APPROVAL of 401 Water Quality Certification

Dear Mr. Atkins:
You have our approval to place fill material in wetlands or waters for the purpose of constructing
a left turn on US 21 from SR 1421, as you described in your application dated 14 May 1996. After
reviewing your application, we have decided that this fill is covered by General Water Quality
Certification Number 3026. This certification allows you to use Nationwide Permit Number 3 when it
is issued by the Corps of Engineers.
This approval is only valid for the purpose and design that you described in your application. If
you change your project, you must notify us and you may be required to send us a new application.
For this approval to be valid, you must follow the conditions listed in the attached certification. In
addition, you should get any other federal, state or local permits before you go ahead with your
project.
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory
hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing,
send a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the
Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and
its conditions are final and binding unless you ask for a hearing.
This letter completes the review of the Division of Environmental Management under Section
401 of the Clean Water Act. If you have any questions, please telephone John Dorney at 919-733-

Re: Project No. 9.8112514 - Construct Left Turn Lane on US21
from SR1421, 925' South Near Lowe's Hardware, in
Alleghany County, NC.
Dear Mr. Jolly:
The North Carolina Department of Transportation, District I
Maintenance plans to construct a left turn lane at the above
location to improve safety for the traveling public.
(1) Sta. 16+85 there is an existing 48" X 48" concrete
box culvert which we plan to extend on the inlet by
addition of a 54" RC Pipe with endwall. The
attachment will be accomplished by using a concrete
collar.
(2) From Sta. 14+25 to Sta. 16+85 the three foot stream
will be rechanneled to accommodate the widening
necessary for the turn lane.
These locations involve unnamed streams which are tributaries
to Little River.
We are requesting a 404 Nationwide Permit (#3 Maintenance)
from your agency.
I am sending a sketch with the proposed erosion control plan
along with a marked county map.
By copy of this letter I am asking Ms. Stephanie Goudreau,
North Carolina--Wildlife Resources Commission Mtn. Reaion
Coordinator to comment directly to you concerning the 404

Nationwide Permit Request.
This work does not involve designated Trout Water.
Also by copy of this letter, I am requesting authorization
to proceed under Section 401 of the Clean Water Act from the
Division of Environmental Management.
If further information is required, please let me know.
Your early review and consideration will be greatly
appreciated.
