You have our approval to place fill material in 0.04 acres of wetlands or waters for the purpose
of replacing Bridge # 27 on SR 1139, as you described in your application dated 25 September 1995.
After reviewing your application, we have decided that this fill is covered by General Water Quality
Certification Number 2732. This certification allows you to use Nationwide Permit Number 14 when it
is issued by the Corps of Engineers.
This approval is only valid for the purpose and design that you described in your application. If
you change your project, you must notify us and you may be required to send us a new application.
For this approval to be valid, you must follow the conditions listed in the attached certification. In
addition, you should get any other federal, state or local permits before you go ahead with your
project.
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory
hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing,
send a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the
Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and
its conditions are final and binding unless you ask for a hearing.
This letter completes the review of the Division of Environmental Management under Section 401

Subject: PDN/NWP-14 (Proposed Replacment of Bridge #27 in Hertford County
The North Carolina Department of Transportation proposes to replace bridge
#27 on SR 1139 over Bluewater Branch in Hertford County with 3 @ 142" x 91"
corrugated spiral metal pipe arches, including a headwall on the upstream side.
Average daily flow at this bridge site is 5.6 cfs. Proposed replacement will not require
an on-site detour and the replacement structure will be installed at the existing location.
Since a small amount of fill will be placed in Waters of the U.S. (< 0.02 acre in
wetlands and < 0.02 acre in surface waters), the attached joint notification form is
submitted for your review and approval. Seven copies of this notification and
associated vicinity map and engineer's drawings are being sent concurrently to the
Division of Environmental Management.
Bluewater Branch is a tributary to Potecasi Creek and lies in the Chowan River
Basin. Its best usage classification is C NSW. The stream is not listed as an
Anadromous Fish Spawning Area. The Division of Coastal Management has
determined that the project does not impact an Area of Environmental Concern.
Only one federally protected species, the red-cockaded woodpecker, is listed by
the U.S. Fish and Wildlife Service for Hertford County. Since the project will not result
in the removal of pine trees, the proposed action will not effect this species.
