Dept. of Transportation P.O. Box 250 North Wilkesboro, NC 28659 Dear Mr. Bennett: You have our approval to place fill material in 0.1 acres of wetlands or waters for the purpose of replacing existing pipes at SR 1324, as you described in your application dated 22 February 1996. After reviewing your application, we have decided that this fill is covered by General Water Quality Certification Number 3026. This certification allows you to use -Nationwide Permit Number 3 when it is issued by the Corps of Engineers. This approval is only valid for the purpose and design that you described in your application. If you change your project, you must notify us and you may be required to send us a new application. For this approval to be valid, you must follow the conditions listed in the attached certification. In addition, you should get any other federal, state or local permits before you go ahead with your project. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. Dear Mr. Thomas, The Department of Transportation is scheduled to grade, drain base, and pave primarily along the existing roadway of SR 1324 (Coy Ham. Due to the proximity of a small stream being a trib to Middle fork Creek Class-c-trout we are requesting a 404 Nationwide permit no. 3 to allow us to upgrade the 12 existing cross line drainage structures that will need replacing, and or extending. Attached is a straight line sketch with proposed erosion control, stream, stream embankment, pipe crossing, and marked county map. By copy of this letter I am asking Ms. Stephanie Goudreau Mt. Region Coordinator with the North Carolina Wildlife Resources Commission to comment directly to you concerning the 404 Nationwide Permit request. A request will be made on this project for a Temporary Encroachmentin the Trout Water Buffer Zone of Halls Ck. and I am asking Ms. Goudreau to comment directly to me concerning the Trout water buffer zone encroachment. 9 N Also by copy of this letter, I am requesting authorization to proceed under Section 401 of the Clean Water Act from the Division of Environmental Management.
