Dear Mr. Tharrington and Ms. Sanchez -King,
In response to your Notice of Deficiency (NOD-2020-PC-0275) of June 4, 2020 for
Lafayette Farms, L-11 (67-53) 1 submit the following:
Deficiency 1: Failure to maintain required lagoon freeboard.
We have had a tremendous amount of rainfall in the last few months and have been
very careful in land application so as to not allow ponding nor runoff. The farm has wet -
natured soils and we must be careful when applying waste. We provided the required
30 day POA and have since gotten our lagoon in compliance. This lagoon has a heavy -
rainfall factor figured in and we encroached upon that area due to the chronic heavy
rains.
I regret that high freeboard has occurred and we are managing the farm to prevent any
damage to our environment
