W oody species across the Study Area consist of loblolly pine (Pinus taeda), tulip poplar (Liriodendron tulipifera), sweetgum (Liquidambar styraciflua), and multiple oak (Quercus sp.) and hickory species (Carya sp.) in the canopy layer. The understory is composed of red maple (Acer rubrum), American beech (Fagus grandifolia), sweetgum, Chinese privet (Ligustrum sinense), autumn olive (Elaeaganus umbellata), American holly (Ilex opaca), and black cherry (Prunus serotina). Herbaceous and vine species include greenbriar (Smilax rotundifolia), Japanese honeysuckle (Lonicera japonica), poison ivy (Toxicodendron radicans), Virginia creeper (Parthenocissus quinquefolia), blackberry (Rubus sp.), goldenrod (Solidago sp.), switchcane (Arundinaria tecta), and various other herbs and grasses. The Natural Resources Conservation Service (NRCS) Soils Survey of Stanly County and Union County (Appendix D, Figure 3) was reviewed and on-site soils are presented in Table 1. The NRCS’s National Hydric Soils List classifies Chewacla silt loam, Congaree fine sandy loam, Oakboro silt loam, and Secrest-Cid Complex as hydric (NRCS 2017). Table 1. A review of the USFWS NWI (USFWS 2017) indicated multiple wetlands and streams within the Study Area (Appendix D, Figure 4). The U.S. Geological Survey (USGS) National Hydrography Dataset (NHD) provides digital geospatial datasets to the public that map a network of surface waters and catchments of the United States. The USGS NHD (USGS 2017) depicts multiple stream channels within the Study Area (Appendix D, Figure 4). The Study Area crosses multiple Federal Emergency Management Act (FEMA) 100-year floodplains (FEMA FIRM Panels 3710542700J, 3710543700J, 3710544700J, 3710545700J, 3710546700J, 3710546800J, 3710547800J, 3710547900J, 3710548800J, 3710558000K, 3710558000K, 3710558200K, 3710558200K, 3710650200K, 3710650200K, 3710650300J, 3710651300K, 3710652300K, 3710653300J, 3710654300J, 3710654400J, 3710655300J, 3710655400J, 3710656400J, and 3710657400K; FEMA 2017) (Appendix D, Figure 4). Jurisdictional Delineation On September 25-27, October 2-4, October 9-10, October 16-18, 2018, and January 11, January 16-17, February 8, March 7, March 19, March 26-27, April 10-11, May 7-8, and May 21-22, 2019, HDR environmental scientists performed field surveys to identify waters of the U.S. under Section 404/401 of the CWA. Jurisdictional waters of the U.S. were delineated according to the methodology and guidance described in the USACE 1987 Wetland Delineation Manual, USACE Post-Rapanos guidance, and the 2012 USACE Eastern Mountains and Piedmont Regional Yadkin Regional Water Supply Project Request for Preliminary Jurisdictional Determination Revised March 13, 2020 Page | 4 Supplement (Version 2.0) (USACE 1987; 2012). Streams were classified utilizing the methodology and guidance provided in Regulatory Guidance Letter (RGL) 05-05 (USACE 2005) and the North Carolina Division of Water Resources (NCDWR) Methodology for Identification of Intermittent and Perennial Streams and Their Origins (Version 4.11) (NCDWR 2011). Jurisdictional waters of the U.S. were flagged in the field and mapped using a Trimble® Geo7X GPS unit capable of sub-meter accuracy. GPS points were post-processed utilizing Trimble® GPS Pathfinder Office software. Results The results of the on-site field investigation conducted by HDR indicate that there are 123 jurisdictional stream channels, 81 jurisdictional wetlands, and 17 jurisdictional open water ponds (Appendix D, Figures 5A-5E). Potential Jurisdictional Features Tables are located in Appendix E, Tables 2 through 4, with relevant information. USACE Wetland Determination Data Forms are included in Appendix F, Stream Identification Forms are located in Appendix G, and representative photographs of potential features are provided in Appendix H. A majority of the on-site waters drain to the Rocky River (HUC 03040105). The Rocky River is classified as Aquatic Life, Secondary Recreation, Fresh Water (C) Waters by the North Carolina Department of Environmental Quality (NCDEQ). The remainder of the on-site waters (in the eastern portion of the Study Area) drain to the Upper Pee Dee River (HUC 03040104). The Upper Pee Dee River is classified as Water Supply IV- Highly Developed (WS-IV) Waters by the NCDEQ. Potential Jurisdictional Features On-site potential jurisdictional waters of the U.S. total approximately 33,881 linear feet (lf) (or 6.69 acres) of jurisdictional stream channel, 13.99 acres of jurisdictional wetlands, and 3.73 acres of jurisdictional open water ponds (Appendix D, Figure 5). A summary of on-site potential jurisdictional waters is provided in Tables 2 through 4 of Appendix E.
