Cooper James TCJ Associates PO Box 10325 Greensboro, NC 27404 To Those Concerned, Brawley Construction intends to address the erosion and lack of maintenance on the retention pond located behind the Dollar General in King, NC on Mountain View Road in the following manner: A) The rip rap will be removed from the weir between the collection pond and the distribution pond. B) The erosion of this dam will be graded and completed with impervious fabric to be placed below the rip rap as the rip rap is replaced. C) The distribution pond bank will be graded back more gently from the high water mark in order to maintain constant and consistent grass slopes. D) The disturbed areas will be seeded with 30% rye and 70% fescue and stabilization mats will be placed on the slopes after seeding and fertilization. E) All areas surrounding a 20' radius of the top shoulder of the pond will be over seeded with 30% rye and 70 % fescue and fertilized to help create a more stable area around the pond. F) Maintenance will begin twice monthly at a minimum once this remediation work is complete. Brawley Construction anticipates the scope work to be completed by March 1, 2012. As noted in our letter to DENR of September 27", we contacted John Darden of Darden Engineering Services and asked him to conduct a site inspection of the pond and review the design and construction of' the pond. Mr. Darden performed the inspection on November 1, 2011 and advised us that the construction of the pond was consistent with the approved drawings and that the water level was stable at the current level. Additionally, he recommended we clean up the pond in general and clean up around the catch basin at the end of the parking lot. Mr. Darden further advised us today that he had contacted You with a proposal to allow the pond to function at the existing water level and plant additional plants along the water line and was waiting for a response from DENR. As you may recall, we sold this location in March 2010 but were unaware that the stormwater permit and maintenance of the pond required transfer with the sale. As we are the current permit holder, Columbia Development, LLC will be responsible for a Scope of Work when it is approved, but upon completion of the agreed upon work the pond will be transferred to the current owner via the form you provided. The DENR letter of September 30`t' requested a corrective action plan by November 15`t'. While the above noted is not a formal plan, it is an outline of the actions that have taken place and a sound proposal from Mr. Darden. We trust this shows good faith on our part to remedy the situation in a timely manner to avoid any penalties. We look forward to DENR's response to Mr. Darden's proposal regarding the pond. As a status report....we contacted Darden Engineering, which is the engineering firm that designed the pond, and requested their assistance in determining why the water level is below the specified amount. Once we have their findings, we intend to contact the new owner to discuss the transfer of ownership and the situation with the pond. We will keep you appraised of our activities. SCHEDULE OF COMPLIANCE 1. The stdrmwater management system shall be constructed in its entirety, vegetated and operational for its intended use prior to the construction of any built -upon surface. 2. During construction, erosion shall be kept to a minimum and any eroded areas of the system will be repaired Immediately.' 3. The permittee shall at all times provide the operation and maintenance necessary to assure the, permitted stormwater system functions at optimum efficiency. The approved Operation and Maintenance Plan must be followed in its entirety and maintenance must'occur at the scheduled intervals including, but not limited to: a. Semiannual scheduled inspections (every 6 months). b. Sediment removal. C. Mowing and revegetation of slopes and the vegetated filter. d. Immediate repair of eroded: areas. e. Upon completion Of construction, prior to issuance of a Certificate of Occupancy, and prior to operation of this permitted facility, a certification must be received from an appropriate designer for the system installed certifying that the permitted facility has been installed in accordance with this permit, the approved plans. and specifications, and other supporting documentation. Any deviations from the . approved plans and specifications must be noted on the Certification. A modification may be -required for those deviations. 7. if the stormwater system was used as an Erosion Control device, it must be restored to design condition prior to operation as a stormwater treatment device, and prior to occupancy of the facility. 8. Access to the stormwater facilities shall be maintained via appropriate easements at all -times., 9. The permittee shall submit to the Director and shall have received approval for revised plans, specifications, and calculations prior to construction, for any modification.to the approved plans, including, but not limited to, those listed below: a. Any revision to any item shown on -the approved plans, including the stormwater management measures, built -upon area, details, etc. b. Project name change. C. Transfer of ownership. d. Redesign or addition to the approved amount of built -upon area or to the drainage area. e. Further subdivision, acquisition, lease or sale of all or part of the project area. The project area is defined as all property owned by the permittee, for which Sedimentation and Erosion Control Plan approval or a CAMA Major permit was sought. f. Filling in, altering, or piping of any vegetative conveyance shown on the approved plan. 10. The permittee shall submit final site layout and grading plans for any permitted future areas shown on the approved plans, prior to construction. 11. A copy of the approved plans and specifications shall be'rnaintained on file by the permittee for a.minimum of ten years from the date of the completion of construction. 12. The Director may notify the permittee when the permitted site does not meet one or more. of the minimum requirements of the permit. Within the time frame specified in the notice, the permittee shall submit a written time schedule to the Director for modifying the site to meet minimum requirements: The permittee shall provide copies of revised plans and certification in writing to the Director that the changes have been made. Ill. GENERAL CONDITIONS This permit is not transferable except after notice to and approval by the Director. In the event of a change of ownership, or a name change; the permittee must submit a completed Name/Ownership Change form, to the Division of Water Quality, signed by both parties, and accompanied by supporting documentation as listed on page 2 of the form. The project must be in good standing with the Division. The approval of this request will be considered on its merits and may or may not be approved. 2. Cooper James PO Box 10325 Greensboro, NC 27404 Re: Division Water Quality Dear Cooper, Brawley Construction Company was contacted by Columbia on or about January 19, 2009 and requested to aid in expediting the completion of the retention pond on Dollar General site at King, NC. Although Brawley had no prior duties under the contracting of this pond, Brawley agreed to become involved. On January 20, 2009 the site was reviewed by Brawley to see what scope of work had as of yet to be completed. On January 20, 2009 Brawley attempted to contact Bradley Benett of DWQ. The morning of January 21, 2009 Columbia received from DWQ a letter of noncompliance. Brawley was contacted at this time to attempt to bring this site under compliance quickly. Since becoming involved Brawley has found that the mass grading of the site and placement of inlets, outfalls and spillways have been completed and are being surveyed January 26, 2009 for accuracy. Brawley began on January 26, 2009 to proceed with the seeding and matting of the areas not requiring aquatic plantings. This portion of the project should, barring rain, be completed by Wednesday January 28, 2009. -2- Brawley has also contacted a supplier for the organic soil to be placed on the shelf in the wet pond. Also contacted was an aquatic supplier to supply and place the plantings for the wet area of the pond. Brawley feels that with normal weather conditions allowing work to proceed this can be accomplished on or before February 20, 2009. Brawley will maintain contact with Mr. Boone of the DWQ to apprise DWQ as to what progress is being made concerning this project. It is worth noting that Brawley intends to have the engineers certification by February 20, 2009 and if needed Mr. Boone's review. SCHEDULE OF COMPLIANCE 10 The stormwater management system shall be constructed in its entirety, vegetated and operational for its intended use prior to the construction of any built -upon surface. 2. During construction, erosion shall be kept to a minimum and any eroded areas of the system will be repaired immediately. 3. The'permittee shall at all times provide the operation and maintenance necessary to assure the permitted stormwater system functions at optimum efficiency. The approved Operation and Maintenance Plan must be followed in its entirety and maintenance must occur at the scheduled intervals including, but not limited to: a. Semiannual scheduled inspections (every 6 months). b. Sediment removal. I C. Mowing and revegetation of slopes and the vegetated filter. d. Immediate repair of eroded areas. e. Maintenance of all slopes in accordance with approved plans and specifications. f. Debris removal and unclogging of outlet structure, orifice device, flow spreader, catch basins and piping. g. Access to the outlet structure must be available at all times. 4. Records of maintenance activities must be kept and made available upon request to authorized personnel of DWQ. The records will indicate the date, activity, name of person performing the work and what actions were taken. 5. The facilities shall be constructed as shown on the approved plans. Upon completion of construction, prior to issuance of a Certificate of Occupancy, and prior to operation of this permitted facility, a certification must be received from an appropriate designer for the system installed certifying that the permitted facility has been installed in accordance with this permit, the approved plans and specifications, and other supporting documentation. Any deviations from the approved plans and specifications must be noted on the Certification. A modification may be required for those deviations. 7. If the stormwater system was used as an Erosion Control device, it must be restored to design condition prior to operation as a stormwater treatment device, and prior to occupancy of the facility. 8. Access to the stormwater facilities shall be maintained via appropriate easements at all times. 9. The permittee shall submit to the Director and shall have received a proval'for revised plans, specifications, and calculations prior to construction, for any modification to the approved plans, including, but not limited to, those listed below: a. Any revision to any item shown on the approved plans, including the stormwater management measures, built -upon area, details, etc. b. Project name change. C. Transfer of ownership. d... Redesign or addition to the approved amount of built -upon area or to the drainage area. e. Further subdivision, acquisition, lease or sale of all or part of the project area. The project area is defined as all property owned by the permittee, for which Sedimentation and Erosion Control Plan approval or a CAMA Mayor permit was sought. f. Filling in, altering, or piping of any vegetative conveyance shown on the approved plan. 10. The permittee shall submit final site layout and grading plans for any permitted future areas shown on the approved plans, prior to construction. 11. A copy of the approved plans and specifications shall be maintained on file by the Permittee for a minimum of ten years from the date of the completion of construction. 12. The Director may notify the permittee when the permitted site does not meet one or more of the minimum requirements of the permit. Within the time frame specified in the notice, the permittee shall submit a written time schedule to the Director for modifying the site to meet minimum requirements. The permittee shall provide copies of revised plans and certification in writing to the Director that the changes have been made. lll. GENERAL CONDITIONS This permit is not transferable except after notice to and approval by the Director. In the event of a change of ownership, or a name change, the permittee must submit a completed Name/Ownership Change form, to the Division of Water Quality, signed by both parties, and accompanied by supporting documentation as listed on page 2 of the form. The project must be in good standing with the Division. The approval of this request will be considered on its merits and may or may not be approved. 2. In the event that the facilities fail to perform satisfactorily, including the creation of nuisance conditions, the Permittee shall take immediate corrective action, including those as may be required by this Division, such as the construction of additional or replacement stormwater management systems. 6. The permittee grants DENR Staff permission to enter the property during normal business hours for the purpose of inspecting all components of the permitted stormwater management facility. 7. The permit issued shall continue in force and effect until revoked or terminated. The permit -may be modified, revoked and reissued or terminated for cause. The filing of a request for a permit modification, revocation and re -issuance or termination does not stay any permit condition. 8. Unless specified elsewhere, permanent seeding requirements for the stormwater control must follow the guidelines established in the North Carolina Erosion and Sediment Control Planning and Design Manual. 9. Box 1067 Moorsevil,l.e, NC 28115 You contacted me, this past week, about evaluating the soil at a site on Mountainview Road, just off North Carolina Highway 66, near King, North Carolina. It is the construction site of a new Dollar General Store. You asked me to evaluate the soil area, where a sand -.filter sewage treatment system is proposed, for, the possible existence of a seasonal high water table. I began my evaluation of the site on Friday a#Iernoon, 2/8/08, and completed it on Saturday morning, 2/9/08. I used a soil auger to bore and then describe six holes in or about the proposed sand -filter location. The approximate location of the six holes is located on the attached map (not to scale). I determined that the soil at this site formed in old alluvium (stream terrace). This was evidenced by the presents of subrounded and subangular quwts pebbles scattered throughout the profile of each of the six holes. Further evidence was the soil colors, the stickiness of the subsoil clay, the soil horizon textures, and the depth of the soil profile in holes number 2, 3, and. 4. There is no stream of any size, now, flowing in this area. However, this is definitely old alluvium. Presently, this site is in a head slope landscape position, which means that surface water and subsurface water start to funnel through this area toward the main drainageway. The stickiness of the subsoil clay and the fact that it is alluvium indicates that the clay mineralogy is probably mixed rather than kaoliniti.c. I observed no water table, currently present, in any of the six holes I bored. However, the soil profile descriptions (attached) indicate the presents of a seasonally perched water table. Hole (stop) # 4, which I bored to a depth of 82 inches, gives the best indication. It had redox iron accumulations starting at a depth of about 6 inches and continued to a depth of 82 inches and at that depth I had auger refusal by contact with a large quartz pebble or pebbles. This hole had redox depletions of'chroma 2 or less starting at a depth of about 13 inches and continuing to a depth of 45 inches. Below a depth of 45 inches there were some redox depletions, but they were chrome 3 or 4. Also, at a depth of about 45 inches the estimated sail texture dropped from clay to clay loam and at a depth of 57 inches to a sandy clay loam. Dole # 1 had redox accumulations starting at a depth of about 13 inches, but redox depletions with chcbma 2 or less gray colors did not occur until a depth of about 52 i.nche§ and continued t�ad auger refusal by contact with a large quartz pebble or pebbles at 54 inches. Hole # 2 redox accumulations starting at a depth of about 19 incites. but redox depletions with c6oma 2 or less gray colors did not occur until a depth of about 44 inches and continued td a depth of about 59 inches. From a depth of 59 inches to a depth. of 61 inches, there were redox accumulations and depletions, but the depletions were chroma 4 and not c6oma 2. Summary: Redox features in all six holes indicate a seasonal high water table. Holes # 2, 3, and 4 indicate by not having chroma 2 or less gray soil colors in the deepest horizons that the water table is perched. Holes # 1, 5, and 6 would probably show a perched water table, also, if I had gotten the holes deeper. A, perched water table is common in old alluvium where a heavier textured material, such as clay, aver lies a lighter textured material, such as sandy clay loam. During very wet periods of high preciipitatiOn, most likely between November and March, the water that enters the soil and moves down into the well structured, clayey subsoil can not move into the coarser textured, less structured underlying sandy clay loam as fast as it moves down through th�. subsoil. Therefore, the water stacks -up on top of the coarser textured material; ikeeping the soil saturated for sufficient days to produce the chroma 2 or less gray colors; indicative of soil wetness and a seasonal high water table. The fact that the auger holes only show about I to 15 percent gray redox depletions in one or more Boil horizons indicates that the soil probably does not stay saturated for more than a few weeks at a time during the wettest years. The soil may not be saturated for more than a few days during drier years. If your revised plans propose a level spreader, please be sure to completely fillout the level spreader supplement form and design it based on the requirements in the BMP Manual. One of the options under "Level Spreader Design" must be marked "Y" for Yes. Also, if the design flow is 12 cfs as stated, please note the automated comment next to "Design flow" on the supplement form. 3. On SP-3, the level spreader lip cannot have any soil on top of it. Smooth - walled high density polyethylene pipes will then carry the stormwater to the flow splitter. The flow splitter will allow the first 1 inch of stormwater runoff to enter the sand filter and be treated of any suspended solids. The treatment in the sand filter will take place by allowing the stonnwater to flow into a forebay area where low velocities will allow suspended particles to settle out. The upper volume of the stormwater will then be able to leach into the sand where any remaining solids will be able to be filtered out. Perforated pipes lying under the sand will collect the filtered stormwater and convey it to a ditch running along the side of the property. For storms that produce runoff greater than I inch the flow splitter will allow the excess stormwater buildup and over flow a weir fixed at a set elevation in the flow splitter. The overflow will then be directed via pipe to a level spreader which will in turn spread the excess stormwater evenly over a vegetative filter. I. Supplemental forms have been filled out and submitted with this revision for both the sand filter and the level spreader. 2. I have adjusted the inconsistencies we spoke of over the phone on the Stormwater Management Permit Application. 3. Attached is a copy of the soil report for the site. The soil scientist did report there was a SHWT (seasonal high water table) at the location of the sand filter. He also reported the SHWT was minimal and probably only happened at the wettest time of the year. We did look further into this matter and consulted with Atlantic Coast Engineering and Testing, INC. They have stated in an attached letter that with the building and parking area in its location, if we install a curtain drain above the sand filter it will resolve any trace of the SHWT. 4. Drainage area maps have been added to the plans. 5. Roof drains have been directed into the catch basins and notes have been placed on the plans stating as much. b. There are not wetlands on the property and a note has been placed on the plans stating so. 7. A level spreader has been added to the plans to convey the overflow from the sand filter into a 30 foot vegetative strip. 8. The deed restrictions for we submitted for this project will be dismissed.
