Moore NC DOT Route 1, Box 169C Marion, N.C. 28752 Dear Mr. Moore: FILE V11 You have our approval to place fill material in 0.02 acres of wetlands or waters for the purpose of improving South Mountain State Park Road, as you described in your application dated 1 March 1995. After reviewing your application, we have decided that this fill is covered by General Water Quality Certification Number 2735. This certification allows you to use Regional General Permit Number 031 when it is issued by the Corps of Engineers. This approval is only valid for the purpose and design that you described in your application. If you change your project, you must notify us and you may be required to send us a new application. For this approval to be valid, you must follow the conditions listed in the attached certification. Type A sediment and erosion control measures shall be used for this project. In addition, you should get any other federal, state or local permits before you go ahead with your project. If you do not accept any of the conditions of this certification,' you may ask for an adjudicatory hearing. You must act within 30 days of the date that you receive this letter. To ask for a hearing, send a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and its conditions are final and binding unless you ask for a hearing. This letter completes the review of the Division of Environmental Management under Section 401 of the Clean Water Act. If you have any questions, please telephone John Domey at 919-733-1786. SAMUEL HUNT I I I SECRETARY I am attaching a straight line diagram with erosion control plan, an application form for a nationwide permit, and a county map section relative to a spot safety improvement on South Mountains State Park Road in Burke County. South Mountains State Park Road is presently 13 to 15 feet wide. We plan to widen the road to 18 feet and increase the typical section. The proposed typical section is also attached. Grading will be moderate to heavy. This portion of South Mountains State Park Road is not part of the North Carolina State Maintained System. The improvement will begin 150 feet east of the State Park office and will continue in an easterly direction for 1,275 feet. We proposed to replace/extend three (3) pipes which carry a live stream at survey stations 12 + 30, 13 + 15 and 18 + 30. With a copy of this letter, I am requesting Stephanie Goudreau, North Carolina Wildlife Resources Commission Mountain Region Coordinator, to comment directly to you concerning the nationwide permit request.
