DENR - WATER QUALITY VIETLANDS AND STOR,'MATER OMNCH We are in receipt of your letter dated December 3, 2009 which requests additional information for the 401 Water Quality Certification for the 2009 Hood Road North Annexation project. The following provides a response for all of your comments in the bulleted list that we received: 1. The use of rip rap in the stream channel. The plans have been modified to show rip rap extending from the upstream side of the temporary easement to the downstream side of the permanent easement reducing the total impact area. After construction the rip rap is to be taken out of the stream bed. (See Exhibit A) 2. Clarification of permanent and temporary impacts. The plans, figures, and permit application have been amended to show the reduced temporary and permanent impacts. These impacts have been reduced by limiting the work area to one side of the .stream. Clarification whether borings or open cut will be utilized for stream crossings. All stream crossings will be open cut as stream soils are unsuitable for borings. 4. Clarification of working in the dry. Depending on the particular stream, one of two methods will be implemented to construct across the channel. One method will involve having the pipeline constructed in two segments, each to the middle of the stream channel. Once one side has been installed it may be restored to allow stream flow over the newly constructed pipe. The other side/section of the pipe would then be installed completing the crossing. For lower flow situations the channel would be completely blocked. This will create a complete crossing in the dry allowing the construction to proceed quickly across the stream channel. Depending on the stream flow bypass pumping may be used to maintain the stream flow as well as the coffer dam integrity during construction. KHA Chad Evenhouse, PWS, KHA Alan Johnson, North Carolina Department of Water Quality (NCDWQ) Steve Chapin, United States Army Corps of Engineers (Corps) Purpose Kimley-Horn and Associates, Inc (KHA) staff met on behalf of Charlotte-Mecklenburg Utilities (CMU) with the North Carolina Division of Water Quality (NCDWQ) and U.S. Army Corps of Engineers (Corps) to discuss the 404/401 permit application and Preliminary Jurisdictional Determination request for the 2009 Annexation North Hood Road Sanitary Sewer project (Nationwide Permit 12 application submitted on November 5, 2009. The meeting was held to review the project and permit application and address agency questions related to the design and proposed activities. The following comments are presented by review areas discussed in the field. The areas reviewed in the field were selected to represent the project as a whole, as well as provide a review of the more significant areas of proposed impacts. Southern Outfall Area (Wetland #7, Impact #4; Stream #5, Impact #7) • NCDWQ, Corps, and KHA concurred on shifting the temporary easement currently located in Wetland-7 north approximately 1Oft. to minimize temporary wetland impacts. • NCDWQ requested that trees greater than 8" DBH not be cleared within the wetland area temporary construction easement where practicable. • Corps required that the permit application be amended to account for forested wetland impacts within the permanent easement be considered permanent due to the change in vegetation community type. Areas that would be re-forested would be considered temporary impact. • Agencies recommended that the City provide for 404/401 compliance documentation during construction of significant impact areas. Northern Outfall (Wetland #1, Impact #1; Stream #6, Impact #3) NCDWQ asked whether temporary riprap for the stream crossings would be removed after construction. KHA said that riprap would be removed from the channel bottom, but would remain along the banks for stability. KHA said that they would review the option of removing all riprap with CMU. • NCDWQ and the Corps recommended that a more aggressive re-vegetation plan along the stream banks be applied rather than just seeding. KHA said that the planting plan would be amended to include woody species plantings typical of stream restoration and streambank stabilization projects. A planting list and specifications would be submitted with the amendments to the permit application. • Agencies were mostly concerned with incorporating species that grow and mature quickly as to stabilize and shade wetlands/streams in the shortest amount of time possible. Other Comments All larger impact areas (i.e. wetland impacts greater than 0.10 acres, or stream impacts greater than 40 linear feet) will require more discussion and justification as to the need to impact that amount of area. KHA agreed that these areas were more difficult to minimize impacts due to various factors (i.e. topography, property lines, design requirements of the gravity sewer, etc.) and that a summary table with notes on site limitations or design constraints would be provided with the amendment to the permit application. KHA will provide the following information with the amendment to the Nationwide Permit (12) application: o Design changes with modified figures per the on-site discussion to move the temporary easement where practicable. o Recalculate impacts to include permanent impacts for wetlands where the vegetation community will be converted from forested to herbaceous. o Provide a summary table including notes for each larger impact area describing the design requirements or site constraints affecting the impact area and justification for the impact. o Amended impact summary table for the permit and project summary sheet originally submitted. All wetlands were delineated by KHA staff early in the design process and were avoided to the extent practicable when locating the utility easement alignment. Likewise, stream crossings were avoided to the extent practicable. Open cut trenching for construction was decided upon since the depth of the pipe would be too shallow for the practical use of directional boring. The number of stream crossings and wetland impacts were evaluated during design.
