You have our approval to place fill material in 0.10 acres of wetlands or waters for the purpose
of road maintenance at SR 1471 (John Jolly Road), as you described in your application dated 19
December 1994. After reviewing your application, we have decided that this fill is covered by General
Water Quality Certification Numbers 2745 and 267:1. These certifications allow you to use Nationwide
Permit Numbers 3 and 26 when they are issued by the Corps of Engineers.
This approval is only valid for the purpose and design that you described in your application. If
you change your project, you must notify us and you may be required to send us a new application.
For this approval to be valid, you must follow the conditions listed in the attached certification. In
addition, you should get any other federal, state or local permits before you go ahead with your
project.
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory
hearing. You must act within 30 days of the date that you receive this letter. To ask for a hearing,
send a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the
Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and
its conditions are final and binding unless you ask for a hearing.
This letter completes the review of the Division of Environmental Management under Section 401
of the Clean Water Act. If you have any questions, please telephone John Dorney at 919-733-1786.

The North Carolina Department of Transportation, District I
Maintenance plans to grade this road primarily along the
existing roadway in the 1995 - 1996 Fiscal Year. We will be
encroaching upon the 25' Buffer Zone of a trout stream (Brush
Creek) from Station 50+60 +- to Station 51+50 +-. We will
maintain approximately the same grade in this are to minimize
any damage to the trout stream. We request that we be
allowed to stabilize the banks of the stream in this area
using Class I Rip Rap per our Standard Specifications Section
862-2 since the stream enters the project perpendicular to
the roadway in this area. We will be replacing or extending
pipes which carry live streams and are approximately
perpendicular crossings of the project at Station 44+70 and
Station 46+25. We are requesting a 404 Nationwide Permit (#3
Maintenance and No. 26 Bank Stabilization) from your agency.
I am sending a revised straight line sketch with the proposed
erosion control, stream, stream bank, and construction
limits. In addition, I am sending a typical section of the
road, plan and profile of short section around stream at
Station.50+60 to Station 51+00, general notes on erosion
control, and a marked map.
By copy of this letter I am asking Ms. Stephanie Goudreau,
North Carolina Wildlife Resources Commission Mountain Region
Coordinator to comment directly to you concerning the 404
Nationwide Permit Request.

A request will be made on this project for a Temporary
Encroachment in the Trout Water Buffer Zone of the DEHNR
Trout Stream (Brush Creek) and I am asking Ms. Goudreau to
comment directly to me concerning the Trout Water Buffer Zone
Encroachment.
Also, by copy of this letter, I am requesting authorization
to proceed under Section 401 of the Clean Water Act from the
Division of Environmental Management.
We would plan to begin construction in the fall of this year.
If further information is required, please let me know. Your
early review and consideration will be greatly appreciated.

EROSION CONTROL PLAN SHEET
Silt''Basin Type B's will be constructed to the dimerision;of
six feet by three feet by three feet unless otherwise:-noted
on the plans.
Generally, the order of installation of the erosion control
measures will be as follows:
Temporary silt basins shall be installed before
clearing and grubbing begins.
Silt fences and temporary silt ditches shall be
installed after clearing and before grading.
Temporary stone ditch checks shall be installed as
soon as ditchline is established.
Pipe outlet and inlet protection will be done as
soon as the pipe is installed.
Seeding and other permanent erosion control
measures are to be.implemented as soon as practical.
