Dear Mr. Hennessy, At the January 19, 2006 Agency Meeting the merger team was updated on the status of the project commitments addressed at the July 2005 Merger Meeting. The issues addressed at the meeting included the two Carolina Bays, the animal crossing easement connecting the two Bays, the 10-ft wide easement on each side of the road, wetland impacts and design issues. Enclosed for your review are the meeting minutes, a Status of Project Commitments Paper and a Wetlands Impact Paper, with their associated exhibits. Please provide written comments on the enclosed package of information by March 6, 2006. A Merger Meeting has tentatively been scheduled for March 16, 2006. Based upon the responses received on the attached package, a new Concurrence Form will be presented with the modified project commitments. Specific issues involving the environmental commitments are expected to be addressed by the Merger project team in a formal Concurrence Point 4C meeting in either March or April of 2006. EPA believes that NCDOT should be able to address the specific questions or issues in writing prior to or at the Concurrence Point 4C meeting. EPA believes that the critical commitments related to Alternative B are being addressed by NCDOT and that the Merger Process may not require that the project be taken back to earlier concurrence points to reevaluate the Least Environmentally Damaging Practicable Alternative (LEDPA) decision. The preservation of the two Carolina Bays, a third bay and other upland and wetland areas (approximately 860 acres) represent significant measures to address future impacts to important coastal resources EPA staff has remained actively involved with this project and the North Carolina Department of Transportation's (NCDOT) efforts to resolve the major environmental commitments addressed in the September 13, 2005, written brief. In addition to Mr. Militscher, the EPA Merger team's representative, Mr. Ted Bisterfeld of the NEPA Program Office and Mrs. Kathy Matthews of the Wetlands Regulatory Section also joined the project team for the February 7-8, 2006, field visit. Both Mr. Bisterfeld and Mrs. Matthews had prior involvement with this proposed project. By copy of this letter, EPA is also providing a written follow-up comments to the Merger O1 Process Review Board members concerning the Elevation for Conflict Resolution written brief dated September 13, 2005. This letter with attachments represents EPA's formal comments on the Record of Decision (ROD) project environmental commitments for the above referenced project. In addition to this signed concurrence letter, EPA also requests that the N.C. Division of Water Quality and U.S. Army Corps of Engineers do not issue their respective permits until after the copies of the signed property agreements between NCDOT and St. James and Williamson's are provided to the Merger team agencies. Once the draft MOU on access control has been finalized and agreed to by the Merger team, EPA requests that a copy for signature be sent to Mr. Heinz Mueller in order to obtain the Deputy Regional Administrator's approval.. Based on a careful review of the February 6 Commitment Update Package, EPA's specific recommendations and comments for each of the environmental commitments are addressed in the attachment to this letter. The Reserve at St. James Plantation, Phase II The eastern bay (One of the two original Carolina Bays) offers approximately 133 acres of wetlands and 44 acres of uplands. In addition, St. James is also offering a new bay located to the north of the primary Carolina Bay. The new bay contains approximately 210 acres of wetlands and 13 acres of uplands. A 300-foot wildlife corridor is proposed to connect these two bays (Approximately 2,000 feet long). The wildlife comdor contains both wetlands and uplands between these two bays. In total, approximately 400 acres of both wetlands (+343 acres) and uplands (+57 acres) would be placed in a conservation easement. NCDOT has noted that St. James currently has easements held by the North American Land Trust on other portions of their property that protects open space around cluster development. St. James property has received the jurisdictional determination for wetlands with approximately 0.1 acres of wetland impacts for the Phase II development. Overall, the proposal as presented by NCDOT is accepted to EPA with the following comments/issues: - Exhibit 3: It is indicated that all boundaries and delineations are approximate. Nonetheless, there is no legend identifying even key features. There is a proposed interior road called "Parson's Place" along the northern rim to the main Carolina Bay and what was referred to as the 200-foot bay buffer. There are no lots shown along the drive but it dead ends at a cul-de-sac. There are no lots shown in this area as well. Why is this road extended for approximately 900-1,000 feet if there are no platted lots in this area between the Carolina Bay and the proposed wildlife corridor? The same general question applies to "Spoonbill Loop". 2 Does Exhibit 3 from the January 19, 2006, Merger meeting accurately reflect the proposed development plans for the Reserve at St. James, Phase II development? 3 It would be helpful for the Merger team to see what other areas/properties are held by the North American Land Trust in the Reserve at St. James Phase II. 4 The St. James developer has verbally agreed to protect wetlands within the Carolina Bay after the lots are sold. Can NCDOT get this agreement in writing during negotiations on the lands to be donated as part of the conservation easement. 5 Platted lots are shown in areas that appear to be wetlands. Has the ACE's jurisdictional determination of wetland impacts of 0.1 acres been confirmed with this development plan? 6 A portion of a golf greenway appears to be located within the eastern tip of the Carolina Bay. Is this correct and can the development plan be altered to avoid this impact? 7 St. James has agreed to preserve the identified property "after the lots are sold" (per the Merger team meeting minutes). Can the St. James plan for preservation be put into place by NCDOT prior to the [all of the] lots being sold? B. The Williamson Tract There are two development plans (conceptual Master Plans A and C) for the Williamson Tract that includes all of the `western' Carolina Bay and a portion of the eastern Carolina Bay between the proposed new roadway and the property owned by St. James Plantation. The developer has 0 impacts to U.S. Army Corps of Engineers (ACE) approved jurisdictional wetlands from Master Plan C. NCDOT has made preliminary negotiations with the landowner to alter their master plan to remove development out of wetlands. A proposed clubhouse would be placed inside of the western Carolina Bay in an uplands area. The landowner would also provide a wildlife corridor between the western and eastern bays. The landowner has also agreed to grant an easement to NCDOT for three areas outside the Carolina Bay designated on master plan as Park & Recreation. Under Master Plan C, 188 acres of the western Carolina Bay would be put into an easement. There are also 36 acres of the eastern Carolina Bay that would be included in the proposal. In total, the proposed easement is approximately 460 acres, of which approximately 225 acres is upland and 235 acres of wetlands. The property owner has requested a new access point to the new roadway just north of the proposed wildlife corridor between the two bays. Verbally, EPA agreed with the change in access point (Right-in, right-out, only) provided NCDOT can secure the conservation easement proposal with the landowner. Overall, the proposal as presented by NCDOT is acceptable to EPA with the following comments/issues: 8 Master Plan contains other Park and Recreation areas in addition to PR3, PR15 and PR 11, which are believed to be the three additional areas to be included in the NCDOT easement. PR 13, PR 14, PR 12, PR 10, PR 8, PR 16, PR 5, PR 4, and PRl are also included in Master Plan C as parks, trails and open space. Most of these areas are uplands located adjacent to wetlands. EPA would request that some of the other larger PR areas also be considered for inclusion in the conservation easement, if possible (Specifically, PR 13, PR 14, PR 10 and PR 1Z. These upland areas adjacent to connecting wetlands would provide important wildlife connectivity and habitat in and around the Carolina Bays and PR 6 and PR 9. Nature trails would be permissible in PRs 13, 14, 10 & 1. 9 For R 33, "Legacy lots", the preliminary lots appear to be located at least partially in wetlands. Has the jurisdictional determination of 0-acre impact from the ACE been confirmed with this Master Plan? C. General Conditions for the Conservation Easements EPA supports the U.S. Fish and Wildlife Service and N.C. Wildlife Resource Commission's recommendations to NCDOT for managing the conservation easements for both Federally-listed and State-listed threatened and endangered species. EPA also supports NCDOT's proposal to perform an `inventory' of various plant and animal species as part of the conservation easement property description for each parcel to be put under third party management and ownership. 2. Acquisition of 200-foot Buffers NCDOT has identified potential legal difficulties in acquiring the 200-foot buffers around the Carolina Bays through condemnation. The North Carolina Department of Justice has issued a legal opinion on this matter dated November 8, 2005. Both landowners have identified the 200-foot buffer areas around the Carolina Bays as being critical to their respective cluster development plans. In order to avoid wetland impacts and costs, the upland buffers around the bays would appear to be very financial attractive from a development standpoint. Based upon information from NCDOT, EPA understands that a single unimproved lot can be as much as $400,000 for approximately 0.2 of an acre. From a cost standpoint, EPA understands the potential prohibitive constraint on NCDOT possibly acquiring the entire 200-foot buffers around both Carolina Bays. For the Williamson Tract, PR 6, PR 9 and PR 15 will help to provide some upland buffer to the western Carolina Bay. In addition, PR 7 with the proposed `environmentally friendly' clubhouse plans will also help reduce certain long-term commercial and residential impacts to the bay. EPA does not have any outstanding `buffer' issues for the western Carolina Bay provided other issues and questions can be addressed. For the Reserve at St. James Phase II, there are numerous unanswered questions regarding their development plans and the location of platted lots in relation to the remaining buffer and the Carolina Bay. EPA is very concerned for the proposed development roadway (which splits into two cul-de-sacs) extending into the upland portion of the eastern Carolina Bay and the potential lack of buffer. Platted lots here appear to extend into the wetlands with little to no buffer between the lots and the wetlands. EPA understands that Exhibit 3 is approximated but has substantial environmental concerns with the proposed development adjacent to or into the Carolina Bay. 3. Wildlife Corridors between the Carolina Bays NCDOT propose two main wildlife corridors, including the one between the bays on the St. James property and the one between the two primary Carolina Bays. EPA defers to the U.S. Fish and Wildlife Service and the N.C. Wildlife Resources Commission on the general adequacy of the proposed wildlife corridors. As a general opinion, EPA believes that at a minimum, the additional acreage comprising the wildlife corridors will provide additional protected habitat for a number of important native plant and animal species. The proposed wildlife corridor on the St. James property between the two bays will also indirectly help to control future access for development. As a secondary beneficial effect to the human environment, traffic noise into the St. James development will be reduced east of the proposed wildlife corridor. 4. Control of Access/10-foot Conservation Easement There have been two main issues identified by NCDOT concerning control of access and the previously proposed 10-foot conservation easement. NCDOT maintains that it `can not' legally obtain the 10-foot conservation easement by condemnation. This issue may be a moot point as the Williamson's are requesting an additional access point to be located at the eastern edge of the western Carolina Bay to the new roadway. This request is has been highlighted by NCDOT as a vital negotiation point between the property owner and NCDOT. EPA does not disagree with this newly proposed `right-in/ri~ht-out' access point. However, EPA believes that the access point at the western may not be needed by the Williamsons and that this one may deleted during final negotiations between NCDOT and the property owner. The ACE representatives at the field meeting also indicated that the eastem half of the access point at the northernmost location (i.e., Nearest the bridge location) may not be needed for the Yellow Banks area either. EPA would prefer to see this entire access point completely eliminated. There are high quality wetlands that maybe impacted from the construction of this access point. Furthermore, this access point is very close to where the bridge will touch down on the mainland side and is problematic from both a construction standpoint and from one of safety. During a hurricane evacuation event, this future access point could seriously impede local island traffic from exiting the island. EPA and other agencies have expressed concerns that the best form of access control would be from the purchase of the 10-foot conservation easement along the new roadway adjacent to the right-of--way. NCDOT has maintained that condemnation is legally prohibitive. EPA does agree that the condemnation process would impair negotiations with the landowners and make any settlement for other conservation areas problematic. NCDOT proposes to handle future control of access through a Memorandum of Understanding (MOU). A draft MOU is included in the commitments package as Exhibit 6. EPA's specific comments on the draft MOU are outlined below: -Page 2 Item 2.0; Proiect Control of Access Limits and Special Designation The access point at Station 79+50 may not be needed and the MOU should be revised to reflect the removal of this access point. The access point should be modified to allow for median u-turns in both directions. The right-in/right-out only access point at approximately Station 150+00 and 160+ 00 for the Williamson property needs to be individually included in this section. The right-in/right-out only point at Station 191+45 for St. James property needs to be individually listed in the MOU. - Page 3, Item 3.2; NCDENR, USAGE and FHWA Consideration The second paragraph needs to be modified to allow any of the agencies to disapprove of an access break if the requested break in control of access alters the safety, mobility and operational integrity of the project. This paragraph should also be modified to explain the basic purpose and need for the project, which includes existing and projected traffic volumes, safety and inadequate highway capacity for hurricane evacuations. The Merger process required that NCDENR, USAGE and FHWA and other agencies concur on the basic purpose and need for the project and that additional access points could jeopardize these documented needs. -Page 1 and Page 4; EPA requests that it become an additional party to the MOU. Please add EPA's title on the first page, Section 3.2 and on the last page. The signature block should read: A. Stanley Meiburg, Deputy Regional Administrator, USEPA Region 4. There was significant discussion in the field between agency representatives on whether or not it would be prudent to include a Section 404 permit condition on the control of access (in addition to the MOU). EPA defers to ACE's legal and management officials regarding the appropriateness of such a permit condition. However, EPA generally believes that this could provide an additional measure of protection provided that the control of access issue involved a break at a location where there were jurisdictional wetlands. EPA has noted that there are extensive upland areas along the future right-of- way where a control of access break could be sought and the enforceability of a Section 404 permit condition would potentially be problematic unless there was an MOU in place as an added protection. Between the special designation, "Special Control of Access" on the NCDOT plans, the multi-agency MOU and an appropriate Section 404 permit condition, EPA believes that its concerns for future indirect and cumulative impacts to human and natural resources can be minimized without the 10-foot conservation easement. 5. Direct Wetland Impacts and Avoidance and Minimization Measures NCDOT has provided EPA and other agencies with a detailed breakdown on direct wetland impacts (Exhibit 7), a 2-page description and an explanation on how the impacts potentially changed (i.e., 16.1 acres to 22.9 acres) from the Final Environmental Impact Statement (FEIS) and Record of Decision (ROD) to the final design stage. A separate column is also provided on the impacts from the current design after additional minimization. EPA has noted that direct impacts have been reduced from 22.9 acres to 21.7 acres since the last Concurrence Point 4C meeting. Most of the difference between the FEIS/ROD impact numbers and the Concurrence Point 4C impact numbers is due to grade changes that were not appropriately anticipated during earlier phases of planning and engineering. The actual grade of the road has increased several feet (from approximately 2' to 3' to 6') to allow the inclusion of 42" to 48" equalizer pipes between wetland systems and for `flooding'. Either special cut ditches or a raised roadbed surface is needed in this area of the Coastal Plain otherwise the roadway would be subject to frequent flooding. Special cut ditches would potentially drain adjacent wetland areas. Thus, additional fill is required to raise the roadway surface. EPA and other agencies now have a detailed site-by-site table to evaluate where the increase in impacts came from following prior avoidance and minimization meetings. EPA and other agencies have now acknowledged this design condition in the Coastal Plain and will in the future request more specific information on projected future wetland impacts for other projects. As a reminder to NCDOT, Federal Highway Administration (FHWA) and other team members, the ROD will need to incorporate the permanent and temporary surface water (i.e., 0.068 and 0.027 acres, respectively) and stream (i.e., 2871inear feet and 1041inear feet, respectively) impacts per EPA's September 13, 2005, Conflict Resolution brief. Mumford, NCDOT, Roadway Design Unit Max Price, NCDOT, Hydraulics Unit R-2245 Second Bridge to Oak Island Update on the Commitment to Acquire Two Carolina Bays The Reserve at St. James, Phase II The proposed easement allocation within the Phase II development includes two Carolina Bays, joined by a 300-foot wide Wildlife Corridor. Within these bays lie several small upland patches, totaling approximately 57 acres. The result is approximately 400 acres of upland and wetland habitat area that maybe placed in conservation easement. Williamson Tract Conceptual Plan A for the Williamson Tract illustrates development without a conservation easement. The proposed easement allocation is illustrated on Conceptual Plan C for the Williamson Tract, surrounding the Carolina Bay. A Club House and Amenity Center (PR7) are planned within the Carolina Bay that would be outside the proposed easement., In addition, three park areas surrounding the bay (PR15, PR11, and PR3) may be included within the proposed easement. A 300-foot wide Wildlife Corridor is proposed leading east from the bay to the proposed roadway alignment. The Williamson property also includes a small section of Carolina Bay east of the proposed roadway alignment. The total area of proposed easement is approximately 460 acres, of which approximately 225 acres is upland. Estimation of upland and wetland areas are based on GIS data from the NC Division of Coastal Management and NCDOT Aerial photographs. DRAFT MEMORANDUM OF UNDERSTANDING Among the NORTH CAROLINA DEPARTMENT OF ENVIlZONMENT AND NATURAL RESOURCES and THE NORTH CAROLINA DEPARTMENT OF TRANSPORTATION and THE UNITED STATES ARMY CORPS OF ENGINEERS, WII.MINGTON DISTRICT and THE FEDERAL HIGHWAY ADMINISTRATION This Memorandum of Understanding ("MOU") is made on the last day entered below among the North Carolina Department of Environment and Natural Resources ("NCDENR"), the North Carolina Department of Transportation ("NCDOT"), the Federal Highway Administration ("FHWA"), and the United States Army Corps of Engineers,, Wilmington District ("USAGE"), (collectively referred to hereinafter as "the Parties"). GENERAL RECITALS WHEREAS, the FHWA and NCDOT approved the selected alternative for TIP project R-2245 (hereinafter, "the Project") as part of the Record of Decision executed by FHWA and NCDOT on October 20, 2004 and November 10, 2004, respectively; WHEREAS, the approved alternative for the Project is described as widening SR 1105 (Middleton Avenue) between the Atlantic Ocean and the Atlantic Intracoastal Waterway ("AIWW"), constructing a new bridge over Davis Canal and a new high-rise bridge over the A1WW to the mainland, and constructing a roadway on new location from the new high-rise bridge to NC 211 at SR 1500 (Midway Road); WHEREAS, pursuant to the Merger O1 Process, certain federal and state resource and regulatory agencies participate with NCDOT in the early planning process for select NCDOT projects; WHEREAS, pursuant to N.C.G.S. §§ 136-18(5) and 136-93, NCDOT and the Board of Transportation is authorized to issue rules governing the permitting of street and driveway access to State highways; 1 DRAFT WHEREAS, pursuant to the Merger O1 process and interagency discussion among the Parties, NCDENR and USACE have determined that maintaining control of access along portions of the right-of-way of the Project is necessary to minimize indirect impacts to wetlands and water quality within the study area, which they believe may result from the Project; and WHEREAS, NCDOT and the FHWA agree that the control of access limits are important to maintaining the safety, mobility, and operational integrity of the project. NOW THEREFORE, the Parties agree as follows: 1.0 NCDOT Authority and Procedure. The Parties agree that NCDOT is given the statutory authority to review street and driveway access requests pursuant to N.C.G.S. §§ 136-18(5) and 136-93, and has an established procedure for determining whether to grant street and driveway access to state highways. 2.0 Project Control of Access Limits and Special Designation. The "Control of Access Limits" subject to this MOU are defined as follows: Control of access limits subject to the MOA shat] begin at the northern terminus of the Atlantic Intracoastal Waterway Bridge (approximate station -L- 62+88) and continue to the intersection of the NC 211 southern right of way boundary (approximate station -L- 247+9_Sj. Three designated access breaks will be allowed for future access roads at -L- Station 79+50.00 on the left and right and at -L-Station 1.91+45 on the right only. These future access roads will also have control of access that is subject to the MOA along the first 1500' of their lengths, measured from their respective intersections with the mainline right of way. NCDOT agrees to provide special designation of the subject Control of Access limits on the NCDOT plans as "Special Control of Access" with a unique symbol and a legend referencing this agreement between the Parties. (See Exhibit A, Sample Special Control of Access Designation") 3.0 Review of Requests to Break Control of Access. As part of the right-of- way acquired by NCDOT for the Project, NCDOT has also acquired the right to control the access to such right-of--way along portions of the project. Accordingly, it is the intent and desire of NCDOT to maintain the integrity of the roadway facility by retaining the control of access limits as shown on the Project. 3.1 Initial Review and Consideration by NCDOT - If a future request is made to break the existing control of access limits along the Project, NCDOT agrees to follow the operating procedures of the NCDOT Right of Way Disposal and Control of Access Committee. 2 DRAFT 3.2 NCDENR, USACE and FHWA Consideration - If the NCDOT Right of Way Disposal and Control of Access Committee determines that the control of access break is warranted and justified, then the Chairperson of the NCDOT Right of Way Disposal and Control of Access Committee will initiate a meeting among the NCDOT State Highway Administrator, the Chief of the Regulatory Division of the USACE Wilmington District, the Chief Deputy Secretary for NCDENR, and the Division Administrator of the FHWA. The Parties will consult and discuss the control of access break request. If the Parties determine that the control of access break request cannot be approved by all Parties, then the Parties will generate a list of reasons that the control of access limits need to be maintained. Any objection by NCDENR or USACE shall be based upon their respective agency's regulatory expertise and consistent with the water quality impact avoidance and minimization purposes discussed in the Final Environmental Impact Statement and ROD for the Project. NCDOT will then notify the requesting party of the denial of the request for a break in the access. It is also recognized that in order for a break in the control of access to be approved that all Parties must agree and each party must document approval in written form. 4.0 Notices. All notices required under this MOU shall be in writing and sent via U.S. Mail, postage prepared, by national courier service or hand delivered to the addresses set out below. Notice shall be deemed delivered and given when mailed, if mailed, or when delivered by hand or by courier, upon receipt. Notice to NCDOT Notices to USACE Notices to NCDENR [ TO BE COMPLETED BY NCDOT ] 5.0 Amendments. Amendments to this MOU may be made with mutual agreement in writing by the signature agencies. 6.0 Termination.
