At the conclusion of this comment period, a copy of all comments will be provided to NCDMS and the NCIRT
along with District Engineer's intent to approve or disapprove this Final Record Drawing and initial credit
release.

Please find the summary of the completed adaptive management plan (AMP) for the Fletcher Stream and
Wetland site attached. All AMP work was completed by 2/28/2020.
Due to the additional work completed in February 2020, DMS and E.W. Solutions decided to delay Monitoring
Year 1 (MY1) reporting until 2020. Accordingly, the MY1 credit release will be requested for the entire site in
April 2021 at the next IRT credit release meeting.
This varies from our original IRT request but will allow for standard project credit releases and will hopefully
avoid confusion.
As described in the summary, E.W. Solutions is requesting a monitoring variance based on the delayed MY1
reporting. The full delivery provider collected monitoring data on a majority of the site in 2019 and are
requesting reduced monitoring in MY7 if performance standards have been met. All project assets will be

monitored for the required 7-year period. Please let me know if a separate mitigation plan addendum request
is required.
A copy of this AMP summary will be included as an attachment in the 2020 - MY1 report for documentation.

The proposed corrective action states that regraded areas will be replanted using the original planting plan.
However if site conditions are wetter than originally designed or the proposed regrading will expand areas of
inundation, alternate species may need to be considered. DWR requests the final seed mix and table of
planted species and quantities be included in the summary letter noted for the 30% credit release.

Please notify the IRT when the Adaptive Management Plan repair work is complete and provide the IRT with a
final Record Drawing (formerly referred to as As -Built). With this correspondence, the IRT approves the

The IRT visited the Fletcher Stream and Wetland Site on Tuesday July 23, 2019. The full delivery provider (EW
Solutions) is proposing an adaptive management plan to minimize/ alleviate hydrologic trespass. The work
will involve regrading areas of the wetland adjacent to Weston Creek and replanting those areas in the 2019
dormant season.
At the site visit, the IRT proposed a 15-day review period for the adaptive management plan. The proposed
adaptive management plan is attached for IRT review.
In addition, the IRT requested a proposal to address credit release on the site. DMS and the full delivery
provider request that the project continue on the current monitoring trajectory with 2019 as Monitoring Year
1(MY1). The attached memorandum describes the project credit release proposed by DMS.

Dear Mr. Tsomides,
Construction at the Fletcher Mitigation Site (the Site) was completed in March of 2019. Throughout the
life of the construction on the Weston Creek Reach there have been several significant rainfall events,
including two 5-inch rainfall events that resulted in major flooding at the confluence with Hoopers
Creek. The frequency of the overtopping events has been attributed to the exceptionally high rainfall
in the region during the previous 18- 24 months.
In April 2019 the adjacent property owner raised the concerns regarding floodwaters exiting the
easement and causing damage to the agricultural field between the easement and Hoopers Creek. In
response, the attached Adaptive Management Plan (AMP) was developed to address hydrologic
trespass (Attachments 1 and 2).
The initial regrading was completed November 2019. These activities include the regrading of the
floodplain along the east and west flanks of the newly restored Weston Creek to better control and
manage overbank flows (Attachment 3). The AMP grading operations were proposed in response to
deviations from the original Fletcher Mitigation design which resulted in flood flows that originated
within conservation easement exiting the site and impacting adjacent agricultural land. This grading
plan consisted of constructing a shallow Swale and low berm, running south to north along both sides
of Weston Creek, to contain and direct flood flows northward through the conservation easement. The
grading along the western side continues through the narrowing of the conservation easement to a
riprap base ditch. There, the outfall is stabilized as it flows into Weston Creek. The eastern side was
also manipulated and directs flood flows into an existing ditch which connects to Weston Creek.

The total area disturbed by the grading operations is approximately 6.6 acres, with 5.3 acres being
within the wetland restoration area. A buffer was maintained adjacent to Weston Creek as to not
affect any of the previously installed restoration features or constructed channel. The only exception
to this is the floodplain outfall on the western side near the downstream end. The majority of the
grading closely follows the proposed AMP design. In areas where slight departure was observed, it
resulted in a more conservative grading approach with regard to mitigating flood flows affecting
adjacent properties. Regraded areas were stabilized with temporary seed mix followed by permanent
seed mix, Table 1. Repair planting and additional livestake install was finished on January 28, 2020,

On February 6, 2020 a storm event totaling 3.35 inches caused additional flooding to the Weston Creek
Reach via an overbank event from Hoopers Creek. The event caused minor impacts to the adjacent
agricultural area. Work was halted and a repair plan was developed to address the remaining issues
with hydrologic trespass. These repairs targeted three key areas along the Weston Creek reach. A low
swale was installed along the easement boundary near the middle of the Weston Creek reach. This
swale was designed to divert draining floodwaters within the easement and prevent trespass. The
elevation of the berm along the lower section of Weston Creek was regraded to an elevation of 2077 ft,
the preconstruction elevation. A log hedgerow was installed along the berm to buffer the impact of
high flows from Hoopers Creek. A log deflector wall was installed on the upstream bank at the mouth
of Weston Creek. All of these repair areas were seeded, live staked, and re -planted (Attachment 3).
Repairs to the Weston Creek reach, replanting, and live staking were concluded on February 28, 2020.
As a result of the need for an Adaptive Management Plan, we are revising the delivery schedule of MY1
— MY7 monitoring and closeout reports (Table 3). During October 2019 - February 2020 we collected
monitoring data for the entire Fletcher mitigation site (with the exception of groundwater gauge data
from monitoring wells in the wetland re-establishment area). We will be including this data in report
form as an addendum to the MY1 report at the end of 2020. The primary objective of this is to simplify
the monitoring and avoid having separate MY1 monitoring reports for Weston and the remainder of
the Fletcher mitigation project. It is our intention that after MY6, if all criteria are being met, we will
conclude monitoring of the Fletcher mitigation project area other than Weston Creek Reach 1A and 113
and the wetland re-establishment area. In this case, the MY7 monitoring report would consist only of
data for Weston Creek Reach 1A and 1B and the wetland re-establishment area. Tables 4 and 5
illustrate the proposed yearly monitoring schedule and components for those specific monitoring
parameters.

On July 23, 2019, representatives from DMS, EW Solutions (Full Delivery Provider), Stantec, and the
IRT met on the project site to discuss EW Solutions' & Stantec's proposed Adaptive Management Plan
(dated July 2, 2019). The Adaptive Management Plan has been developed in order to address a
potential hydrologic trespass issue identified on the site. During the site visit, the IRT was agreeable
to the proposed repair work.
The Adaptive Management Plan notes; "After regrading is complete, six vegetation monitoring plots
and ten groundwater gauges will be re -installed and the monitoring monuments will be resurveyed.
Additionally, ground surface topography of the regraded areas will be re -surveyed. Since the proposed
Adaptive Management Plan will impact existing ground surface and vegetation, it is proposed that
impacted wetland gauge and vegetation plot monitoring be extended by one additional year. It is
proposed that all stream reaches and vegetation monitoring stations that are not affected by this effort
continue on the present monitoring schedule. "
At the site meeting, the IRT requested a proposal to address the project's Credit Release Schedule. A
copy of the asset table and asset map from the 2019 As -Built Baseline Monitoring Report are attached.

Management Plan work. Upon IRT review and approval, the proposed Adaptive Management Plan
work will commence immediately. Re -planting will be completed no later than the end of 2019.
The proposed work will impact 100% of the project's COLD stream credits (2,758 SMUs) and 100%
of the project's riparian WETLAND credits (8.91 WMUs). 100% of the project's COOL stream credits
(7,253.30 SMUs) will not be impacted by the proposed Adaptive Management work in anyway. The
COOL stream credits represent 73% of the project's total stream credits.
DMS and EW Solutions request that the project continue on the current monitoring trajectory with
Credit Release proposed as follows:
• The initial 30% credit release (Year 0/ As -Built) for the entire site (10,011.3 SMUs & 8.91
WMUs) will be requested upon completion of the proposed Adaptive Management Plan work
and submittal of a summary letter and re -surveyed ground surface topography of the regraded
areas (provided by EW Solutions). The IRT initiated the review of the final As -Built report on
June 25, 2019. DMS will hold the full 30% credit release request until the IRT has also
reviewed the completion summary letter and revised maps.
• 2019 will represent Monitoring Year 1 (MY1). A MY1 report will be completed by EW
Solutions and will include all of the information associated with the completed Adaptive
Management Plan work. DMS will provide the final MY1 report to the IRT in 2020 per the
standard credit release process.
• DMS will request the Year 1 Monitoring credit release for COOL stream credits only at the
2020 credit release meeting.
• The MY1 credit release request for all COLD stream credits and all riparian WETLAND
credits will be delayed by 1-year. This 1 year off set will continue until the IRT agrees to
release all project credits concurrently OR the site reaches Monitoring Year 8 (MY8).
• The 10% Stream Bankfull Standard will be requested upon successful completion of the
success criteria on all project streams as specified in the IRT approved mitigation plan.

1.0 ISSUE OF CONCERN
Construction of the Fletcher Mitigation Site (the Site) was completed in March of 2019. Prior to the
completion date, grading activities were completed on the wetland area adjacent to Weston
Creek in September of 2018. Since the completion of grading activities for the wetlands there
have been several significant rainfall events, including two 5 in rainfall events that resulted in major
flooding on the downstream receiving waters of Hooper's Creek. The frequency of the
overtopping events has been attributed to the exceptionally high rainfall in the region during the
previous twelve to eighteen months.
The total rainfall in the Fletcher area during the preceding year has been over 80 inches which is
33 inches above the average annual rainfall for 47 inches. Overbank flow has occurred as
expected for the higher rainfall events. However, on April 3, 2019 the adjacent property owner
raised the concern that flood flows were exiting the Site and flowing onto his property to a higher
degree than in the past. Specifically, floodwaters were exiting the easement at a location along
the western boundary (see Figure 1) and then flowing north along the boundary line and into field
between the easement and Hooper's Creek. He expressed concern that this additional flow was
damaging part of his fields and would result in some of the area being unusable for crop
production. This Adaptive Management Plan has been developed in order to address the issue of
this potential hydrologic trespass.
2.0 PROPOSED CORRECTIVE ACTION
The adjacent property owner requested that ditches be installed within the conservation
easement to collect the flood flows prior to entering his property. However, an internal
examination of the as -built surface was conducted to develop a better understanding of the
problem. This examination determined that deviations in the constructed surface from the design
surface have potentially contributed to this issue. Some of the deviations, while being relatively
minor and within construction tolerances, have the potential to shift a portion of the flood flows
from the east floodplain to the west floodplain. However, a significant deviation occurs on the
west floodplain which may be contributing significantly to this issue. This deviation created a linear
depression running northward which may be capturing additional flood flows and routing them
out of the easement. It is possible this linear depression is the remnant of the haul route that was
in place during the construction of the downstream end of Weston Branch and that final grading
out of the haul route never corrected any settling or shifting of the landscape along this corridor.
The proposed plan (see Figure 2) is to regrade portions of the floodplain to address this issue. This
regrading will include correcting the deviations from the original design grading plan and also will
provide for additional grading that will move flood flows northward through the easement without
exiting to the west. The flood flows will be directed to the northern boundary of the wetland area

and then conveyed along the west side of Weston Creek. At the narrowest point the floodplain
conveyance grading will have a top width of approximately 35 ft and a depth of approximately
1 foot. This will have a capacity to carry the 10-year flood flow under fully vegetated conditions.
Over time as mature vegetation begins to shade out the herbaceous layer flow conveyance
should improve. Upstream of the easement constriction the flood conveyance area will be
expanded to improve storage and retention of flood flows. The flood conveyance grading will
need to extend to the lower end of Weston Creek in order to provide for continuation of the flood
conveyance and tie the grades into the existing stream.
The regrading effort will affect approximately 4 acres of the wetland restoration area. The change
in surface elevation will generally be less than 6 inches, with a few small areas changing up to 12
inches. No regrading will occur within 10 feet of the restored Weston Creek and all grading will be
within the tolerances allowed to maintain wetland hydrology. The area impacted by regrading
activities will be stabilized with temporary and permanent seed mix and replanted in the fall using
the specifications of the original planting plan.
