Box 250 North Wilkesboro, N.C. 28679 FILE COPY Dear Mr. Bennett: You have our approval to place fill material in 0.04 acres of wetlands or waters for the purpose of replacing existing pipe along SR 1317 in a small steam (Rich Hill Creek), as you described in your application dated 21 June 1995. After reviewing your application, we have decided that this fill is covered by General Water Quality Certification Number 2745. This certification allows you to use Nationwide Permit Number 3 when it is issued by the Corps of Engineers. This approval is only valid for the purpose and design that you described in your application. If you change your project, you must notify us and you may be required to send us a new application. For this approval to be valid, you must follow the conditions listed in the attached certification. In addition, you should get any other federal, state or local permits before you go ahead with your project. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and its conditions are final and binding unless you ask for a hearing. Dear Mr. Thomas, The Department of Transportation is scheduled to grade, drain, base, and pave primarily along the existing roadway of SR 1317 (Rich Hill Rd.), in Ashe County during the 1995-1996 fiscal year. Due to the proximity of a small stream, Rich Hill Creek Class-c-trout, we are requesting a 404 Nationwide permit No. 3, to allow us to upgrade the 4 existing cross line drainage structures that will need replacing, and or extending. Attached is a straight line sketch with proposed erosion control, stream, stream embankment, pipe crossing and marked county map. By copy of this letter, I am asking Ms. Stephanie Goudreau, Mt. Region Coordinator with North Carolina Wildlife Resources Commission, to comment directly to you concerning the 404 Nationwide Permit request. A request will be made on this project for a Temporary Encroachment in the Trout Water Buffer Zone of Rich Hill Creek. I am asking Ms. Goudreau to comment directly to me concerning the Trout Water Buffer Zone Encroachment. Also, by copy of this letter, I am requesting authorization to proceed under Section 401 of the Clean Water Act from the Division of Environmental Management. (2) As construction progresses temporary and permanent erosion control devices shall be installed in a timely manner, according to any special permit requirements and /or requirements set out in G.S. 113A-57. MANDATORY STANDARDS FOR LAND-DISTURBING ACTIVITY Pursuant to G.S. 113A-57(3), Provisions for a ground cover sufficient to restrain erosion must be accomplished within 30 working days or 120 calendar days following completion of construction or development, whichever period is shorter, except as provided in 15A NCAC 4B .0024(e). DESIGN STANDARDS IN SENSITIVE WATERSHEDS Pursuant to G.S. 113A-57(3) provisions for a ground cover sufficient to restrain erosion must be provided for any portion of a land-disturbing activity in a HQW zone within 15 working days or 60 calendar days following completion of construction or development, whichever period is shorter. (3) All siltation and erosion control devices shall be properly maintained until no longer needed. (4) On projects performed by D.O.T. Maintenance Forces, request will promptly be made to the Division Roadside Environmental Unit for stage and permanent seeding. (5) Any removal of siltation devices will be based an the condition of established ground cover of that area the device Iq serving. CONSTRUCTION SEOUENCE FOR INSTALLING ROADWAY CULVERTS 1. Clear only enough area and install the downstream measures such as silt check dams, silt screens, and silt basins as noted on plan. 2. Excavate the 2' base tail ditch. 3.
