Box 25201 Raleigh, N.C. 27611 FILE COPY Dear Mr. O' Quinn: You have our approval to place fill material in 0.001 acres of wetlands or waters for the purpose of bridge replacement on SR 1362 in Oyster Creek Banks Subdivision, as you described in your application dated 2 June 1995. After reviewing your application, we have decided that this fill is covered by General Water Quality Certification Number 2732. This certification allows you to use Nationwide Permit Number 14 when it is issued by the Corps of Engineers. This approval is only valid for the purpose and design that you described in your application. If you change your project, you must notify us and you may be required to send us a new application. For this approval to be valid, you must follow the conditions listed in the attached certification. In addition, you should get any other federal, state or local permits before you go ahead with your project. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and its conditions are final and binding unless you ask for a hearing. PROJECT SUMMARY: The applicant proposes to replace an existing 10' wide by 54' long wooden and steel bridge with a 24' wide by 57' long timber bridge with an asphalt surface. d N.C. DEPARTMENT OF TRANSPORTATION Bridge Replacement - Oyster Creek Ocracoke Island, Hyde County Environmental setting The project is located at the second bridge on the extension of SR 1362 in Oyster Creek Banks Subdivision on Ocracoke Island in Hyde County, North Carolina. The existing bridge is approximately 10' wide by 54' long. The bridge crosses a 55' to 60' wide canal off Oyster Creek that flows into the Pamlico Sound. Boat traffic is prevalent in the canal and numerous docks exist both upstream and downstream from the bridge. Average water depth in the canal is approximately 6' below NWL. Highground adjacent the canal and bridge site has been subdivided into individual building lots. Vegetation along both banks of the canal and the bridge site include Yucca, Spartina patens, Juncus roemerianus, Sea Oats and other native vines and grasses. The waters of the canal are classified SA by the Environmental Management Commission. Oyster Creek is not a primary nursery area and is closed to shellfishing by Shellfish Sanitation. Project proposal The applicant proposes to replace the existing bridge with a 24' wide by 57' long timber bridge. The under clearance of the proposed bridge would be 7', which is 1 foot greater than the current structure. The proposed bridge would consist of 2 timber bents supporting three 19' timber spans. The proposed wooden deck surface will be covered with asphalt. Approximately 10 sq. yrds. of material is proposed to be placed as fill below MHW. Another ±20 sq. yrds. of fill will be used in the approaches. The source of the fill material is the dredge spoil disposal area at the north end of Ocracoke Island. A total of 80' (40' per side) of interlocking steel sheetpile bulkhead is proposed to confine all fill materials within the road right-of-way adjacent the canal. Environmental impact The proposed project would result in the loss of ±40 sq. ft. of creek/canal bottom due to filling. As a result of the installation of the timber bent piles and filling activities, localized turbidity will occur. Navigation on the creek/canal would be impeded during construction activities, but no long-term negative impacts are expected. The under clearance of the proposed bridge would be 7' above NWL, a l' increase from the current structure. The width of the bridge crossing will increase from 10' to 24'. No wetlands will be filled. The North Carolina Department of Transportation is proposing to replace a bridge over Oyster Creek in the Town of Ocracoke in Hyde County. The Bridge will be replaced in its existing location with three 19 foot timber spans and will not require a temporary detour. The structure will provide a +24 foot travelway with no shoulders. The bridge will consist of an asphalt surface over a wooden deck. The wooden deck will be on top of timber beams connected to timber pilings. The new structure will have 1 additional foot of vertical clearance than the existing bridge. The proposed work will result in the placement of 10 cubic yards (0.001 acres) of fill below ordinary high water. All fill material will be contained behind the proposed bulkhead. The proposed bent in the canal will be pile driven and will not require any "mucking out". It does not appear that any submerged aquatic vegetation exists in the area and the work will not result in any impacts to wetlands. The NCDOT is requesting that the proposed work be authorized under a Coastal Area Management Act (LAMA) permit. This project is anticipated to be approved by Nationwide Permit 14 (Road Crossings) from the U. S. Army Corps of Engineers, and by 401 General 0 2 Certification 2732 from the NC Division of Environmental Management.
