Since the provision of a #57 stone/fabric parking area does not constitute a BMP, the permit modification application submitted in September 2015 is not applicable anc., the change should instead be considered as a plan modification. I will update the drawing to reflect the correct stone section, remove the underdrain system, and clearly annotate the requirement that the subgrade shall not be mechanically compacted. I've copied the permittee and would ask that he print and sign the attached application and return to my attention. It is my understanding that there is no fee associated with a plan modification. Please let me know if this is not the case or if you have any other concerns with the plan of action I've described here. Your letter implies that the drve !sle would be considered impervious aespite there being no such stipulation in the session law. I presume your reasoning for considering the drive isle to be impervious in spire of the session law is :he belief that vehicular traffic would break down the stone and/or compact the underlying soil. While this line of thought might hold true at a higher volume parking facility, the boat storage facility may see 5 vehicle trips per day during summer weekends and perhaps 5 trips on the other days of the week combined. This time of year, I doubt the access road sees 5 trips in a month. i aim meeting with the permittee next Monday to discuss this matter and will confirm that this is the preferred strategy. If y; a have any further insight into your interpretation of SL-2015-149 that you could relay to me, it would be most helpful as I revise the plans. Some of the comments specifically pertaining to the permeable pavement used for irfiltration/detention BMP may be rendered NA. I will address these as appropriate pending your response. Before we will transfer the permit to the HOA, these issues will need to be resolved: Comments regarding Phase I under SW8 050213: 1. , I noticed that there is a lapse of over 13 months (Feb. 23, 2006 through March 30, 2007) between the originally recorded deed restrictions which assigned 3800 sf to each Phase I lot and the amendment which restored the BUA limit for the Phase I lots to the permitted 2800 sf. My concern is how many lots in Phase I were sold under the 3800 restriction, and did those lot owners consent to having their BUA limit reduced? 2. Did the developer make sure that any of those lots described above which were sold under the 3800 sf limit, were actually in compliance with the 2800 sf limit at the time the amendment was filed? 3. Per Google Earth, the gravel in the boat storage area was already in place as of October 2008. At that time, gravel was considered a built -upon area. As such, you will. need to modify the permit to account for that additional BUA and propose a suitable high density BMP that will treat the runoff, or modify the permitted BMP to accept that additional drainage. 4. The plans provided for the boat storage area need to be more detailed to include dimensions, grading, gravel pavement section details (including stone depth, geomembrane liner, type of stone used) and the BMP details. Comments regarding Phase II under SW8 050842: 1. The Amenity Area site plan needs to show the proposed (now existing) grading and drainage to verify that the runoff is draining into the appropriate permitted BMP. Comments regarding SW8 070649: 1. The recorded deed restrictions consistently refer to an erroneous permit number of SW8 07064." The correct permit number is SW8 070649. Somehow, beginning with the Seventh Amendment which annexed Phase III and continuing with each subsequent amendment pulling in the various Sections within Phase III, the "9" has been consistently omitted from the end of the permit number. It is imperative that the correct permit number be referenced in these documents. The developer will need to record an amendment to correct this error. Is everything on track with the construction and remediation work that needs to be done? It's supposed to be starting soon, now that weather is warmer, right? Please let me know when the remediation work will begin. I've got other inspections in Onslow County, and can include NHR in my tour. In July 2015, a nexv law was passed which excludes #57 stone laid at least 4" thick over a geotextile fabric from the definition of a built -upon surface. I gave the developer the oration of redesigning the boat storage area using #57 stone. Neighborhoods of Holly Ridge Phase Onslow County Dear Mr. Cook: Donald R. van der Vaart Secretary Effective August 1, 2013, the State Stormwater program was transferred from the Division of Water Quality (DWQ) to the Division of Energy, Mineral and Land Resources (DEMLR). All previous references to DWQ will remain in older stormwater permits issued prior.to August 1, 2013 until they are modified. Please note that this letter references DEMLR as the Division responsible for issuance of the permit. Due to the 2 permit extension laws dated August 5, 2009, and August 2, 2010, the effective period of any stormwater permit that was set to expire between January 1, 2008 and December 31, 2011, was extended for a total of up to four (4) years. Accordingly, the SW8 050213 permit is now effective from the date of issuance until March 3 2019, which includes all available extensions. The. Division is unable to accept a renewal application for a permit that has more than 1 year left on its term. Since there are 3 years and 4 months left on the permit term for SW8 050213, the Division will not be able to process your request for renewal at this time. Please send in the renewal request 180 days prior to the extended expiration date, which would be around September 3, 2018. The Wilmington Regional Office received and accepted a modified State Stormwater Management Permit Application for Neighborhoods of Holly Ridge Phase 1 on September 24, 2015. A preliminary in-depth review of that information has determined that the application is not complete. The following information is needed to continue the stormwater review: 1. 02H. 1 003(g)(4) - Provide topographic maps of the project area showing original and proposed contours and drainage patterns. The boat storage area plan is missing existing (original) contour infonmation and existing (original) drainage patterns. 2. 02H. 1 003(g)(6) - Delineate the existing and the proposed built -upon area including roads, parking areas, buildings, etc. Please add dimensions of the #57 stone area and the impervious pavement areas to the plans. 3. 02H. 1 003(g)(7) - Provide technical information showing final numbers, calculations, assumptions, drawings and procedures associated with the stormwater management .measures including but not limited to: Built -upon area, runoff coefficients, runoff volume, runoff depth, flow routing, inlet and outlet configuration (if applicable), and other applicable information as specked. a. About a month after the June 17, 2015 letter requesting additional information was sent, the Legislature enacted SL 2015-149, which set forth specific design criteria that allows the Division to consider #57 stone as a "pervious" surface. The session law considers a surface of #57 stone (as designated by ASTM) laid at least 4" thick over a geotextile fabric to be a pervious surface. If you would like the opportunity to redesign the stone to meet the SL requirements, please do so. if you do, then you only need to treat the actual impervious drive aisle and access street. The modified application that was submitted only contains the boat storage drainage area. The 2005 application provided a supplemental page with the completed bio-retention drainage area columns. Is it your wish to add the 2005 application supplement page to this current modification? If not, then please add the drainage area information for the 4 bio-retention basins to the current application. c. As indicated in the Division's June 17, 2015 letter, you need to demonstrate how the proposed gravel will meet the "permeable pavement used for infiltration" guidelines using a 1.5" design storm, and you must also be able to safely convey the 10 year 24 hour storm. Detention with direct discharge to SA waters via an orifice is not an option under the 1995 rules. Permeable pavement as a BMP did not exist in 1995, which makes things a bit complicated from the standpoint of design. The project is within % mile of and draining to SA waters, so the permeable pavement must be designed for infiltration and a 50' vegetated filter for the "overflow" must be provided. d. If you cannot meet the 1995 rules to infiltrate the 1.5" design storm, then per 02H.1005(a)(1)(B)(iii), you must design the BMP to control and treat the greater of, runoff [volume] from all surfaces generated by 1.5" of rain, or the difference in the stormwater runoff [volume] from all surfaces from the predevelopment and postdevelopment conditions for a 1 year 24 hour storm. For the pre -development runoff calculation, you cannot assume that the existing gravel surface is impervious since it was added later and is not shown on the 2005 approved plans. This BUA was not shown on the approved plan and not explicitly called out in the BMP calculations. Actions proposed to resolve this matter include an evaluation of the size, location, and drainage patterns associated with the storage area. This will require a combination of a ground survey, review of available aerial photography, and observation of the area during a runoff producing rainfall event. Once these items are established, an analysis of the affected BMP(s) will be conducted to determine if they are sized appropriately or, if not, the feasibility of modifying the BMP(s). Once this analysis is complete, revised plans will be developed which accurately depict the boat storage area and, if necessary, provide details for BMP improvements. In the event that the storage area straddles the approved project area for phases I and 2, there will be a need to modify both permits accordingly. Please note that this phase was designed and permitted by another engineering firm and, as such, our files are incomplete. A review of the DENR file is scheduled for 1/6/2015. Once this information is in hand, I will be better able to direct our surveying crew to locate critical features of the exiting phase 1 collection system, BMPs and the storage area. This letter, with attachments, is the report of our testing. Field Testing On August 19, 2015, ECS conducted an exploration of the subsurface soil and groundwater conditions at two requested locations shown on the attached Test Location Plan (Figure 1). ECS located the borings using a site plan provided by Stroud Engineering. The purpose of this exploration was to obtain subsurface information of the in -place soils for the stormwater BMP areas. ECS explored the subsurface soil and groundwater conditions by advancing one hand auger boring into the existing ground surface at the requested boring locations. ECS visually classified the subsurface soils and obtained representative samples of each soil type encountered. ECS also recorded the SHWT and groundwater elevation observed at the time of the hand auger borings. The attached SHWT Form provides a summary of the subsurface conditions encountered at the hand auger boring locations. The SHWT and groundwater elevation was estimated at the boring locations below the existing grade elevation. The boat storage area was added to the Neighborhoods of Holly Ridge sometime before October 2008 without benefit of an approved plan. Please note that you are attempting, to apply a 2014 definition to a gravel surface that was created 6 years before the new definition went into effect. After due consideration of your request, the Division offers the following observations. Due to the long-term compaction that gravel is subjected to, gravel was considered a built - upon area under the definition of built -upon area for stormwater programs, which was in force at the time the gravel for this particular site was laid. The construction of a new gravel surface under SL 2013-413 between August 2013 and September 2014, was not considered a built - upon area. Please note that the Session Law was not retroactive to existing gravel surfaces. The current definition of built -upon area is as follows: 15A NCAC 02H .1002 DEFINITIONS Effective 1/1/2015 The definition of any word or phrase in this Section shall be the same as given in Article 21, Chapter 143 of the General Statutes of North Carolina, as amended. Other words and phrases used in this Section are defined as follows: (1) "Built -upon Area" means impervious surface and partially impervious surface to the extent that the partially impervious surface does not allow water to infiltrate through the surface and into the subsoil. "Built -upon area" does not include a slatted deck or the water area of a swimming pool. As you can see gravel was removed from the list of things that were not considered built -upon area, however gravel was also NOT specifically defined as BUA. Today, gravel could be considered as a pervious pavement and could be assigned a similar amount of BUA credit if it meets the criteria outlined for pervious pavement in the BMP manual. Please provide stamped, signed and dated calculations which demonstrate how the installation of the gravel meets the "permeable pavement used for infiltration" guidelines and how it will be maintained to retain its pervious qualities overtime. The Division can make certain allowances for the lack of a full 2' seasonal high water table separation; 2. The fact that this particular installation of gravel is in a storage area that supposedly does not see a lot of traffic volume and therefore, compaction is probably not going to be an issue; 3. The type and depth of stone used and the presence or absence of underlying filter fabric will also play a part in how much compaction occurs, how pervious the installation will be over time and how much BUA credit can be assigned. Gravels not underlain with filter fabric tend to be pushed down in the soil over time, creating an impervious surface. Unwashed gravels containing a lot of fines or a variety of stone sizes cannot be accepted for pervious pavement credit because the majority of the available void space will be taken up with the fines and smaller stones. Based on this definition, only those partially impervious surfaces which do not allow water to infiltrate through the surface and into the subsoil could be classified as Built -upon area. Field observation has confirmed that water readily infiltrates through the aggregate in question. You brought up the option of utilizing the void space in the aggregate as a means to store and infiltrate the water. This is what is occurring in practice. However I suspect that the underlying soils would not qualify for an infiltration BMP, I would suggest that the overlaying aggregate does not worsen this condition. To the contrary, aggregate acts to detain water and dissipate energy when placed over a less permeable surface. This concept is no different than the action of dense stand grass on a compacted berm. What I am saying is that my opinion, based on my observations, is that this parking area meets the letter and intent of the definition. If the aggregate were removed, there would be more ponding and runoff than what is occurring now because the aggregate is the less restrictive of the upper two layers. David L. Menius, P.E. Before we will transfer the permit to the HOA, these issues will need to be resolved: Comments regarding Phase I under SW8 050213: 1. 1 noticed that there is a lapse of over 13 months (Feb. 23, 2006 through March 30, 2007) between the originally recorded deed restrictions which assigned 3800 sf to each Phase I lot and the amendment which restored the BUA limit for the Phase I lots to the permitted 2800 sf. My concern is how many lots in Phase I were sold under the 3800 restriction, and did those lot owners consent to having their BUA limit reduced? 2. Did the developer make sure that any of those lots described above which were sold under the 3800 sf limit, were actually in compliance with the 2800 sf limit at the time the amendment was filed? 3. Per Google Earth, the gravel in the boat storage area was already in place as of October 2008. At that time, gravel was considered a built -upon area. As such, you will need to modify the permit to account for that additional BUA and propose a suitable high density BMP that will treat the runoff, or modify the permitted BMP to accept that additional drainage. 4. The plans provided for the boat storage area need to be more detailed to include dimensions, grading, gravel pavement section details (including stone depth, geomembrane liner, type of stone used) and the BMP details. Comments regarding Phase II under SW8 050842: 1. The Amenity Area site plan needs to show the proposed (now existing) grading and drainage to verify that the runoff is draining into the appropriate permitted BMP. Comments regarding SW8 070649: 1. The recorded deed restrictions consistently refer to an erroneous permit number of SW8 07064." The correct permit number is SW8 070649. Somehow, beginning with the Seventh Amendment which annexed Phase III and continuing with each subsequent amendment pulling in the various Sections within Phase III, the "9" has been consistently omitted from the end of the permit number. It is imperative that the correct permit number be referenced in these documents. The developer will need to record an amendment to correct this error. Is everything on track with the construction and remediation work that needs to be done? It's supposed to be starting soon, now that weather is warmer, right? Please let me know when the remediation work will begin. I've got other inspections in Onslow County, and can include NHR in my tour.
