You subsequently responded to our letter and Pre-Construction Notification with two additional information requests, the last dated January 4, 2006, and referred to the project as DWQ Project #05-2082. Since the time of this correspondence we requested and held a site visit with Mr. Kyle Barnes of your Washington field office. This site visit occurred on January 19, 2006. Based on the guidance we received from Mr. Barnes we completed the inspection and culvert repair phase only, using only sandbags to divert water through adjacent piping, and removing the sandbags immediately following completion of the work. These repairs involved sealing cracks in the pipe, not complete replacement. The temporary placement of the sandbags was authorized under NWP33/GC3366, and was done in accordance with the conditions of this permit. Bank stabilization is allowable under 15A Equipment access at Sites 1 and 3 is easily accomplished along the existing power line right of way. Disturbance to buffer vegetation will be minor, including temporary impacts from equipment operation to the vines and herbaceous vegetation that are currently growing along the banks. No trees would be removed in these locations. The upstream side of the northern culvert at location 1 is not a regulatory issue since at this point the waterway is a man-made ditch; the natural stream and associated buffer begin at the downstream end of the culvert. The upstream side of the southern culvert at site 1 is depicted as site 2 in the drawings. The upstream side of culvert location 3 requires no maintenance at this time. ~~~ ~~o V~~«~ ~~~j,~~ aGw 5090/18160 LN October 11, 2006 Equipment access at site 2 requires the removal of several trees within the 50 ft buffer area. These trees are less than 35 ft from Cunningham Boulevard, directly above the headwall of the culvert. The area of tree removal is indicated on the enclosed drawings. During the site visit with Mr. Barnes a larger issue was recognized at site 2; this site is experiencing bank subsidence from above due to a broken concrete stormwater pipe that enters the .site from the south along the roadway. This 73 ft long pipe is the end point of approximately 700 ft of pipe and open drainage swales collecting stormwater from a large parking lot and a section of Roosevelt Road. The pipe is currently lying in several disjointed sections jutting out of the hillside above the stream and is apparently the source of the several small (approximately 16 in. diameter) blowouts under the roots of the trees growing on that hillside. MCAS Cherry Point has decided to correct this problem by installing a new subsurface drainage pipe in the road shoulder (within the 50' buffer but currently vegetated in grass) to redirect the flow into an existing drop inlet located above the headwall, and re-grading and stabilizing the subsided areas mentioned above. Additional disturbance of the riparian buffer to protect existing structures is allowable under 15A NCAC2B.0233. We feel that we have thoroughly addressed the concerns expressed during the site visit with Mr. Barnes and in your correspondence.
