I apologize for the delay in e-mail ing/following up with you after our site visit to your property, but please find attached
the electronic documentation regarding the stream being subject to the Tar -Pamlico Riparian Buffer Rules. I've cc'ed
Emily Thompson with the U.S. Army Corps of Engineers, so that you'll have her contact information, as constructing the
pond, if allowable, may also require permitting from her (federal) agency. I've tried to do a little bit of background
digging to see if there's any evidence on our end if the pond had previously existed (but haven't found anything so far),
because as we discussed while on -site, if there is documentation that a pond was previously existing (in addition to what
appears visually to be a breached dam structure as seen on -site), that history would make it potentially easier to get the
"rebuilt" pond permitted than, for example, an entirely new pond. If you've been able to find any of that kind of
information, please feel free to pass it along, as it will help with any discussions about permitting and what other
requirements there might be.
Thanks also for your patience, I'm continuing also to search for historic evidence of the pond (as the dam suggests that
there was something there), and if there's any questions you have, please let me know.

The Division of Water Resources has determined that the streams listed above and included on the attached map
have been located on pages 25 of the most recent published NRCS Soil Survey of Pitt County, North Carolina
and/or the most recent copy of the Greenville NW USGS Topographic map at a 1:24,000 scale and evaluated for
applicability to the Tar -Pamlico Riparian Buffer Rule. Each stream that is checked "Not Subject" has been
determined to not be at least intermittent or not present on the property. Streams that are checked "Subject"
have been located on the property and possess characteristics that qualify them to be at least intermittent
streams. There may be other streams or features located on the property that do not appear on the maps
referenced above but may be considered jurisdictional according to the US Army Corps of Engineers and subject to
the Clean Water Act.
This on -site determination shall expire five (5) years from the date of this letter. Landowners or affected parties
that dispute a determination made by the DWR may request a determination by the Director. An appeal
request must be made within sixty (60) calendar days of date of this letter to the Director in writing.

This determination is final and binding as detailed above, unless an appeal is requested within sixty (60) days.
This determination only addresses the applicability to the buffer rules and does not approve any activity
within the buffers. The project may require a Section 404/401 Permit for the proposed activity. Any
inquiries regarding applicability to the Clean Water Act should be directed to the US Army Corps of
