Corps of Engineers comments: The 25 foot restored/established stream buffer (indicated in green on the plans) will not be encroached upon by construction of the upland pond or other clearing and grading activities. a. A note has been added to sheet 2 indicating that the buffers are to be protected during future construction activities on the site. 2. The agencies are concerned about the "tightness" of the meander between stations 1+00 — 2+00 on the restored channel. Provide a narrative in the plans of how the design will allow for the shape of the proposed meander. a. The meander bend in question has a radius of 14 feet, which is twice the bankfull width of 7 feet for stream S4. Based on past experience with similarly -sized streams on similar slopes, a radius of curvature ratio of 2.0 will be stable with proper bank treatments (in this case seeding, coir matting and live staking.) We note that Big Norton Prong, while significantly larger, has a slightly smaller radius of curvature on a meander bend within the Meshad property. We selected the radius and arc length of the bend in order to promote a deep pool, which we believe will provide good aquatic habitat. 3. The lower reach of the proposed restored stream channel (from the approximate original location of the confluence of S4 and SI to Norton Prong) is to be located closer to the original location of SL As discussed during the site meeting on March 23, the restored stream channel should merge with Norton Prong along or close to the ox-bow bend on Norton Prong. The CAP proposes a stream channel in or very close to a location that the agencies stated during the meeting on February 4 was not acceptable. Page 1 of 3 a. The revised plans include a confluence of S4 at the oxbow bend on Big Norton Prong. 4. A vegetated stream buffer, with a minimum width of 30 feet, is to be established on both sides of all restored channels. The width is to extend landward from the bankfull elevation on each side of the restored streams. Reduced buffer width along the south bank of the restored main channel is to be allowed and based upon construction constraints with the impounding structure of the proposed upland pond. a. John Meshad will be submitting a request to Stan Aiken at DEMLR for a trout buffer waiver on the south side of the restored stream. The buffer width on the north side of the restored channels will be at least 25 feet, but in most cases significantly wider. 5. The vegetation to be planted within the stream buffers and restored wetlands is to be comprised of an appropriate mix of live stake, containerized, and bare root native woody species, as well as, a native herbaceous riparian and wetland seed mix. a. Sheet 10 in the attached plans includes lists of proposed woody and herbaceous buffer plants, all of which are native species. 6. The density of woody stem planting should be based upon a 320 stem per acre survival at three years. a. The bare root species table on Sheet 10 specifies a minimum planting density of 400 stems per acre, assuming an 80% survival rate over the first three years after restoration. NC Division of Water Resources comments: 1. Please provide a copy or your responses to the North Carolina Wildlife Resources Commission email dated May 12, 2020, and the US Army Corps of Engineers request for additional information email dated May 13, 2020. [15A NCAC 02H.0506(b)(2) and (c)(2)J. a. Responses are included herein. 2. Please clarify the proposed plan for the streamflow from Sl once the diversion swale is removed and S3 flow is diverted to the new channel. During the site meeting March 23, 2020, there were discussions regarding potential construction of a pond in the area south of S3 and S4. If this is the case, please provide additional details regarding the pond. [I5A NCAC 02H.0506(b)(2)J. a. S 1 fed the former pond and is planned to feed the proposed pond that is being designed by others. The timing of pond construction has not been determined as of this date. If pond construction does not coincide with stream restoration, the diversion swale will be left in place to intercept flow in S 1 until the pond and dam construction begins. Notes on Sheet 3 have been revised to this effect. NC Wildlife Resources Commission comments: 1. How wide will the planted/preserved buffer be on the 2 reconstructed channels? a. Please see the response to Corps question 4 above. 2. My understanding is that a dam will be constructed. There is no indication the pond and dam design. Can you provide details? I am particularly interested in knowing if a cold -water release is incorporated into the pond design. Page 2 of 3 a. The dam and pond are being designed by others. A flashboard riser structure with a Cold- water release is in place from the aborted pond construction and we assume that this same structure will be configured to provide a cold -water outlet from the proposed pond. 3. It appears that very little riparian vegetation exists on Norton Prong itself. Native brook trout inhabit Norton Prong, and we strongly recommend and request that a native woody buffer of at least 3Oft in width be planted on Norton Prong. Can this be incorporated? a. Please seethe response to question 1 above. The buffer on the east side of restored S4 will extend to Norton Prong to create a shared buffer at least 30 feet wide. 4. Can you provide an additional plan overview figure, with the limits of the new pond, dam, reconstructed streams and their buffers, wetland impacts and restored area? There are some figures provided, but none of them provide all of this information. a. The plans include an erosion control plan that shows the proposed disturbance associated with the stream restoration. The dam and pond are being designed by others. We trust that these responses adequately address agency questions and comments. If you have any additional questions or comments, please contact me.
