C. 28621 Dear Mr. Atkins: -tow ?EHNR July 14, 1995 Alleghany County DEM Project # 95718 FILE COPY You have our approval to place fill material in wetlands or waters for the purpose of replacing a pipe line on SR 1412, as you described in your application dated 3 July 1995. After reviewing your application, we have decided that this fill is covered by General Water Quality Certification Number 2745. This certification allows you to use Nationwide Permit Number 3 when it is issued by the Corps of Engineers. This approval is only valid for the purpose and design that you described in your application. If you change your project, you must notify us and you may be required to send us a new application. For this approval to be valid, you must follow the conditions listed in the attached certification. In addition, you should get any other federal, state or local permits before you go ahead with your project. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and its conditions are final and binding unless you ask for a hearing. This letter completes the review of the Division of Environmental Management under Section 401 of the Clean Water Act. If you have any questions, please telephone John Domey at 919-733-1786. Army Corps of Engineers Regulatory Branch 6512 Falls of the Neuse Road Suite 105 Raleigh, North Carolina 27615 Re: Emergency Pipe Replacement - SRI 412 - Alleghany County, North Carolina Dear Mr. Jolly: The North Carolina Department of Transportation, District I Maintenance has discovered a pipe line which has partially collapsed on SR1412 approximately 0.28 Miles East of the intersection of SR1409. The existing line is a 48" CS pipe and we plan to replace it with approximately 50 LF of 48" welded steel pipe. The installation will be accomplished with a bore and jack operation which will minimize disturbance to the area. We are requesting a 404 Nationwide Permit (#3 Maintenance) for this emergency work from your agency since this pipe crossing involves a small stream. I am sending a straight line sketch with the proposed erosion control, stream, and a marked map showing the location. By copy of this letter I am asking Ms. Stephanie Goudreau, Mountain Region Coordinator of the North Carolina Wildlife Resources Commission to comment directly to you concerning the 404 Nationwide Permit request. Also, by copy of this letter, I am requesting authorization to proceed under Section 401 of the Clean Water Act from the Division of Environmental Management. We will to begin construction as soon as possible. If further information is required, please let me know. Your early review and consideration of this request will be greatly appreciated.
