion shall be kept to a minimum and any eroded areas of the
system will be repaired immediately.
The permittee shall at all times provide the operation and maintenance necessary to assure
the permitted stormwater system functions at optimum efficiency. The approved
Operation and Maintenance Plan must be followed in its entirety and maintenance must
occur at the scheduled intervals including, but not limited to:
a. Semiannual scheduled Inspections (every 6 months).
b. Sediment removal.
C. Mowing, and revegetating of side slopes.
d. Immediate repair of eroded areas.
e. Maintenance of side slopes in accordance with approved plans and specifications.
f. Debris removal and unclogging of outlet structure, orifice device and catch basins
and piping.
g. Access to the outlet structure must be available at all times.
h. The wet detention pond for Little River Golf Club - Phase I, (POD A)
Clubhouse & Lodges, Permit No. SW6030701 was designed to remove 90%
TSS, therefore a vegetated filter was not required.
4. Records of maintenance activities must be kept and made available upon request to
authorized personnel of DWQ. The records will indicate the date, activity, name of
person perfor -iing the work and what actions were taken.
Decorative spray fountains will not be allowed in the stormwater treatment system.
6. The facilities shall be constructed as shown on the approved plans. This permit shall
become voidable unless the facilities are constructed in accordance with the conditions of
this permit, the approved plans and specifications, and other supporting data.
7. Upon completion of construction, prior to issuance of a Certi ficate of Occupancy, and
prior to operation of this permitted facility, a certification must be received from an
appropriate designer for the system installed certifying that the permitted facility has been
installed in accordance with this permit, the approved plans and specifications, and other
supporting documentation. Any deviations from the approved plans and specifications
must be noted on the Certification.
8. If the stormwater system was used as an Erosion Control device, it must be restored to
design condition prior to operation as a stormwater treatment device, and prior to
occupancy of the facility.
9. A modification must be permitted prior to any construction. The following items will
require a modification to the permit. The Director may determine that other revisions to
the project should require a modification to the permit:
a. Any revision to the approved plans, regardless of size.
b. Project name change.
C. Transfer of ownership.
d. Redesign or addition to the approved amount of built -upon area.
e. Further subdivision, acquisition, or sale of the project area. The project area is
defined as all property owned by the permittee, for which Sedimentation and
Erosion Control Plan approval was sought.
F. Filling in, altering, or piping of any vegetative conveyance shown on the approved
plan.
10. A copy of the approved plans and specifications shall be maintained on file by the
Permittee for a minimum of ten years from the date of the completion of construction.
11. The permittee shall submit final site layout and grading plans for any permitted future
areas shown on the approved plans, prior to construction. If the proposed BUA exceeds
the pennitted amount, a modification to the permit must be submitted and approved prior
to construction.
12. Prior to the sale of any portion of the property, an access/maintenance easement to the
stormwater facilities shall be granted in favor of the permittee if access to the stormwater
facilities will be restricted by the sale of any portion of the property.
13. The permittee is responsible for verifying that the proposed built -upon area does not
exceed the allowable built -upon area.
14. The Director may notify the permittee when the permitted site does not meet one or more
of the minimum requirements of the permit. Within the time frame specified in the notice,
the permittee shall submit a written time schedule to the Director of modifying the site to
meet minimum requirements. The permittee shall provide copies of revised plans and
certification in writing to the Director that the changes have been made.
15. The permittee shall notify the Division of any name, ownership or mailing address
changes within 30 days.
M. GENERAL CONDITIONS
This permit is not transferable. In the event there is a desire for the facilities to change
ownership, or there is a name change of the Pennittee, a formal permit request must be
submitted to the Division of Water Quality accompanied by an application fee,
documentation from the parties involved, and other supporting materials as may be
appropriate. The approval of this request will be considered on its merits and may or may
not be approved.

Failure to abide by the conditions and limitations contained in this permit may subject the
Permittee to an enforcement action by the Division of Water Quality, in accordance with
North Carolina General Statutes 143-215.6A to 143-215.6C.
The issuance of this permit does not preclude the Permittee from complying with any and
all statutes, rules, regulations, or ordinances which may be imposed by other government
agencies (local, state, and federal) which have jurisdiction.
4. In the event that the facilities fail ,to perform satisfactorily, including the creation of
nuisance conditions, the Permittee shall take immediate corrective action, including those
as may be required by this Division, such as the construction of additional or replacement
stormwater management systems.
The permittee grants DENR Staff permission to enter the property for the purpose of
inspecting all components of the permitted stormwater management facility.
The permit may be modified, revoked and reissued or terminated for cause. The filing of
a request for a permit modification, revocation and reissuance or termination does not
stay any permit condition.

The Fayetteville Regional Office received a Stormwater Management Permit Application
for Little River Golf Club - Phase 1, (POD A) Clubhouse & Lodges on July 30, 2003. Additional
information requested was received on October 20, 2003. Staff review of the plans and
specifications has determined that the project, as proposed, will comply with the Stormwater
Regulations set forth in Title 15A NCAC 2H.1000. We are forwarding Pen -nit No. SW6030701,
dated November 17, 2003, for the construction of stonnwater treatment facilities associated with
Little River Golf Club - Phase f, (POD A) Clubhouse & Lodges.
This permit shall be effective from the date of issuance until November 16, 2013, and
shall be subject to the conditions and limitations as specified therein. Please pay special attention
to the Operation and Maintenance requirements of Item 11.4 of this permit. Failure to establish an
adequate system for operation and maintenance of the stormwater management system will result
in future compliance problems.
If any parts, requirements, or limitations contained in this permit are unacceptable, _you
have the right to request an adjudicatory hearing upon written request within thirty (30) days
following receipt of this permit. This request must be in the form of a written petition,
conforming to Chapter 150B of the North Carolina General Statutes, and filed with the Office of

pennit.
The Permit shall be effective from the date of issuance until November 16, 2013 and shall be
subject to the following specific conditions and limitations:
I. DESIGN STANDANDS
This permit is effective only with respect to the nature and volume of stormwater
described in the application and other supporting data.
This stormwater system has been approved for the management of stormwater runoff as
described on page 3 of this permit, the Project Data Sheets. One (1) Wet Detention basin
designed for 90% TSS removal efficiency without effluent filter. The stormwater wet
pond controls have been designed to handle the runoff from 2.50 acres for a total of
108,900 square feet of impervious area. In addition runoff from 0.8 acres associated with
construction of sidewalks not associated with a designed collection system for a total of
908 square feet of impervious area. This equals a combined total of 109,808 square feet
or 0.4165 % impervious area associated with Phase 1, (POD -A) of this 604.96 acre site
for phased low density.cluster development.

3. Approved plans and specifications for this project are incorporated by reference and are
enforceable parts of the permit.
4. The tract will be limited to the amount of built -upon area indicated on page 3 of this
permit, and per approved plans.
The runoff from all built -upon area within the permitted drainage area for the associated
collection system of this project must be directed into the permitted stormwater wet pond
control systems.A permit modification must be submitted and approved prior to the
construction of any additional built -upon area associated with the wet pond.
6. The overall tract built -upon area percentage for this and including all future low density
cluster development that is not included in this permit will be limited to 60.6169 acres or
10.02 %, but in no way can exceed 72.5952 acres or no greater than 12.0 %, as required
by Section .1006 (2) of the stormwater rules.
7. A minimum 30 foot wide vegetative buffer for development is required along all
perennial waters indicated on the most recent version of U.S.G.S. 1:24,000 (7.5 minute)
scale topographic maps or as determined by local government studies.
8. The built -upon area for future development is limited to a remaining 72.1787 acres.

II. SCHEDULE OF COMPLIANCE
The stormwater management system'shall be constructed in its entirety, vegetated and
operational for its intended use prior to the construction of any built -upon surface.
2. During construction, erosion shall be kept to a minimum and any eroded areas of the
system will be repaired immediately.
The permittee shall at all times provide the operation and maintenance necessary to assure
the permitted stormtivater systern functions at optimum efficiency. The approved
Operation and Maintenance Flan must be followed in its entirety and maintenance must
occur at the scheduled intervals including, but not limited to:
a. Semiannual scheduled Inspections (every. 6 months).
b. Sediment removal.
C. Mowing, and revegetating of side slopes.
d. immediate repair of eroded areas.
C. Maintenance of side slopes in accordance with approved plans and specifications.
1'. Debris removal and unclogging of outlet structure, orifice device and catch basins
and piping.
g. Access to the outlet structure must be available at all times.
h. The met detention pond for Little River Golf Club - Phase I, (POD A)
Clubhouse & Lodges, Permit No. SW6030701 was designed to remove 90%
TSS, therefore a vegetated filter was not required.
4. Records of maintenance activities must be kept and made available upon request to
authorized personnel of DWQ. The records will indicate the date, activity, name of
person performing the work and what actions were taken.
Decorative spray fountains wilt not be allowed in the stormwater treatment system.
The facilities shall be constructed as shown on the approved plans. This permit shall
become voidable unless the facilities are constructed in accordance With the conditions of
this permit, the approved plans and specifications, and other supporting data.
Upon completion of construction, prior to issuance of a Certificate of Occupancy, and
prior to operation of this permitted facility, a certification must be received from an
appropriate designer for the system installed certifying that the permitted facility has been
installed in accordance with this permit, the approved plans and specifications, and other
supporting documentation. Any deviations from the approved plans and specifications
must be noted on the Certification.
If the stormwater system was used as an Erosion Control device, it must be'restored to
design condition prior to operation as a stormwater treatment device, and prior to
occupancy of the facility.

9. A modification must be permitted prior to any construction. The following items will
require a modification to the permit. The Director may determine that other revisions to
the project should require a modification to the permit:
a. Any revision to the approved plans, regardless of size.
b. Project name change.
c. Transfer of ownership.
d. Redesign or addition to the approved amount of built -upon area.
C. Further subdivision, acquisition, or sale of the project area. The project area is
defined as all property owned by the permittee, for which Sedimentation and
Erosion Control Plan approval was sought.
f. Filling in, altering, or piping of any vegetative conveyance shown on the approved
plan.
10. A copy of the approved plans and specifications shall be maintained on file by the
Permittee for a minimum of ten years from the date of the completion of construction.
11. The permittee shall submit final site layout and grading plans for any permitted future
areas shown on the approved plans, prior to construction. If the proposed BUA exceeds
the permitted amount, a modification to the pern-ilt must be submitted and approved prior
to construction.

DESCRIPTION OF STORMWATER TREATMENT
Little River Golf Club proposes to develop its property, which currently contains an 18-
hole golf course and miscellaneous supporting facilities. The property is a 605-acre tract
in Carthage, North Carolina. The proposed development includes a new Clubhouse
facility with supporting infrastructure such�dfives and parking, lodging facilities, cabinsl
and single-family residential properties. The overall project will minimize impervious
areas and build to approximately 10% impervious area. 30-foot buffers will be provided
along all perennial streams and adjacent to delineated, surveyed wetlands.
The first phase of the project, as submitted in this package, proposes a new Clubhouse
and two (2) lodging facilities with supporting drives, parking and utilities to serve them.
As we propose a curb and gutter system with storm water collection for this phase we
will provide for a water quality BMP to control and treat the stormwater discharge from
the collection system. A wet detention pond will be designed to treat the runoff from the
first I inch of rainfall and provided for 90% TSS removal as interpolated from the coastal
counties SAIDA charts applied to the SAIDA chart for this project. An association will be
set up for operation and maintenance of the facility as called for on the plans.
The remaining site development will be developed to low density standards with no
stormwater collection systems as defined in The Stormwater Management Section of the
State's Administrative Code, except for a portion of Pod A as called for on the Watershed
Management Plan.

II. REQUIRED ITEMS CHECKLIST
The following checklist outlines design requirements per the Stormwater Best Management Practices Manual
(N.C. Department of Environment, Health and Natural Resources, February 1999) and Administrative Code
Section: 15 A NCAC 2H .1008.

I11. WET DETENTION BASIN OPERATION AND MAINTENANCE AGREEMENT
The wet detention basin system is defined as the wet detention basin, pretreatment including forebays and the
vegetated filter if one is provided.

Maintenance activities shall be performed as follows:
1. After every significant runoff producing rainfall event and at least
a. Inspect the wet detention basin system for sediment accumulation, erosion, trash accumulation,
vegetated cover, and general condition.
b. Check and clear the orifice of any obstructions such that drawdown of the temporary pool occurs within
2 to 5 days as designed.
2. Repair eroded areas immediately, re -seed as necessary to maintain good vegetative cover, mow vegetative
cover to maintain a maximum height of six inches, and remove trash as needed.
3. Inspect and repair the collection system (i.e. catch basins, piping, swales, riprap, etc.) quarterly to maintain
proper functioning.
4. Remove accumulated sediment from the wet detention basin system semi-annually or when depth is
reduced to 75% of the original design depth (see diagram below). Removed sediment shall be disposed of
in an appropriate manner and shall be handled in a manner that will not adversely impact water quality (i.e.
stockpiling near a wet detention basin or stream, etc.).
The measuring device used to determine the sediment elevation shall be such that it will give an accurate
depth reading and not readily penetrate into accumulated sediments.
When the permanent pool depth reads _2.5 feet in the main pond, the sediment shall be removed.
When the permanent pool depth reads _2.0 _ feet in the forebay, the sediment shall be removed.

5. Remove cattails and other indigenous wetland plants when they cover 50% of the basin surface. These
plants shall be encouraged to grow along the vegetated shelf and forebay berm.
6. If the basin must be drained for an emergency or to perform maintenance, the flushing of sediment through
the emergency drain shall be minimized to the maximum extent practical.

Dear Ricky:
As we have discussed extensively, I have finalized our stormwater management approach for the
above referenced project and the design documents for Phase 1. As you know my client wishes to
develop property around an existing 18-hale golf course in Carthage, North Carolina. The project is
located in a WS III 1 HOW waters watershed as previously verified by your office. The tract of land
being developed is 604.96 acres with the first phase of development involving an approximately 6
acre piece. The overall development will be developed to a low density standard with about 10%
impervious area proposed. We will provide the necessary buffers for all perennial streams and
wetlands as required and have decided to develop new roadways to a ditch type section with no
discrete stormwater collection systems. However, Phase 1 of the project, as submitted herein,
proposes a new clubhouse for the golf course with 2 new lodging facilities. These facilities will be
served with drives and parking designed with curb and gutter and storm drainage. Because of this we
have proposed a water quality pond to manage the runoff from the storm drainage collection system.
A water quality pond is proposed that will treat the runoff from the first inch of rainfall and will provide
for 90% TSS removal efficiency. In addition, the pond will help to approximate pre -developed runoff
rates for the 10 year storm event.

On April 23, 2003, the Fayetteville Regional Office received a copy of the Approved Erosion
Control Plan for Little River Clubhouse. State regulations 15A NCAC 21-1.1000 requires any project that
is required to obtain an Erosion and Sedimentation Control Plan approval, to apply for a Stormwater
Management Permit. In order to determine if a Stormwater Management Permit will be required for this
project, the classification of -and distance from the receiving waters must be verified by this Office. Please
return the attached classification request form with a copy of that portion of the USGS quad sheet with the
project and the closest downslope named receiving waters clearly noted.
A Stormwater Management Permit Application, ice, and supporting information will be required
if this project is either draining to an Outstanding Resource Water or within l mile of and draining to a
High Quality Water. Projects that drain to Water Supply Watersheds must be reviewed and/or receive
approval for impervious surface allocations to be signed by the local governing authority for compliance.
["lease be advised that construction of "any" built -upon areas prior to receipt of a Stormwater
Management Permit (if required) will be a violation of North Carolina General Statutes.
Please note that the information requested must be received within 30-days receipt, or

The review of the above -referenced erosion control plan has been completed. The plan
has been found to be acceptable subject to the following stipulations:
1. The permanent seeding specifications received via facsimile transmission on ,Tune 3, 2003
from Nan[ Songco of Land Design are incorporated into the approved plan.
2. This project is located within a High Quality Water (HQW) zone. All regulations regarding
sensitive area watersheds should be followed.
3. Enclosed is a Certificate of Plan Approval, which must be displayed at the job site. Title
15A, Section 413.0127(c) of the North Carolina Administrative Code requires that no person
may initiate a land -disturbing activity before notifying this agency of the date the land -
disturbing activity will begin. Failure to provide notification will result in a violation of this
plan approval.
4. In order to ensure the early coordination and implementation of the erosion control plan for
this project, it is requested that a preconstruction conference be held. As a minimum,
representatives of the owner, engineer, contractor, and this office should attend, subject to the
availability of staff. Please notify Steve Cook of this office as to when this conference is
scheduled. It is also requested that you notify this office of the proposed starting date for this
project.

6. Please note that this approval is based in part on the accuracy of the information provided in
the Financial Responsibility/Ownership Form, which you provided. You are required to file
an amended form if there is any change in the information included on the form.
7. Acceptance and approval of this plan is conditioned upon your compliance with federal and
state water quality laws, regulations, and rules. In addition, local city or county ordinances or
rules may also apply to this land -disturbing activity. This does not supersede any other
permit or6approval. The developer is responsible for obtaining any and all permits and
approvals necessary for the developing of this project prior to the commencement of this
land -disturbing activity. ;This could include the Division of Water Quality under storm water
• regulations, the -US Army Corps of Engineers under Article 404 jurisdiction, local county or
town agencies under their local ordinances, or others that may be required. This approval
cannot supersede any other permit or approval; however, in the case of a Cease and Desist
Order from the Corps of Engineers, that Order would only apply to wetland areas. All other
lands must still be in compliance with the Sedimentation Pollution Control Act.
8. If any area on site falls under the jurisdiction of Section 404 of the Clean Water Act, the
developer is responsible to the orders of the US Army Corps of Engineers. Any erosion
control measures that fall within jurisdictional wetland area must be relocated to the
transition point between the wetlands and the highlands to assure that the migration of
sediment will not occur. If that relocation presents a problem or contradicts any requirements
of the Corps of Engineers, it is the responsibility of the developer to inform the Land Quality
Section's Regional Office so that an adequate contingency plan can be made to assure
sufficient erosion control on -site. Failure to do so will be considered a violation of this
approval.
9. Any borrow material brought onto this site must be from a legally permitted mine site or
other approved source. A single use borrow site is only permissible if all of the following
apply: (1) The excavation or grading is conducted to provide soil or other unconsolidated
material to be used without further processing for a single off -site construction project for
which an erosion control plan has been approved in accordance with Article 4 of Chapter
1 I3A of the NCGS. (2) The affected land, including nonpublic access roads, does not exceed
five acres. (3) The excavation or grading is completed within one year. (4) the excavation or
grading does not involve blasting, the removal or material from rivers of streams, the disposal
of off -site waste on the affected land, or the surface disposal of groundwater beyond the
affected land. (5) The excavation or grading is not in violation of any local ordinance. (6)
An erosion control plan for the excavation or grading has been approved in accordance with
Article 4 of Chapter 113A of the NCGS.
10. following the completion of the project, you should notify this office to schedule a final
inspection. The purpose of this inspection is to ensure that all erosion control requirements
have been met.

11. This project is subject to the National Pollutant Discharge Elimination System (NPDES) and
covered by the enclosed general storm water permit NCGO10000 (Construction Activities).
You should become familiar with all of the requirements for compliance with the enclosed
general permit.
This approval is subject to the satisfactory performance of the erosion control measures
under field conditions. Should it be determined that the requirements of the Sedimentation
Pollution Control Act of 1973 (GS 113A, 51-66) are not being met, revisions to the plan and its
implementation will be required.
This permit allows for a land disturbance, as called for on the application plan, not to exceed
C 5.21 acres and/or the limits of the submitted plans. Exceeding these limits will be a violation of
this permit and would require a revised plan and additional application fee. Amendments to the
plan should be submitted to this office under the same procedures as followed for the original plan.
This plan approval shall expire three (3) years following the date of approval, if no land -disturbing
activity has been undertaken, as is required by Title 15A NCAC 4B .0029.

IV. DEED RESTRICTIONS AND PROTECTIVE COVENANTS
The following italicized deed restrictions and protective covenants are required to be recorded for all
subdivisions, outparcels and future development prior to the sale of any lot. If lot sizes vary significantly, a table
listing each lot number, size and the allowable built -upon area for each lot must be provided as an attachment.
I. The following covenants are intended to ensure ongoing compliance with state stormwater management permit number
as issued by the Division of Water Quality. These covenants may not be
changed or deleted without the consent of the State.
2. No more than 5,000 square feet of any lot shall be covered by structures or impervious materials.
Impervious materials include asphalt, gravel, concrete, brick, stone, slate or similar material but do not include wood
decking or the water surface of swimming pools.
3. Swales shall not be filled in, piped, or altered except as necessary to provide driveway crossings.
4. Built -upon area in excess of the permitted amount requires a state storm water management permit modification prior to
construction.
5. All permitted runoff from outparcels or future development shall be directed into the permitted storm water control
system. These connections to the storm water control system shall be performed in a manner that maintains the integrity
and performance of the system as permitted.

II_ REQUIRED ITEMS CHECKLIST
The following checklist outlines design requirements per the Stoimwater Best Management Practices Manual
(N.C. Department of Environment, Health and Natural Resources, February 1999) and Administrative Code
Section: 15 A NCAC 211.1008.

III. WET DETENTION BASIN OPERATION AND MALNTENANCE AGREEMENT
The wet detention basin system is defined as the wet detention basin, pretreatment including forebays and the
vegetated Filter if one is provided.

Maintenance uctivides shall be performed as follows:
1. After every significant runoff producing rainfall event and at least monthly:
a. Inspect the wet detention basin system for sediment accumulation, erosion, trash accumulation,
vegetated cover, and general condition.
b. Check and clear the orifice of any obstructions such that druwdown of the temporary pool occurs within
2 to 5 days as designed.
2.' Repair eroded areas immediately, re -seed ws necessary to maintain good vegetative cover, mow vegetative
cover to maintain a maximum height of six inclies, and remove trash as needed.
3. Inspect and repair the collection system (i.e. catch basins, piping, swales, riprap, etc.) quarterly to maintain
proper functioning.
4. Remove accumulated sediment from the wet detention basin system semi-annually or when depth is
reduced to 75% of the original design depth (sec diagram below). Removed sediment shall be disposed of
in an appropriate manner and shall be handled in a manner that will not adversely impact water quality (i.e.
stockpiling near a wet detention basin or stream, etc.)_
The measuring device used to deterrnine the sediment elevation shall be such that it will give an accurate
depth reading and not readily penetrate into accumulated sediments.
When .the permanent pool depth reads 2.5 feet in the main pond, the sediment shall be removed.
When the permanent pool depth reads 2 feet in the forebay, the sediment shall be removed.

5. Remove cattails and other indigenous wetland plants when they cover 50% of the basin surface. These
plants shall be encouraged to grow along the vegetated shelf and forebay berm.
6. If the basin must be drained for an emergency or to perform maintenance, the flushing of sediment through

with plans & specifications shows a total of 2.72 acres of impervious area. Please correct
or explain.
5. Please update Page 2 of 4, III. (6) % impervious area, 2.5 acres of proposed impervious
area associated with 4.0 acres in drainage area (1) equals 62.50% impervious, while the
1.09 acres of proposed impervious area associated with the 0.8 acres in drainage area (2)
equals 135.25 % iniprevious. hnprevious areas can not equal greater than 100% of a
given drainage area. Please explain.
6. Please update Page 3 of 4, IV. (2) of deed restrictions and protective covenants. Since it is
the understanding of this office that POD A (phase 1) is only associated with the
Clubhouse and lodges, and that said property will not be sold or subdivided; therefore IV
(2) should be corrected from 5,000 square feet per lot to read NIA. Note: future (phased
development) application submittals that propose any tranfer of ownership will be limited
to a 10.02% build upon area (BUA) per lot size and/or not to exceed 10.02% BUA of
total land mass being transfer when totaling BUA of individual lots. This 10.02% BUA
requirement has been established by you as indicated on your application and master plan.
7. Please update Page 4 of 4, VIII. (1) Applicant name/signature must be by a president
or vice president of a company or corporation. If not, remember to provide a signed
authorization from someone who fits the requirements. (See #2 above)

Vogel sent a signed and dated revised page 1 of 4 changing Diameter of orifice from 2.0
inches to 1.5 inches. Thank you for correcting this item, nofurther action is required to
