After consulting with our team in Raleigh, we concur with your interpretation of the Rule as per
crossing. Buffer impacts are allowable without mitigation. Approval of the proposed project will be

Hi Dave,
Based on the table excerpt below, we proposed no mitigation due to the fact that neither of the two road crossings
exceeded 150 linear feet of impact along either stream (142 lf for Ingle Branch, and 87 lf for the UT) or 1/3 of acre per
crossing. We have interpreted the thresholds in the table of uses as limits per crossing, instead of cumulatively for the
entire project.
Please let me know if we have misinterpreted any of this information or you would like further explanation on how we
got these numbers.

Nancy,
Please explain which “Use” in the Table of Uses per 15A NCAC 02B. 0267 (Jordan Lake Riparian Buffer Rule)
allows for the proposed buffer impacts without mitigation as indicated in your application. Buffer mitigation is
required for road crossing impacts to buffers of greater than 1/3 acre. The PCN shows a total of 24,623 sq ft
which is greater than 1/3 (43,560/3 = 14,520). We will subtract wetlands that are within the buffer, but even
with that, impacts are greater than 1/3 acre.
