You have our approval to place fill material in 0.02 acres of wetlands or waters for the purpose
of road maintenance at SR 2441 (Ben Mills Road), as you described in your application dated
26 September 1994. After reviewing your application, we have decided that this fill is covered by
General Water Quality Certification Number 2745. This certification allows you to use Nationwide
Permit Number 3 when it is issued by the Corps of Engineers.
This approval is only valid for the purpose and design that you described in your application. If
you change your project, you must notify us and you may be required to send us a new application.
For this approval to be valid, you must follow the conditions listed in the attached certification. In
addition, you should get any other federal, state or local permits before you go ahead with your
project.
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory
hearing. You must act within 30 days of the date that you receive this letter. To ask for a hearing,
send a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the
Office o?Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and
its conditions are final and binding unless you ask for a hearing.
This letter completes the review of the Division of Environmental Management under Section 401

The Department of Transportation is scheduled to grade, drain, base and pave primarily along the
existing roadway of SR 2441 (Bens Mill Road), in Wilkes County during the 1994-1995 fiscal
year. Due to the proximity of Fishing Creek (Class - C), we are requesting a 404 Nationwide
No. 3, to cover the 2 existing cross line drainage structures that will need replacing, or upgrading.
Attached is a straight line sketch with proposed erosion control, stream, stream embankment,
pipe crossing and construction limits.
By copy of this letter I am asking Ms. Stephanie Goudreau, North Carolina Wildlife Resources
Commission Mt. Region Coordinator, to continent directly to you concerning the 404 Nationwide
Permit request.
Also by copy of this letter, I am requesting authorization to proceed under Section 401 of the
Clean Water Act from the Division of Environmental Management.

EROSION CONTROL SCHEDULE
(1) All ndPnuate temporary erosion control measures will be
installed before clearing and grubbing operations begin.
(2) As construction progresses temporary and permanent
erosion control devices shall he installed in a timely
manner, according to any special permit requirements
and /or requirements set out in G.S. 113A-57.
MANDATORY STANDARDS FOR LAND-DISTURBING ACTIVITY
Pursuant to G.S. 113A-57(3), Provisions for a ground
cover sufficient to restrain erosion must be
accomplished within 30 working clays or 120 calendar
days following completion of construction or
development, whichever period is shorter, except as
provided in 15A NCAC 4B .0024(e).
DESIGN STANDARDS IN SENSITIVE WATERSHEDS
Pursuant to G.S. 113A-57(3) provisions for a ground
cover sufficient to restrain erosion must be
provided for any portion of A land-disturbing
activity in a HQW zone within 15 working days or 60
calendar days following completion of construction
or development, whichever period is shorter.
(3) All siltation and erosion control devices shall be
properly maintained until no longer needed.
(4) On projects performed by D.O.T. Maintenance Forces,
rerlvest will promptly be made to the Division Roadside
Environmental Unit for stage and permanent seeding.
(5) Any removal of siltation devices will he based on the
condition of established ground cover of that area the
device 14 serving.
