Hi Tyson,
I wanted to follow up to be sure we were all on the same page. The Division considers this application "on hold" until
we receive a response to Amanda's request for information dated 6/24 and an updated plan/application that indicates
how stormwater management will be addressed to meet the requirements stated below. You do not need to have an
approved stormwater management plan, but rather an application that indicates stormwater has been addressed so
that we can document both that water quality will be protected and, that future impacts aren't likely as a result of the
stormwater management plan.

I have checked with our Stormwater Unit in the Division of Energy, Mineral and Land Resources and here's a response
they provided to another project recently, which would also apply to this project which drains to Winkler Creek, C, Tr+ in
the New River Basin. I'm copying the supervisor Annette Lucas so she knows I forwarded this information to you. If you,
or the engineer have any questions please feel free to reach out to her.
From the Division of Water Resource's classifications requirements, the'Y' is assigned ORW status in the New River
Basin:
New River Basin
+ This symbol identifies waters that are subject to a special mana(
specified in 15A NCAC B .0225 the Outstanding Resource Waters (ORW)
protect downstream waters designated as OR.
Then, 15A NCAC 02B .0225(c) states:
c) Quality Standards for ORW.
(1) Freshwater: Water quality conditions shall be maint-dined

15A NCAC 02H. I{11 and .1021.
We have interpreted this rule as a requirement for development projects within the New River basin with the C+
designation to adhere to the ORW Stormwater requirements in 15A NCAC 02H .1021. This rule sets a high density
threshold of greater than or equal to 12 percent built -upon area, and the 15A NCAC 02H .1000 rules section overall
requires treatment of the 1" storm with one or more Primary SCMs.

I have talked to the engineer and ASU and they have explained the rationale for the location of the building and
proposed impacts. We are waiting for the formal request for additional information so we can properly address all
questions.
The applicant is wanting to know what the required mitigation ratio will be for the proposed stream impacts? This will
help them determine what the potential mitigation fee would be.
Lastly, is there any length of stream impact that can be permitted without triggering mitigation? You mentioned a
former permit for 48' of stream impact elsewhere on ASU property and the existing culverts onsite will count towards
the 150 LF threshold.

Any updates on the decision for stormwater treatment requirements?
