Dear Mr. Atkins:
You have our approval to place fill material in waters for the purpose of road maintenance and
bank stabilization at SR 1135A (Dock Billings Road), as you described in your application dated 15
February 1995. After reviewing your application, we have decided that this fill is covered by General
Water Quality Certification Numbers 2745 and 2665. These certifications allow you to use Nationwide
Permit Numbers 3 and 13 when they are issued by the Corps of Engineers.
This approval is only valid for the purpose and design that you described in your application. If
you change your project, you must notify us and you may be required to send us a new application.
For this approval to be valid, you must follow the conditions listed in the attached certification. In
addition, you should get any other federal, state or local permits-before you go ahead with your
project.
If you do not accept any of the conditions of this certification". you may ask for an adjudicatory
hearing. You must act within 30 days of the date that you receive this letter. To ask for a hearing,
send a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the
Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and
its conditions are final and binding unless you ask for a hearing.
This letter. completes the review of the Division of Environmental Management under Section 401

Re: Grade, Drain, Base, and Pave SRI 135A (Dock Billings Road) from the Southern Intersection of
SRI 139 to the Northern Intersection of SR 1139 (1.46 Miles) in Alleghany County, North Carolina
Dear Mr. Jolly:
The North Carolina Department of Transportation, District I Maintenance plans to grade this road primarily
along the existing alignment in the 1995 - 1996 Fiscal Year. We will be replacing existing pipes at Station
25+65 +- and Station 69+15+- which involve live streams. We will also be extending or replacing various
other pipe culverts throughout the project which do not involve live streams. We will be encroaching upon
the 25' trout stream buffer from Station 13+- to Station 15+-, from Station 17+- to Station 35+-, and from
Station 69+- to Station 70+-. We have tried to avoid any impacts to the trout waters by shitlng the center
line away from streams where possible. We will place rip rap along the stream banks where it was
impossible to avoid excavation or embankments adjacent to the streams. We are requesting a 404
Nationwide Permit (#3 Maintenance and tt13 Bank Stabilization ) from your agency.
I am sending a straight line sketch with the proposed erosion control, stream, and cross sections of the
affected areas. In addition, I am sending a typical section of the road, general notes on erosion control and a
marked map.
By copy of this letter I am asking Ms. Stephanie Goudreau, Mountain Region Coordinator of the North
Carolina Wildlife Resources Commission to comment directly to you concerning the 404 Nationwide
Permit request.
A request will be made on Qnis project for a Temporary Encroachment in the Trout Water Buffer Zone of
the DEHNR Trout Stream (Bledsoe Creek) and I am asking Ms. Goudreau to comment directly to me
concerning the Trout Water Buffer Zone Encroachment.
Also, by copy of this letter, I am requesting authorization to proceed under Section 401 of the Clean Water
Act from the Division of Environmental Management.

We would plan to begin construction in the spring. If further information is required, please let me know.
Your early review and consideration of this request will be greatly appreciated.

Right of way is staked 50' wide,'25' each side of centerline. Yhere
is a 100' x 100' sight distance staked at the-intersection of SR 1139
and SR 1135-A. Sta. 76+46 (E.O.P.) ties to Sta. 59+05 (E.O.P.) on SR
1135 (Bess Spicer Rd.).
This project is to be constructed in'1995-96 road program.

Silt Basin Type B's will be constructed to the dimension of
six feet by three feet by three feet unless otherwise noted
on the plans.
Generally, the order of installation of the erosion control
measures will be as follows:
Temporary silt basins shall be installed before
clearing and grubbing begins.
Silt fences and temporary silt ditches-shall be
installed after clearing and before-grading.
Temporary stone ditch checks shall be installed as
soon as ditchline is established.
Pipe outlet and inlet protection will be done as
soon as the pipe is, installed':
Seeding and other permanent erosion control
measures are to be.implemented as soon as practical.
