The 15-Day Adaptive Management Plan As -Built review for the Fletcher Stream and Wetland Site (SAW-2016-02205) ended
June 10, 2020. Per Section 332.8(o)(9) of the 2008 Mitigation Rule, this review followed the streamlined review process. All
comments received from the NCIRT are incorporated in this email. There were no objections to issuing the initial credit
release. Please find attached the current signed ledger. The MY1 credit release will be requested for the entire site in April
2021 at the next IRT credit release meeting.

NCIRT Comments:
EPA, Todd Bowers:
On February 6, 2020 a storm event totaling 3.35 inches caused additional flooding to the Weston Creek Reach via an
overbank event from Hoopers Creek. The event caused minor impacts to the adjacent agricultural area. Work was halted
and a repair plan was developed to address the remaining issues with hydrologic trespass. These repairs targeted three
key areas along the Weston Creek reach. A low swale was installed along the easement boundary near the middle of the
Weston Creek reach. This swale was designed to divert draining floodwaters within the easement and prevent trespass.
The elevation of the berm along the lower section of Weston Creek was regraded to an elevation of 2077 ft, the
preconstruction elevation. A log hedgerow was installed along the berm to buffer the impact of high flows from Hoopers
Creek. A log deflector wall was installed on the upstream bank at the mouth of Weston Creek. All of these repair areas
were seeded, live staked, and re -planted. Repairs to the Weston Creek reach, replanting, and live staking were
concluded on February 28, 2020.
It is the sponsors request that after MY6, if all criteria are being met, they will conclude monitoring of the Fletcher
mitigation project area other than Weston Creek Reach 1A and 113 and the wetland re-establishment area. In this case,

the MY7 monitoring report would consist only of data for Weston Creek Reach 1A and 113 and the wetland re-
establishment area.
At this time the EPA Region 4 Oceans, Wetlands and Streams Protection Branch has no substantial comments or
concerns with the plan put forth by the site sponsor. The sponsor should continue to closely monitor Weston Creek and
adjacent wetlands for the intended response to site modifications to minimize any ongoing hydrological trespass to
adjacent property, especially following storms of similar magnitude as listed above. I am looking forward to the inclusion
of groundwater data with the first monitoring report due at the end of 2020. Thank you once again for the opportunity
to review and provide feedback on the request for monitoring modification at the Fletcher Mitigation Site in Henderson
Co., NC.
DWR. Erin Davis:
DWR supports the requested 30% as -built credit release. We are also ok with the proposed monitoring schedule
(presented clearly in table format). Based on last year's site visit there are a few concerns such as, parallel reaches
maintaining channel features and mowing encroachments that we will be aware of during monitoring.

1 - For NCDMS, no credits are released during the first milestone
2 - For NCDMS projects, the initial credit release milestone occurs when the as -built report (baseline monitoring report) has been approved by the NCIRT and
posted to the NCDMS Portal, provided the following criteria have been met:
1) Approved of Final Mitigation Plan
2) Recordation of the preservation mechanism, as well as a title opinion acceptable to the USACE covering the property.
3) Completion of all physical and biological improvements to the mitigation site pursuant to the mitigation plan.
4) Receipt of necessary DA permit authorization or written DA approval for projects where DA permit issuance is not required.
3 - A 10% reserve of credits is to be held back until the bankfull event performance standard has been met.
