Su_mmerfield Charter Academy _
(Project Name)
for Charter Development Company, LLC (Project Owner) hereby state that, to the
best of my abilities, due care and diligence was used in the observation of the project
construction such that the construction was observed to be built within substantial
compliance and intent of the approved plans and specifications.
The checklist of items on page 2 of this form is included in the Certification.
Noted deviations from approved plans and specification:
Sand filter for drainage area, D.A. #1, discharges to diversion ditch and sediment trap that was
constructed as part of the original temporary sediment erosion controls. Revised grading did not
permit the construction of a level, spreader per original plans. Diversion ditch and sediment trap is
stabilized and discharges, upstream of the buffers Discharge is diffused through rock check as part
of the sediment trap. There are no signs of erosion or channelization evident in the stream buffer.

In response to your request for additional information dated March 21, 2013, we offer the
following corresponding responses for your consideration:
1. Enclosed please find an original signed and notarized authorization letter.
2. SWU-101
a. Attached please find a Basin Information Table for all the drainage areas.
b. We have indicated the proper off -site drainage areas.
3. We have revised plan Sheet C-4.0 to include all areas draining to each BMP
including off -site areas and the area of the BMP themselves. We have added
existing and proposed contours to the plan.
4. We have revised the drainage areas to include all off -site drainage. This is reflected
on plan Sheet C-4.0
5. We have revised and included our Storm Water Management and Soil Erosion and
Sedimentation Control Plan, Revised April 2, 20103 to include calculations for: 1)
existing runoff pre -development, 2) post -development runoff from drainage areas, 3)
peak runoff rate from the outfalls post -construction, 4) stage -storage tables for sand
filters, 5) sand filter area is the area at the lowest elevation for the respective sand
filter, 6) underdrain pipe sizing, 7) hydraulic grade line for the sand filters for the
100yr-24hr storm event, 8) flow calculations for Pipe ZZ and Outlet OP#10.

Additionally, we have required water quality volume, areas, formulas, flow
calculations, pre and post flow from each drainage area, and tables on plan Sheet C-
4.0.
6. Attached please find the SHWT determinations for sand filter #1, #2, and #5.
7. The gravel hatching represented a temporary access route around the building for
building construction. We have eliminated the bio-retention cells from being our
BMP's. In place of bio-retention cells, these areas will now just be depressions to
collect the storm water for conveyance in the closed conduits to the sand filters.
8. We have eliminated the well site from the plan. Please refer to plan Sheet C-2.0.
We are just stubbing the gravel drive across the creek for future access and
maintenance to septic field. No water will be channeled, it will sheet flow off the
proposed gravel.
9. We have shown the drainage area for the water flowing to pipe ZZ on plan Sheet C-
4.0. We have provided calculations for the 100yr-24hr storm event in our Storm
Water Management and Soil Erosion and Sedimentation Control Plan, Revised April
2, 2013. The flow of water can be dissipated with a rip -rap outlet protection. The
associated velocity is below the threshold for bluegrasslBermudagrass on highly
erodible soils
10. BMP Cross Section Detail on plan Sheet C-2.2.
a. We have indicated a clay core seal to be constructed under the rock weir.
b. This cross section is only for the sand filter.
11. We have eliminated all bio-retention cells. We have modeled the site for a 100yr-
24hr storm event. The hydraulic grade line in the sand filters and the top of pond
elevations are indicated in the Storm Water Management and Soil Erosion and
Sedimentation Control Plan, Revised April 2, 2013. There is nearly a foot of
freeboard in the ponds during this storm event.
12. The sand filter basins may/can be used during construction to ensure compliance
with the NPDES permit. Please reference the note under the Sand Filter Section
Detail on plan Sheet C-2.2. The BMP Manual recommends using chocking stone if
there is a potential for high sediment loads that would clog the washed stone. We
are eliminating this factor by telling the contractor not to install the underdrains,
stone, and filter media until the site has been stabilized to the greatest extent
possible.
13. We have eliminated sand filter, BMP #4, and propose to construct a drainage swale
to keep off -site surface water from entering the site.
Page 3
Mr. Robert D. Patterson

Sand Filter #4 has been eliminated and combined with drainage area #2. Sand filters are numbered and
identified according to their respective drainage areas. Each drainage area consists of several smaller
sub -drainage areas. The drainage areas and sub -drainage areas are numbered according to their
respective sand filter. For example, Sand filter #1 collects and treats water from drainage area #1.
Drainage area #1 consists of sub -drainage areas #1.1 through #1.10. The level spreader is identified as
LS#1. The level spreader diffuses flow from the discharge of sand filter #1.
There are a total of three (3) discharge points on the site, identified as 0P#1, OP#3, and OP#8 as shown
on plan sheet C-2.1.
Sand Filter #1 discharges to OP#1.
Sand Filter #2 and #3 discharge to OP#3.
Sand Filter #5 discharges to OP#8.

Chuck,
Regarding #14: The rules require that BMPs be sized conservatively based on the Simple Method and the
whole receiving drainage area at it's ultimate buildout. Essentially, BMPs are sized for an instantaneous volume for the V
runoff for the receiving DA. This applies to BMPs in series as well. The other option would be to design them in parallel
instead by not discharging the bioretention cells into the sand filters.
Regarding #6: I can try to work with you more on this item. However, this requirement is clearly stated in the BMP
manual that at least one boring is required w/in the footprint of each BMP. The SHWT separation is an extremely
important design factor for the success of these types of BMPs. The soil scientist or geotech engineer must be willing to
seal something stating that based on the soils information from the on -site evaluations that the SHWT is at least 2' below
the bottom of the media in each BMP. If they were not specifically looking for the SHWT elevation when the other
borings were done, that may be difficult. The SHWT elevation can be much different than just the elevation that water
was observed at some given point in time. It can also vary greatly across a site due to topography, clay lenses, etc. If
the separation was more than the minimum 2 feet in the one BMP that it was determined for, I might be more
comfortable with it. Also, the underdrains are only for discharging the filtered water, not for getting rid of incoming
groundwater. Without the separation, studies in NC show that there is almost always greater pollutant outflow than
flowing into the BMP.
Please let me know if you want to discuss further. Thanks.

Subject: RE: SW4130301 - Summerfield Charter Academy - Additional Information Request
Robert,
Thank you for the quick review and comments.
understand all your comments, but have a few comments/questions:
Reference Comment #6 —The Owner drilled 17 borings on the property. Soil boring logs and a soil boring exhibit were
submitted indicating water table depths and bottom of media (BOM) for each BMP. The exhibit indicates that ground
water is deeper than the media in each BMP. I specifically want to point out the borings within the building envelope.
These borings are deeper than the others and, in particular, boring 413 is 33 feet below existing grade with no ground
water encountered. The exceptions to the above statement are sand filters #4 and #5. We have limited boring
information in the area of these two BMP's.
I understand the SHWT requirement. However, given the topology of the site, the larger regional topography indicated
on the quadrangle map, existing boring data, and the fact that ground water was only encountered near the creek (west
side, lower portion of the site), we feel that specific SWHT determinations for each BMP would provide the same
findings already presented. This concern is further mitigated with under drains installed for each BMP. Expending
additional time and money to verify the same conclusions is hard to justify given the data provided.
We do acknowledge the lack of boring data for sand filter #4 and #5 and proposed to conduct SHWT determinations for
these BMA's. We request a second review of the information provided and consideration that SHWT is not a concern
except as acknowledged.
Reference Comment #14 —A number of the BMA's are in series. Given the time of concentration, required 1-inch
treatment volume, and storage in each BMP, each BMP will receive the required treatment volume from its respective
treatment area prior to receiving storm water from the upstream drainage area/BMP, then the by-pass structures for
each downstream BMP will divert the upstream storm water and prevent upstream water from entering downstream
BMP's. Basically, all downstream BMA's will collect 1-inch of water from its respective drainage area prior to
receiving/by-passing upstream BMP by-pass water.
At the tail end of a storm, when high flows subside, storm water from the upstream BMP will be diverted to the
downstream BMP. However, at this point, the upstream water has already been treated or is not part of the 1-inch
required to be treated. The downstream BMP would have already captured the required 1-inch from its respective
drainage area.
Assuming a bioretention cell is an acceptable treatment method and the storm system functions hydraulically as
described above (I will provide verification), do you have any other specific concerns regarding the BMP's in series?
Thank you for your consideration. Naturally we are awaiting your decision on comment #6 prior to resubmitting.
Thanks,
Ch uck

Subject: Request for Additional Information
Stormwater Project No. SW4130301
Summerfield Charter Academy
Guilford County
The Division of Water Quality Central Office received a Stormwater Management Permit Application for the
subject project on March 11, 2013. A preliminary review of that information has determined that the
application is not complete. The following information is needed to continue the stormwater review:
✓ 1. The application (SWU-101) and the 0&M Agreements must be signed by a Manager/Member of
the LLC as shown on the NC Secretary of State database. Jim Chamberlain is not shown as a
Manager/Member, so an original letter from a Manager/Member would need to be submitted
authorizing him to sign these for the LLC.
2. On SWU-101, IV.10.:
✓a. One DA column should be filled out for each individual BMP proposed (except level
spreaders). The DA label in the table must match those shown on the plans and
calculations.
---b. Offsite area is shown as zero, but sht. C-4.0 shows runon from offsite area on the east side
of the property.
3. All areas draining to each BMP must be included and shown on the DA map. Sht. C-4.0 does not
show the delineated DA's to capture all the area draining to sand filters 1, 2, 4 and 5; including the
area of the BMPs themselves. Please revise. Also, please show the contours on the DA map.
-4. Based on the existing contours shown, it appears there is offsite area along the northeast of the
property that is not being shown in the DAs delineated to bioretention cells 1- A, 1-13, and 1-C.
✓5. The supplement forms are just a summary of results. Please provide all supporting calculations
for the results shown on the supplement forms (treatment volume using the simple method,
underdrain calcs., sand filter area calcs., stage -storage tables, etc.).

March 21, 2013
6. A SHWT elevation determination must be done within the footprint of each BMP proposed. This
appears to have only been done for sand filter 42.
/7. Sheet C-2.0 shows gravel hatching on top of bioretention cells 1-A, 1-13, and 1-C. Please
explain/revise as needed to show that they will be covered in sod, not gravel.
8. Diffuse flow at a non -erosive velocity must be provided from the proposed swale, near the well
site, that discharges to the riparian buffer using a level spreader. Also, please provide calculations
for the swale to show that it is non -erosive for the 10-yr storm.
9. Diffuse flow at a non -erosive velocity must be provided from the outlet of pipe ZZ to the riparian
buffer using a level spreader.
10. On the BM Cross Section detail on sht. C-2.2:
a. With the forebay bottom below the top of the media, it appears that the water will short
circuit the full media depth by flowing latererally from the forebay into the media layer.
Please revise to prevent this. One possible option would be to line the forebays.
b.' Is this cross section only for the sand filters?
f11. Please show how larger storms will safely bypass/overflow from the bioretention cells. A
bypass/overflow must be provided for storm events larger than the 1" treatment volume.
12. A layer of choking stone is recommended instead of filter fabric between the media and gravel
layers of the BMPs.
13. The discharge from BM #5 is routed to BM 44, so the DA and impervious area for 5 must be
accounted for in the sizing for 4, and reflected on the supplement form and calculations.
14. The DAs and impervious area for all bioretention cells in series with sand filters 1 and 3 must be
included in the sizing for those sand filters. Please revise.
-/15. Please be sure to revise all forms, plans, and calculations to reflect any changes.
Please note that this request for additional information is in response to a preliminary review. The requested
information should be received by this Office prior to April 21, 2013, or the application will be returned as
incomplete. The return of a project will necessitate resubmittal of all required items, including the application
fee.
If you need additional time to submit the information, please mail or fax your request for a time extension to
the Division at the address and fax number at the bottom of this letter. The request must indicate the date by
which you expect to submit the required information. The Division is allowed 90 days from the receipt of
completed application to issue the permit.
The construction of any impervious surfaces, other than a construction entrance under an approved
Sedimentation Erosion Control Plan, is a violation of NCGS 143-215.1 and is subject to enforcement action
pursuant to NCGS 143-215.6A.
All revised original signed documents must be returned or new originals must be provided. Copies are not
acceptable. Any revised calculations or plans must be sealed, signed, and dated. Please reference the State
assigned permit number SW4130301 on all correspondence. If you have any questions concerning this
matter please feel free to call me at (919) 807-6375, or at robert.patterson@ncdenr.gov.

S&ME Project No. 1581-12-138
Dear Mr. Riley:
S&ME, Inc. (S&ME) has conducted Stormwater Best Management Practices (BMP) Soil
Testing per S&ME Proposal No. 1581-12-P207 Revised dated December 11, 2012 to
provide information for a new Stormwater Management Permit Application to the North
Carolina Department of Environment and Natural Resources (NCDENR) — Division of
Water Quality (DWQ) and/or local stormwater regulatory agencies. A soil scientist
investigation was conducted to evaluate the soil properties of a proposed Stormwater
BMP area to determine suitability for stormwater management systems. The soil
scientist investigation was conducted to evaluate seasonal high water table (SHWT)
elevations below existing ground surface (bgs).
DISCUSSION
The use of stormwater BMP's is subject to the suitability of site soils and regulatory
approval. Regulatory guidance on requirements for permitting of stormwater BMP's are
provided in the North Carolina Division of Water Quality — Stormwater Best Management
Practices Manual (NCDENR-SW-BMP), dated July 2007 (Revised, 2009). The NCDENR-
SW-BMP requires that the SHWT, or confining layer must be 2 feet below the bottom of
most Stormwater BMP's.

Stormwater BMP Soil Testing SBME Project No. 1581-12-138
Summerfield Academy — Proposed Stormwater BMP December 17, 2012
PROJECT BACKGROUND
The subject area evaluated is associated with one (1) proposed Stormwater BMP for the
proposed Summerfield Academy. The proposed Summerfield Academy is located
approximately l mile northwest of the intersection of United States (US) Highway 220
and North Carolina (NC) Highway 150 in Summerfield, North Carolina. Mr. Chuck
Christy with WadeTrim provided Mr. Stephen Lacz with S&ME a revised site plan on
December 11, 2012 indicating the location of the proposed Stormwater BMP. S&ME's
scope of services consisted of evaluating the SHWT at the proposed location to a
minimum depth of eight (8) feet bgs, or until seasonal high soil wetness conditions were
encountered (whichever is first encountered), or until auger refusal, as determined by a
Licensed Soil Scientist. The area evaluated consisted of wooded cutover with dense
vegetation (Figure 2).
An S&ME soil scientist conducted an evaluation of the soils within the proposed BMP
system, identified on the provided site map. The soil scientist evaluation was conducted
to evaluate the suitability of the soil properties relative to Stormwater Management
permitted by the NCDENR-DWQ and/or local stormwater regulatory agencies.
FINDINGS
Seasonal High Water Table (SHWT) Determination
The SHWT evaluation was performed by advancing two (2) hand auger borings to depths
ranging from 90 to 108 inches bgs within the proposed stormwater management system
area. The locations of the SHWT evaluations were approximated in the field (Figure 2).
Hand auger borings were evaluated by a Licensed Soil Scientist for evidence of SHWT
influence. This evaluation involved looking at the actual moisture content in the soil and
observing the matrix and mottle colors. Depending on the soil texture, the soil color will
indicate processes that are driven by seasonally high water table fluctuations, such as iron
reduction and oxidation and organic matter staining.
Please note that SHWT evaluations are based on secondary evidence and not on direct
groundwater level measurements. Groundwater levels fluctuate for numerous reasons
and these findings do not indicate that groundwater levels have not or will not rise above
the noted depths. The approximate SHWT test locations are identified in Figure 2, and
the approximated SHWT depths are located in Table 1, and further identified in the
attached soil profile descriptions.

CONCLUSION
Based on information obtained from each of the hand auger boring locations, variability
of SHWT depths exists within the area evaluated and careful consideration will need to
be made when determining stormwater BMP installation depths.
