DANIEL SMITH Director February 21, 2020 Locklin Farms, LLC Locklin Farm PO Box 665 Wallace, NC 28466 Subject: Notice of Violation Locklin Farms LLC AWS710014 Pender County NOV-2020-PC-0135 Dear Mr. Cavenaugh: On February 21, 2020 staff of the NC Division of Water Resources (DWR), Water Quality Regional Operations Section (WQROS), noted during a compliance inspection, a failure to secure a Waste Analysis for multiple irrigation events as well as a failure to designate an Operator in Charge (OIC). As a result of this incident, you are hereby notified that, having been permitted to have a non - discharge permit for the subject animal waste disposal system pursuant to 15A NCAC 2T Section .1300, a violation has been noted for a failure to secure Waste Analysis and a OIC designation form in accordance with your Certified Animal Waste Management Plan and the Swine Waste System General Permit No. AWG100000 that you are covered to operate under. North Carolina Department of Environmental Quality IDivision of Water Resources - Wilmington Regional Office 127 Cardinal Drive, Wilmington, North Carolina 28405 (910)796-7215 DocuSign Envelope ID: 6E26DF4A-2C97-43D2-882A-6lD40193EDE7 Violation 1: Failure to secure a Waste Analysis in accordance with the facility's Certified Animal Waste Management Plan in accordance with Condition III.5 of the Swine Waste System General Permit No. AWG100000. Failure to secure a Waste Analysis occurred multiple time throughout 2019 and has been documented in past inspections. Required Corrective Action for Violation 1: Every reasonable effort shall be made to have the waste analyzed prior to the date of application and as close to the time of waste application as possible or within sixty days before or after the date of application. Violation 2: Failure to designate a certified animal waste management system operator with a valid certification in accordance with the facility's Certified Animal Waste Management Plan in accordance with Condition II.16 of the Swine Waste System General Permit No. AWG100000. Required Corrective Action for Violation 2: Use the proper documents to designate an Operator in Charge to operate the animal waste management system. You are required to take any necessary action to address the above violation. You are required to provide a written response to this Notice, including any additional information that you wish to provide related to this incident that you wish for the Division to consider, within 30 days of receipt of this letter. Please include in your response all corrective actions already taken and a schedule for completion of any corrective actions not addressed.
