This Genera! Certification is issued in conformity with the requirements of Section 401,
Public Laws 92-5Q0 and 95-217 of the United States and subject to the North Carolina Division of
Environmental Management.Regulatians in 15 NCAC 2N, Section .050o and 15 NCAC 2S .0109
and ,0201 for the discharge of fill Material to waters and wetland areas which are waters of the
United States as described in 33 CFR 325 Appendix A of the Corps of Engineers regulations.
The State of North Carolina certifies that the specified category of activity will not violate
Sections 301,302, 343, 30fi and 307 of the Public laws 92-500 and 95-217 'rf conducted in
accordance with the conditions hereinafter set forth.
Conditions of Certification:
1. These ac#ivities do not require written concurrence from the Division of Environmental
Management as long as they comply with all conditions of this General Certification,
2. That the applicant must notify DEM in writing in conjunctior- with ratification of the
U.S. Army Corps of Engineers;
3~ That established sediment and erasion control practices are utilized to prevent
violations of the appropriate turbidity water quality standard X50 NTUs in streams and
rivers not designated as trout waters by DEM; 25 NTUs in all saltwater classes, and al!
lakes and reservoirs; and 10 NTUs in trout waters ar waters tributary to trout waters);
4. That wetland or water #ill shall rat be within 50 feet of the mean high water f ire
or normal water level of any perennial or intermittent water body as shown by the most
recently published version of the United States Geological Survey 1:24,004 X7,5 minute}
scale topagraphiic map ar other site specific data which indicates surface water f low
unless written app~~oval is received from DEM;
5. That this certification does not apply if the developer or landowner was required by
DEM or COE to add deed restrictions on lots to restrict future wetland fill;
fi. That measures shall be taken to prevent live or fresh concrete from coming into
contact with waters of the state until tf~e concrete has hardened;
7. That wetland fill in watersheds with waterbodies classified as High Quality Waters
~e,g., trout, primary nursery areas, WS-I, INS-II, SA, and Qutstanding Resource Maters}
and Nutrient Sensitive Waters shall be minimized as much as practicable to the
satisfaction of the U.S. Army Corps of Engineers;
8. This Certification shall expire when the appropriate Nationwide Permit is
reissued, expires or is modified.
Non-compliance with or violation of the conditions herein set forth by a specific fill project
shall result in revocation of this CerEification forthe project.
