The Town of Benson is in receipt of the 401 Water Quality Certification dated December 9, 2009. In
that certification, there is a provision of 60 days given for us to provide payment to Restoration Systems,
LLC for mitigation of our Neuse Riparian Buffer Zone Impact. At the current time all funding for the
project is not in place; therefore, we request that the 60 day timeframe be extended to something more
amenable to the funding situation. An initial timeframe of one (1) year is requested. Also please note
that we have contacted Restoration Systems, LLC, who assures us that there is no danger of the Lane
Island Bank Parcel losing the ability to support mitigation of our impact within the next year.
