Box 5189 Horse Shoe, N.C. 28742 Dear Mr. Swain: 1- f ij n1 You have our approval to place fill material in 0.17 acres of wetlands or waters for the purpose of road maintenance at SR 1143, Frozen Creek Road, as you described in your application dated 10 January 1994. After reviewing your application, we have decided that this fill is covered by General Water Quality Certification Number 2735. This certification allows you to use General Permit Number 031 when it is issued by the Corps of Engineers. This approval is only valid for the purpose and design that you described in your application. If you change your project, you must notify us and you may be required to send us a new application. For this approval to be valid, you must follow the conditions listed in the attached certification. In addition, you should get any other federal, state or local permits before you go ahead with your project. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 30 days of the date that you receive this letter. To ask for a hearing, send a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and its conditions are final and binding unless you ask for a hearing. SR 1143 is a gravel road that we propose to clear, grub, grade, pave, and replace/extend pipes for a distance of 3.2 miles. Grading will be moderate. We are requesting permission to replace and extend pipes in live streams noted on plans at survey stations 5+00 18+00 19+70 22+40 26+40 44+30 48+00 64+34 68+80 73+00 90+50 98+85 140+50 and 145+55. Pipes will be replaced using our standard method of pipe installation described in the erosion control plans. Please note that we do not propose to disturb fill slopes on the creek side in these locations as indicated by the Buffer Zone Area - Typical Section in the erosion control plans. We are requesting that Nfr. Phillips approve our request for said variance when he recieves the required comments from Mr. E.L. Ingle, Area Roadside Environmental Engineer, and Mr. David Yow, N.C. Mr. David Baker PaL,e 2 January 10, 1995 Due to a steep (approximately 0.25:1) rock embankment left of station 43+00 - station 51+00 we are requesting permission to relocate the channel of Frozen Creek alongside stations 47+75 - 50+75. A straight line type plan diagram, cross - sections, plan of work, and temporary stream crossing diagram are attached. The proposed channel is a nine (9) foot base trapezoidal channel, with 1.5:1 side slopes lined with N.C.DOT Class I Rip Rap to a vertical depth of three (3.0) feet to accomodate the 10 year flood. The existirng stream gradient of 19° o will remain the same in the proposed channel. By copy of this letter, we are asking Mr. David Yow, N.C. Wildlife Resources Commision, to comment directly to the Corps of Engineers concerning the Nationwide Permit request. Upon review for the Corps of Engineers we are requesting that Nlr. Yow forward a copy to us (NCDOT) as well. By copy of this letter, we are also asking Mr. Ed Ingle, Area Roadside Environmental Engineer (NCDOT), to comment directly to us on the above project. A a O s Channel Location Plan of Work Phase I - A temporary stream crossing at station 48+50 is to be constructed to allow stockpiling of rip rap for channel lining (see Stream Crossing Diagram). Phase II - Excavation of the 'proposed channel will begin at the downstream tie in - survey station 50+75. Material will be removed by pulling it away from the existing channel. Upon completion of the tie in, rip rap protection will be added. Excavation will then continue toward the upstream tie in at survey station 47+75 with rip rap being placed as the channel is excavated. Water will be diverted upon completion of excavation and rip rap placement. After water is diverted to the new channel, the old channel will be back-filled. I T -T , , --•---- I i 1 , 1 I H- 14 -T 7 Fj 4-, TEMPORARY SILT FENCE: A temporary silt fence is commonly used at the toe of a fill section to prevent off- site sedimentation. It is made of permeable filter fabric buried at the bottom, stretched and supported by steel posts. The silt fence reduces the water flow while retaining the sediment. They may also be used to divert water flow to protected . outlets. Silt fences need to be checked after each significant rainfall to ensure there effectiveness. They must be maintained on a regular basis. Silt fences shall not be installed across streams, ditches, or waterways. AREAS OF USE: • At toe of fill sections where sediment runoff can be stored and contained inside the project limits. DESIGN CRITERIA: Material With Wire Without Wire Fabric Type 3 Class A Type 3 Class B Steel posts length 5 ft 5 ft. Post spacing 10 ft. 6 ft. maximum 17 March, 1992 TEMPORARY SLOPE DRAIN WITH EARTH BERM: E- E--- A temporary slope drain is a flexible tubing or pipe used to carry concentrated runoff from the top to the bottom of a cut or fill slope without causing erosion along the slope. An earth berm is an earth barrier designed to channel runoff into a number of erosion.control devices. A berm is usually constructed with typical'on- site material. T -sections and elbows at the inlets are used to intercept the directional flow of the runoff, to protect the temporary slope drains from washouts. AREAS OF USE: • At construction areas where storm water runoff above a cut or fill slope will cause erosion if allowed to flow over a slope. DESIGN CRITERIA: • Peak runoff from 10 year storm. • T -section shall be used at inlet for multiple directional flow. • Elbows shall be used at inlet for single directional flow. The silt basin is built at the base of the ditch with its length being at least 2 times the width of the basin. The type-B silt basin is generally built in conjunction with temporary rock silt checks and other devices that control or slow down water flow. This device must be monitored closely and cleaned out on a regular basis until grass is established along the ditch line and sedimentation is no longer a problem. AREAS OF USE: • In conjunction with temporary rock-silt checks and other devices used in drainage ditches. It is an apron of stone of a sufficient thickness to protect the outlet area from scouring out and causing off-site sedimentation dam- age. Pipe outlet energy disipators should be built according to the guideline chart shown on page 52 of this manual. AREAS OF USE: Outlets of pipes and culverts to prevent from scouring. DESIGN CRITERIA: • In accordance with chart on page 52. • Filter fabric, or six inch layer of gravel, shall be used under stone. MATERIALS : • Filter Fabric shall meet requir6ments of section 1056 of Standard Specifications for Roads and Structures, January 1, 1990, for type H filter fabric. On projects where fill material must be placed in a Buffer Zone, it must be built with a rock toe embankment. Fill should then be placed behind the rock embankment such that no earth mater- ial is directly exposed to the buffer zone area. The rock must extend up the slope so that the entire slope is plated with the stone. Your work is authorized by this nationwide permit provided it is accomplished in strict accordance with the enclosed conditions, and those outlined in the attached April 19, 1995 WRC letter. This nationwide permit does not relieve you of the responsibility to obtain other required State or local approval. This verification will be valid until the nationwide permit is modified, reissued or revoked. All the nationwide permits are scheduled to be modified, reissued or revoked prior to 21 January 1997.
