After reviewing your application, we have decided that this fill is covered by General Water Quality Certificadon Number 2735. This certification allows you to use General Permit Number 031 when it is issued by the Corps of Engineers. This approval is only valid for the purpose and design that you described in your application. If you change your project, you must notify us and you may be required to send us a new application. For this approval to be valid, you must follow the conditions listed in the attached certification. In addition, you should get any other federal, state or local permits before you go ahead with your project. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 30 days of the, date that you receive this letter. To ask for a hearing, send a written petition which conforms to Chapter 15013 of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and its conditions are final and binding unless you ask for a hearing. C. 28801 Subject: SR 1943B - Middle Street 1994-1995 Residential Paving Priority Dear Mr. Lund: I am attaching a straight line diagram with erosion control plan, an application form for a nationwide permit, and a county map section relative to the paving of SR 1943B Middle Street in Rutherford County. Middle Street is presently 12 to 14 feet wide. We plan to pave the road 17 feet wide and increase the typical section. The proposed typical section is also attached. Grading will be light to moderate. This project begins at SR 1935 and continues to SR 1942, a distance of 0.72 miles. We propose to replace/extend one pipe which carries a live stream at survey station 28 + 10. With a copy of this letter, I am requesting Stephanie Goudreau, North Carolina Wildlife Resources Commission Mountain Region Coordinator, to comment directly to you concerning the nationwide permit request.
