September 23, 2009 Memorandum to: Jay Johnson, DEO, NC DOT Division 3 From: Steve Mitchell, PDEA, Biological Surveys Group Subject: B-4237 Mussel Survey Report Biologists from the NCDOT Biological Surveys Group, Jason Mays and Steve Mitchell performed a survey for Tar River spinymussel (Elliptio steinstansana, TSM) at the Pitt County SR 1723 crossing of Fork Swamp on September 18, 2009. B-4237 involves the replacement of the existing bridge, number 25, with a new structure on existing location. Surveys were conducted within the Fork Swamp (Tar-Pam River Basin) from a location approximately 400 m downstream of the bridge to approximately 100m upstream of the bridge. During the 2.5 person hours of search effort 55 individuals of Elliptio complummta and a single individual of Lampsilis radiata were collected along with an abundant numbers of Corbicula fluminea (asiatic clam). These same species were encountered during a previous survey conducted on April 28, 2004. No TSM were collected during either of the surveys. Habitat within the surveyed reach of the creek was not adequate for TSM, being about 2-3 meters wide and having unstable silt/mud/sand substrate with unstable banks.' Agriculture and commercial land uses are present in the watershed and an access road parallels the right bank with some signs of recent land clearing activity insulting in very narrow or nonexistent buffer. These influences have resulted in degraded habitat that would not support TSM. US Fish & Wildlife's web site list the TSM occurrence as historic since it has not been observed in Pitt County in over 50 years. B-4237 involves the replacement of the existing bridge, number 25, with a new structure on existing location. Surveys were conducted within the Fork Swamp (Tar-Pam River Basin) from a location approximately 400 in downstream of the bridge to approximately 100m upstream of the bridge. During the 2.5 person hours of search effort 55 individuals of Elliptio complananta and a single individual of Lwnpsihs radiata were collected along with an abundant numbers of Corbicula .Jluminea (asiatic clam). These same species were encountered during a previous survey conducted on April 28, 2004. No TSM were collected during either of the surveys. Habitat within the surveyed reach of the creek was not adequate for TSM, being about 2-3 meters wide and having unstable silt/mud/sand substrate with unstable banks. Agriculture and commercial land uses are present in the watershed and an access road parallels the right bank with some signs of recent land clearing activity resulting in very narrow or nonexistent buffer. These influences have resulted in degraded habitat that would not support TSM. US Fish & Wildlife's web site list the TSM occurrence as historic since it has not been observed in Pitt County in over 50 years. Local: None Federal: USACE Nationwide General Permit 3 - Maintenance State: General Water Quality Certification #3687 Local: None Project Description Replace existing 69'-03" long by 24.0' (clear roadway) wide concrete deck bridge with timber piles with a proposed 102'-6" long by 27'-10" (clear roadway) wide reinforced concrete bridge on steel piles and install a proposed 12" HDPE Pipe by Directional Drilling. Age of the bridge and safety inspection reports dictate the need for replacement of this bridge. There will be no impacts to jurisdictional waters during bridge construction and guardrail installation. The longer bridge will result in approximately 1,630 square feet (0.04 Acres) of excavated roadway fil I beneath the new structure. This project does not involve Section 10 (Rivers and Harbors Act) navigable waters. A section of existing PVC Pipe Water Line will be abandoned and replaced by 12" HDPE Pipe and installed by Directional Drilling. The Launching and Receiving Pits are located outside of the Riparian Buffers and the Proposed water Line will be located 28'Left of the center-line of SR 1723 as shown on the attached plan. A section of telephone line will be relocated from Station 12+65 to Station 19+10 as shown on the plan sheet. This project does not require the completion of a formal PCN but notification to the Corps is being provided to be included in their database. This conveyance is shown on the Gardnerville USGS Quad Map and Sheet Number 63-B of the Soil mop taken from the Soil Survey of Pitt County. The channel is 40 feet wide from bank top to bank top and drains a woodland/agricultural area. No federally protected species or historic resources are immediately adjacent to this location.There is no Moratorium for this project and a Tar River spinymussel Survey has been conducted with a Biological Conclusion of "No Effect" on the Tar River spinymussel. In order to ensure compliance with best management practices, all attached General and Regional Conditions associated with Nationwide Permit 3 and Water Quality Certification #3687 must be followed. Keep demolition and construction debris out of the stream. Riprap will not be placed below the plane of ordinary high water for stabilization. Excavation should be confined to the right of way, and limited to the minimum amount required to excavate In high ground for the construction of the new bridge, All excavated material should be removed from the site, placed on existing spoil piles, or disposed of in farm fields. Any waste material disposed of off-site shall have a reclamation plan. All Erosion and Sedimentation measures and Maintenance Best Management Practices should be implemented. I am forwarding a copy to Mr. Andy Blankenship in Roadside Environmental for his perusal in US inspections. The project supervisor should always have this permit package, including the attached General and Regional Conditions associated with the Nationwide Permit 3 and Water Quality Certification #3687 on site during the bridge replacement. The project supervisor should notify me immediately if any questions or concerns should arise before and during construction.
