Preston Howard, Jr., P.E., Director APPROVAL of 401 Water Quality Certification Mr. Stephen Moore NC DOT Route 1, Box 160C Marion, N.C. 28752 Dear Mr. Moore: FILE COPY You have our approval to place fill material in 0.04 acres of wetlands or waters for the purpose of road improvements at SR 1202, as you described in your application dated 24 May, 1994. After reviewing your application, we have decided that this fill is covered by General Water Quality Certification Number 2735. This certification allows you to use Regional Permit Number 031 when it is issued by the Corps of Engineers. This approval is only valid for the purpose and design that you described in your application. If you change your project, you must notify us and you may be required to send us a new application. For this approval to be valid, you must follow the conditions listed in the attached certification. In addition, you should get any other federal, state or local permits before you go ahead with your project. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 30 days of the date that you receive this letter. To ask for a hearing, send a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and its conditions are final and binding unless you ask for a hearing. SAMUEL HUNT 111 SECRETARY 401 ISSUED Subject: SR 1202 Loggy Hollow Road 1993-1994 Residential Paving Priority Dear Mr. Chapin: I am attaching a straight line diagram with erosion control plan, an application form for a nationwide permit, and a county map section relative to the paving of SR 1202 Loggy Hollow Road in Mitchell County. Loggy Hollow Road is presently 12 to 14 feet wide. We plan to pave the road 18 feet wide and increase the typical section. The proposed typical is also attached. Grading will be moderate to heavy. We propose to channel change from survey station 5 + 75 to 7 + 00. This channel change is necessary because of the septic tank and house across the road. We also propose to extend/replace three (3) pipes which carry live streams at survey stations 16 + 80, 33 + 75 and 46 + 90. By a copy of this letter, we are asking North Carolina Wildlife Resources Commission Fisheries Biologist, to comment directly to the nationwide permit request. C. 28801 Subject: SR 1202 Loggy Hollow Road 1993-1994 Residential Paving Priority Dear Mr. Chapin: I am attaching a straight line diagram with erosion control plan, an application form for a nationwide permit, and a county map section relative to the paving of SR 1202 Loggy Hollow Road in Mitchell County. Loggy Hollow Road is presently 12 to 14 feet wide. We plan to pave the road 18 feet wide and increase the typical section. The proposed typical is also attached. Grading will be moderate to heavy. We propose to channel change from survey station 5 + 75 to 7 + 00. This channel change is necessary because of the septic tank and house across the road. We also propose to extend/replace three (3) pipes which carry live streams at survey stations 16 + 80, 33 + 75 and 46 + 90. By a copy of this letter, we are asking North Carolina Wildlife Resources Commission Fisheries Biologist, to comment directly to the nationwide permit request. A request to twenty-five foot buffer zone will be made to of Environment, Health and Natural Resources Chris Goudreau, District you concerning work within the the Department at a later date.
