Dear Mr. Smith,
Duke Energy Carolinas, LLC (hereinafter Duke Energy) submits this request to terminate the
subject consent order. Duke Energy has completed all the necessary activities for which the
order was issued and is in compliance with the terms of its NPDES permit. Duke Energy has
successfully eliminated flows from outfall 003, outfall 003A and outfall 111 by re-routing the
flows to the Dan river via outfall 006 and 006A. Duke Energy has installed a physical/chemical
system capable of treating 800 gpm of ash basin decanting flow as required.
Effective with the termination of the order, Duke Energy withdraws its pending request for
amendment of the order. For clarity, Duke Energy intends to continue to process 800 gpm of
flow through the physical/chemical treatment system that was installed as a condition of the
order.
