Here is how I re-worked the language - please let me know what you think:
The DWQ will allow the temporary use of a sediment and erosion control device to control stormwater from Section 2 of
Briar Chapel Phase 5 South. The use of the sediment control device as a stormwater BMP may occur for a period of up to
30 months after the issuance of the first Certificate of Occupancy for a Section 2 property provided that the following two
conditions are met:
¦ There is an approved Sediment and Erosion Control Plan in place.
¦ The sediment and erosion control device is properly maintained.
Thirty months after the first Certificate of Occupancy is issued for Section 2, the stormwater management plan that was
approved by the DWQ on June 13, 2008 must be in place and operational. The structural stormwater practices as well as
drainage patterns must be maintained in perpetuity. No changes to the structural stormwater practices shall be made
without written authorization from the DWQ. Stormwater easements shall be recorded for a distance of at least ten feet on
each side of all stormwater conveyances on all lots containing these structures including future access for maintenance.
The stormwater easements utilizing this facility shall allow for the ability to maintain these structures, perform corrective
actions as described above and shall provide for protection of the structures from potential alterations by future property
owners.
After the stormwater plan is implemented, please fill out a Certificate of Completion (available at:

Per our telephone conversation on Friday afternoon, I had a conversation with the owner for Briar Chapel
regarding placing a time constraint on the final conversion of the wet pond BMP from a temporary sediment
and erosion control basin to a forinal wet pond BMP. Based upon the current housing market and general
construction practice, the owner has indicated they feel comfortable committing to having the facility converted
to the final wet pond BMP condition 30 months after issuance of the first certificate of occupancy. Therefore, in
lieu of the language provided in my previous letter to you last week, would you be willing to accept the
following language for incorporation into an updated stormwater management plan approval:
"It is understood by the DWQ that the approved wet pond BMP for Phase 5 South will be utilized as a
sediment and erosion control device during construction of this phase of the project. Furthermore, so long as
there is an active land disturbance permit utilizing this facility as a sediment and erosion control device,
occupation of the homes may occur so long as the storm water management plan that was approved by the
DWQ on June 13, 2008 is in place upon expiration of the land disturbance permit and close out of the
sediment and erosion control stage of the project or 30 months after issuance of the first certificate of
occupancy, whichever comes first"

This would require the developer to convert the facility into the final wet pond BMP condition no later than 30
months after issuance of the first certificate of occupancy (sooner if construction is completed earlier) for this
phase of the project. Please let me know if this language would be acceptable.

I was just checking in to see if you received the hard copy of the clarification letter that I sent via FedEx to you for Briar
Chapel and if you have had a chance to review the language. I am trying to get the updated stormwater management plan
approval letter so I can send over to Chatham County in time for us to get on the agenda for the next County
Commissioner's meeting. County Staff will not let this go until clarification from DWQ has been received. Please let me
know if you did not receive this and I will have it hand delivered to you.

Hello Annette
Per our telephone conversation earlier this morning, please find the attached letter regarding Briar Chapel Phase
5 South in Chatham County, NC. This letter gives a brief summary of the DWQ stonnwater management plan
approvals for Briar Chapel Phase 5 South, along with a request for clarification of the permit language
regarding final conversion of the wet pond BMP from a sediment & erosion control device to a permanent
stormwater BMP with respect to certificate of occupancies. As we discussed, I have proposed in the letter some
revised permit language that if acceptable to DWQ, will replace the language in the existing stormwater
management plan approval (will require an updated stormwater management plan approval be issued with the
revised language incorporated). The proposed revised language hopefully addresses both Chatham County and

DWQ's concern with respect to final conversion of the wet pond BMP as it relates to issuance of certificate of
occupancies while allowing for construction of the site to proceed in a practical manner. For DWQ records, I
am also mailing you a hard copy of the attached letter. Upon receipt and review of' this letter, please let me
know if you have any questions or if any revisions to the letter are necessary. In an effort to expedite achieving
plat approval with Chatham County, an email confirmation acknowledging receipt of this letter and that the
proposed revisions are acceptable would be greatly appreciated.
