You have our approval to place fill material in 0.05 acres of wetlands or waters for the purpose
of bridge replacement at SR 1142, as you described in your application dated 13 October 1994. After
reviewing your application, we have decided that this fill is covered by General Water Quality
Certification Numbers 2664 and 2727. These certifications allow you to use Nationwide Permit
Numbers 12 and 33 when they are issued by the Corps of Engineers.
This approval is only valid for the purpose and design that you described in your application. If
you change your project, you must notify us and you may be required to send us a new application.
For this approval to be valid, you must follow the conditions listed in the attached certification. An
additional condition is that the stream bank and berm (if any) shall be restored to its approximate
original shape after disturbance. In addition, you should get any other federal, state or local permits
before you go ahead with your project.
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory
hearing. You must act within 30 days of the date that you receive this letter. To ask for a hearing,
send a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the
Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and
its conditions are final and binding unless you ask for a hearing.
This letter completes the review of the Division of Environmental Management under Section 401

to replace bridge 106 over Lower Creek in Caldwell. County.

Contractors have begun work on this replacement.
However, it has been determined that, in order to construct
the drilled piers for bents 1 and 21 a rock
orampdenclose by
steel sheeting will-be necessary. The the proposed rock ramps. The con9tructior= of these ramps
will not restrict normal flow or aquatic life movements. The
ramp materials will be completely removed immediately
following completion of construction.
Furthermore, the Department is responsible fvr removing
the existing 12" water liner located downstream of the
existing bridge, and installing a 8" water line upstream of

Ms. Stephani,a Goudreau of the N.G. Wildlife Resources
Commission indicated in a October 61 1994 telephone
conversation that her agency would not object to the proposed
action as long as standard NCDOT Best Management Practices
(BMp' s ) are followed, The Departments SMP' s will be adhered
to for this project.
Because construction activities at this location have
been previously reviewed and permitted, it should not be
necessary to request comments from the U.S, Fish and Wildlife
service and National Marine Fisheries Service regarding the
presence of any federally listed or proposed threatened or
endangered species or critical habitat, or from the Stater
Historic Preservation offict regarding the presence of any
historic properties in the area.

The North Carolina Department of Transportation proposes
to replace bridge 106 over Lower Creek in Caldwell County.
This action has previously been authorized under 404
Nationwide Permit 23 (Categorical Exclusion).
Contractors have begun work on this replacement.
However, it has been determined that, in order to construct
the drilled piers for bents 1 and 2, a rock ramp enclosed by
steel sheeting will be necessary. The enclosed drawing shows
the proposed rock ramps. The construction of these ramps
will not restrict normal flow or aquatic life movements. The
ramp materials will be completely removed immediately
following completion of construction.
Furthermore, the Department is responsible for removing
the existing 12" water line; located downstream of the
existing bridge, and installing a 8" water line upstream of
the existing bridge. This new line will be installed by
building an impervious dike from sandbags or sheet pile
through half of the stream to divert water flow from the work
area. All excavation will take place within this dike work
area. The pipe will be installed through half of the stream
and the dike removed. The same. procedure will then take
place on the other side of the-stream. Please note that the
existing water line is located above ground in the stream and
is functioning as a barrier to aquatic movement. The
proposed water line will be placed below stream bed level,
allowing for increased movement within the stream channel.
