You have our approval to place fill material in 0.04 acres of wetlands or waters for
the purpose of streambank stabilization at SR 1718, as you described in your application
dated 26 August 1994. After reviewing your application, we have decided that this fill is
covered by General Water Quality Certification Number 2665. This certification allows
you to use Nationwide Permit Number 13 when it is issued by the Corps of Engineers.
This approval is only valid for the purpose and design that you described in your
application. If you change your project, you must notify us and you may be required to
send us a new application. For this approval to be valid, you must follow the conditions
listed in the attached certification. In addition, you should get any other federal, state or
local permits before you go ahead with your project.
If you do not accept any of the conditions of this certification, you may ask for an
adjudicatory hearing. You must act within 30 days of the date that you receive this letter.
To ask for a hearing, send a written petition which conforms to Chapter 150B of the
North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box
27447, Raleigh, N.C. 27611-7447. This certification and its conditions are final and
binding unless you ask for a hearing.
This letter completes the review of the Division of Environmental Management under
Section 401 of the .Clean Water Act. If you have any questions, please telephone John

We are providing a package of design sketches concerning
wetlands that will be impacted by this project. We have
enclosed a completed N. C. D. E. M application for your use.
We are proposing a channel change in the unnamed
tributary flowing along SR 1718, Goldview Road,for approx-
imately one hundred thirty feet. This area is located
two hundred feet Northeast of NC 251. These waters are not
high quality waters or trout waters.

DEM Project #94143
We have reviewed your request for 401 Water Quality Certification
to place fill material in 100 feet of waters which are tributary to
unnamed tributary of the French Broad River for stream stabilization
located at SR 1718 in Buncombe County as described in your submittal
dated 8 February 1994. Based on this review, we have determined that
the proposed fill is covered by General Water Quality Certification
No. 2665. A copy of the General Certification is attached. This
Certification is necessary for coverage under Corps of Engineers'
Nationwide Permit No. 13. This action completes DEM's review under
Section 401 of the Clean Water Act.
If this Certification is unacceptable to you, you have the right
to an adjudicatory hearing upon written request within thirty (30)
days following receipt of this Certification. This request must be in
the form of a written petition conforming to Chapter 150B of the North
Carolina General Statutes and filed with the Office of Administrative
Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. Unless such
demands are made, this Certification shall be final and binding.
