Box 250 North Wilkesboro, N.C. 28679 Dear Mr. Bennett: You have our approval to place fill material in 0.10 acres of wetlands or waters for the purpose of replacing existing pipe along SR 1945 (Christian Home Church Road, as you described in your application dated 5 May 1995. After reviewing your application, we have decided that this fill is covered by General Water Quality Certification Number 2745. This certification allows you to use Nationwide Permit Number 3 when it is issued by the Corps of Engineers. This approval is only valid for the purpose and design that you described in your application. If you change your project, you must notify us and you may be required to send us a new application. For this approval to be valid, you must follow the conditions listed in the attached certification. In addition, you should get any other federal, state or local permits before you go ahead with your project. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 30 days of the date that you receive this letter. To ask for a hearing, send a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and its conditions are final and binding unless you ask for a hearing. Due to the proximity of small streams being trib. to East Prong of Roaring River class-c we are requesting a 404 Nationwide permit no. 3 to allow us to up grade the 2 existing cross line drainage structures that will need replacing, and or extending. Attached is a straight line sketch with proposed erosion control, stream, stream embankment, pipe crossing, marked county map, and 8x11 drawing, showing pipe replacement. By copy of this letter 1 am asking Ms. Stephanie Goudreau of the North Carolina Wildlife Resources Commission Mt. Region Coordinator to comment directly to you concerning the 404 Nationwide Permit request. Also by copy of this letter, I am requesting authorization to proceed under section 401 of the Clean Water Act from the Division of Environmental Management. f I The purpose of this new alignment is to shift the roadway away from the stream to eliminate the frequent flooding caused by high water covering the low lying areas of existing roadway. This flooding has occurred frequently in the past 10 years and prohibits the safety of the traveling public and school buses. We would like to begin construction as soon as possible. Stone for plain rip rap shall cons istof field stone or rough Lill hewn quarry stone. The stone shall be sound, tough, dense, resistant to the action of air and water, and suitable in all other respects for the purpose intended. Wliere broken concrete from demolished structures or pavement is avail- able, it may be used in place of stone provided that such use meets with the approval of the Engineer. However, the use of broken concrete which contains reinforcing steel will not be permitted. The stone or broken concrete shall be graded to meet the following requirements: 1. For Class I Rip Rap. Stone shall vary in weight from 5 to 200 pounds. At least 30 percent of, the total weight of the rip rap shall be in individual pieces weighing a minimum of 60 pounds each. Not more than 10 percent of the total weight of the rip rap may be in individual pieces weighing less than 15 pounds each. 2. For Class 2 Rip Rap. Stone shall vary in weight from 25 to 250 pounds. At least 60 percent of the total weight of the rip rap shall be in individual pieces weighing a minimum of 100 pounds each. Not more than 5 percent of the total weight of the rip rap may be in individual pieces weighing less than 50 pounds each. 691 EROSION CONTROL The Contractor shall exercise every reasonable precaution throughout the life of the project to prevent erosion and siltation. Silt fence and erosion control measures shall be installed in accordance with the plans for this project, Section 893 of the Standard Specifications, and in locations directed by the Engineer or his representative. (1) All adequate temporary erosion control measures will be installed before cleating and grubbing operations begin. (2) As construction progresses temporary and permanent erosion control devices shall be installed in a timely manner, according to any special permit requirements and/or requirements set out in G.S. 113A-57. MANDATORY STANDARDS FOR LAND-DISTURBING ACTIVITY Pursuant to G. S. 113A-57(3), Provisions for a ground cover sufficient to restrain erosion must be accomplished within 30 days or 120 calendar days following completion of construction or development, whichever period is shorter, except as provided in 15A NCAC 4B .0024(e). DESIGN STANDARDS IN SENSITIVE WATERSHEDS Pursuant to G.S. 113A-57(3) provisions for a ground cover sufficient to restrain erosion must be provided for any portion of a land-disturbing activity in a HQW zone within 15 working days or 60 calendar days following completion of construction or development, whichever period is shorter. (3) All siltation and erosion control deices shall be properly maintained until no longer needed. (4) On projects performed by D.O.T. Maintenance Forces, request will promptly be made to the Division Roadside Environmental Unit for stage and permanent seeding. (5) Any removal of siltation devices will be based on the condition of established ground cover of that area the device is serving. CONSTRUCTION SEQUENCE FOR INSTALLING ROADWAY CULVERTS I. Clear only enough area and install the downstream erosion control devices as noted on erosion control plan. 2. Excavate the 2' base tail ditch. 3. Excavate and install the roadway culvert. 4.
