9. Narrative Description:
This project underwent review under the State Environmental Policy Act, and included in this
package is the FONSI that resulted.
The project site consists of three (3) single-family residential lots within the subdivision of
Harker's Point, on the northwest end of Harker's Island in Carteret County. Street
addresses are 119 (Lot 20), 123 (Lot 19), and 125 (Lot 18) Maxwell Drive. This development
is on the opposite shoreline and to the north of the Harker's Village Subdivision. The
properties are typical of residential lots, with landscaping, residences on each, individual
piers and docks, and no shoreline stabilization. The lots are approximately '/z acre in size
each, for a total of 1 'h acre. All three homes are serviced by Harker's Island municipal
water, and a package treatment system for the development. The properties lie adjacent to
Brooks Creek, which contains the federal channel leading to the Harker's Island harbor of
Refuge at the east end of the basin. There is a fringe of Martina alterniflora around the
perimeter of Brooks Creek, which opens to the south into the North River at Back Sound.
Brooks Creek has an evident shellfish resource within the intertidal area. There are
significant SAV resources at the mouth, but limited within the creek itself. During the site
visits, there was no indication of either resource within 40' of the western edge of the
westernmost dock involved in this request.
Brooks Creek carries a water quality classification of SA; The North River joining Brooks
Creek is also classified SA, and Back Sound carries the additional classification of ORW.
Brooks Creel: is not designated as Primary Nursery Area by the DMF, and it is closed to the
taking of shellfish for consumption. The Carteret County Land Use Plan classifies this area
of the county as Limited Transition, with the ACC's classified as Conservation. Brooks
Creek has asilty/sandy substrate, and ranges in water depth from 0' nlw to -2.6' nlw.
There is no knowledge of this area having been excavated previously.
The proposal is to excavate around the three existing docks, expand two (2) of the docks, and
add 3 boatlifts (one to each dock). The dredging would continue to connect the new basin of
the two western docks to the new basin of the eastern dock, and create a channel connecting
alt three to the existing federal channel.
In order to accomplish the proposed, the applicants wish to excavate a 90' x 30' area around
the docks of Lots 18 and 19, dredge approximately 20' x 30' around the proposed lifts for
these docks, extend a 20' x 50' channel to connect to the dock at Lot 20, excavate a 50' x 30'
basin around the dock of Lot 20, and then angle a 20' wide channel extending 250' from
midway between the lots in a southeast direction to connect to the existing channel. Current
soundings within the area of the proposed basins average -.5' nlw to -1.2' nlw, with the
request to excavate to a depth of -4' nlw. The current soundings within the proposed
channel range from -1.8' nlw to 2' nlw, with the same desired finished depth of -4' nlw.
The connecting water depth within the federal channel is -6' and greater at nlw.

The proposal is to remove the material with a dragline to barge, for offloading and trucking
to apre-approved site on Harker's Island. The applicant has dedicated an 800' x 300' area
to contain the 1026±cubic yards of material. Excavation will disturb approximately 10, 800
sf of shallow bottom habitat.
Lot 18 is proposing a 20' x 4' floating dock addition to the existing 20'x 10' fixed dock. This
is intended to help access the boatlift. The dock will utilize a parallel ramp, allowing for the
addition to abut the original. Lot 19 in proposing the same style of 22' x 4' float, abutting
the existing 22' x 12' fixed dock.
The owner of Lot 18 is proposing a 12'x 12' boatlift to the east of the fixed dock, while the
owner of Lot 19 is proposing the same to the west of his fixed dock. Neither has a boatlift
currently. The dock on Lot 20 presently has a boatlift to the east of the fixed dock, and is
proposing a 12' x 12' lift to the west of the fixed dock. No dock expansion is proposed for
Lot 20. The project will result in a total of five (5) boat slips for the three (3) docks.
10. Anticipated Impacts:
The installation of the boatlifts and the pilings for the docks will result in temporary
turbidity. The lifts will incorporate 432 sf of Public Trust Area, and the dock expansions will
shade 168 sf of shallow bottom habitat. Excavation will be accomplished by bucket to barge,
disturbing approximately 10,800 sf of shallow bottom habitat that has not been excavated
previously. Turbidity impacts can be expected during the removal of these 1026 cubic yards
of material. Finished bottom soundings will be -4' nlw, connecting to -6' and greater.
While 5.5 acres of high ground has been set aside for spoil placement, the actual area
required should be in the area of 3600 sf. The intended use of this project is for boating
ingress and egress of 3 waterfront homeowners.

The proposed development is the addition of a channel and basins in the Brooks Creek
serving three residential properties with existing docks. The three tracts are located in
the Harker's Point Subdivision (Lots 18, 19 and 20). Additionally, the project includes a
new boat lift at each of the docks and floating step-down docks for two sites (Lots 18
and 19). The proposed channel is 250 feet in length, 20 feet wide and will be dredged
to a depth of -4 feet NLW. Basins will be dredged for each dock to provide 30 feet of
width and a depth of -4 feet NLW. The channel will connect to the existing federally
maintained Harbor of Refuge Channel, authorized at 60 feet wide with a depth of -6 feet
NLW. Approximately 1,030 cubic yards of material will be dredged and disposed of at
an approved upland site on Harker's Island.
The proposed project has been reviewed as an Environmental Assessment and has
been issued a Finding of No Significant Impact (FONSI).
