Expedited permits are generally simple 100% domestics (e.g., schools, mobile home parks, etc) that can be administratively renewed with minor changes, but can include facilities with more complex issues (Special Conditions, 303(d) listed water, toxicity testing, instream monitoring, compliance concerns). No From 2014: "The permit has been given an annual average mercury limit per the current statewide TMDL permitting strategy. The final version has been updated to include a condition requiring a mercury minimization plan per the strategy. The facility doesn't fit neatly in the categories set in the strategy (it's neither municipal nor industrial), but since it's in the Lumber basin, had Hg monitoring, and circumstances require adding a WQBEL limit, the MMP seems like reasonable condition to add, and it shouldn't be a great burden on the facility." In this renewal (2019) The MMP condition was removed from the permit. The facility submitted a plan for mercury monitoring and reduction that the Division finds satisfactory. The hospital is no longer in operation, and the permittee did not exceed mercury limits. The facility did not demonstrate reasonable potential to exceed their current mercury limits, however the RPA concluded that the max value was > 50% of allowable cw, so the quarterly monitoring will remain in place. This can be re-evaluated upon next renewal. Compliance History: No enforcements this permit cycle. 2 NOV's for fecal coliform daily max exceedances in 2018. No toxicity tests were failed this permit cycle. Changes to previous permit: • Based on eDMR data submitted by McCain Correctional Hospital WWTP, mercury did not demonstrate a reasonable potential to exceed applicable water quality standards/criteria. The requirement for a mercury monitoring plan (previously Part 1. Section A. (3)) has been removed. The permittee will be required to monitor mercury once every permit cycle (Part 1. Section A. (1)). • HUC was added to the outfall description on page 2 • The outfall map has been updated • Regulatory citations were added as necessary • Section A. (3) was updated to reflect current eDMR requirements eDMR summary July 2015-July 2019 Instream Monitoring: The current permit requires instream monitoring for dissolved oxygen, specific conductance, and temperature. Review of instream data for the past four years indicates that the dissolved oxygen standard of 5 mg/l was not maintained. Instream DO fell below 5 mg/L in 90 out of 205 upstream samples, and 115 out of 205 downstream samples. Since the sampling station is two miles downstream, it is difficult to constrain whether this facility, which discharges minimal ammonia and BOD, is a cause of low instream DO. It was nice to meet and speak with you earlier this week. For response continuity, attached is the requested Mercury Minimization Plan (MMP) that I submitted earlier this week. The other attachment shows the historical discharge results for Mercury from the effective date of the last permit. I received that BIMS report from the Fayetteville Regional Office yesterday. Per regulatory guidance, using zero for the less than detection limit results, the average discharge since that issuance is approximately 3.3 ng/L. This average is substantially below the permit limit of 17.9 ng/L. My belief was that the MMP requirement was for municipalities with a Major NPDES permit that implemented pretreatment programs. As a nonmunicipal discharger the pretreatment rules are not applicable to our facility. If the requirement was added based on there once being a Hospital at the facility, that Hospital closed in April 2010. DPS requests that the MMP requirements be removed from their Minor NPDES permit and as allowed the requirement to sample for Mercury removed or reduced. I will be out of the office from August 6th until sometime the week of August 20th, so any requests made during that time may be delayed until my return. Thank you for your assistance and let us know if anything else is required to issue a draft permit (preferably issued upon my return to allow adequate review time).
