Dear Mr. Bennett:
You have our approval to place fill material in 0.063 acres of wetlands or waters for the purpose
of replacing existing pipe at SR 1332, as you described in your application dated 24 January 1996 .
After reviewing your application, we have decided that this fill is covered by General Water Quality
Certification Number 3026. This certification allows you to use Nationwide Permit Number 3 when it
is issued by the Corps of Engineers.
This approval is only valid for the purpose and design that you described in your application. If
you change your project,`you must notify us and you may be required to send us a new application.
For this approval to be Nalid, you must follow the conditions listed in the attached certification. In
addition, you should get any other federal, state or local permits before yori go ahead with your
project.
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory
hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing,
send a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the
Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and
its conditions are final and binding unless you ask for a hearing.
This letter completes the review of the Division of Environmental Management under Section
401 of the Clean Water Act. If you have any questions, please telephone John Dorney at 919-733-

The Department of Transportation is scheduled to grade, drain
base, and pave primarily along the existing roadway of SR 1332
(Jack Jones Rd)., in Ashe County during the 1995-1996 fiscal year.
Due to the proximity of a small stream (Roaring Branch Class-c-
trout we are requesting a 404 Nationwide permit no. 3 to allow us
to upgrade the 8 existing cross line drainage structures that will
need replacing, and or extending.
Attached is a straight line sketch with proposed erosion control,
stream, stream embankment, pipe crossing, and marked county map.
By copy of this letter I am asking Ms. Stephanie Goudreau Mt.
Region Coordinator with the North Carolina Wildlife Resources
Commission to comment directly to you concerning the 404
Nationwide Permit request.
A request will be made on this project for a Temporary
Encroachment in the Trout Water Buffer Zone of Roaring Branch
and I am asking Ms. Goudreau to comment directly to me concerning
the Trout water buffer zone encroachment.
Also by copy of this letter, I am requesting authorization to
proceed under Section 401 of the Clean Water Act from the Division
of Environmental Management.
We would like to begin construction as soon as possible. If
further information is required, please let me know. Your early
review and consideration will be greatly appreciated.

manner; according to any special permit requirements

Environmental Unit for stage and permanent seeding.
(5) Any removal of siltation devices will be baser] on the
condition of established ground cover of that area the

CONCTRUCTLON SEOUENCE FOR INSTALLING ROADWAY CULVERTS
1. Clear only enough area and install the downstream measures
siirh as silt check dams, silt screens, and silt besins as
noted on plan.
2. Excavate the 2' base ca 11 ditch.
3. Excnvatp and install the roadway culvert.
4. Install sediment control measures at inlet as noted on
plan.
5. Install ndditlonal pipe outlet protection and inlet
protection as noted.
