I would like. to take this opportunity to discuss the requirements for sewerage collection
systems that were first established in 15 NCAC .02H .0200 in March 2000 and are now found in
15 NCAC 2T .0403, Waste Not Discharged to Surface Waters, which became effective
September 1, 2006. These Regulations place significant operation, maintenance and reporting
requirements on those entities that own or operate a wastewater collection system with average
daily flows of less than 200,000 gallons per day.
These regulations are applicable to your facility. This letter is provided as guidance
to assist you in complying with the new reporting and operations and maintenance (O&M)
requirements and to advise you that you are subject to system review, inspections and possible
enforcement, if the system is not in compliance with the regulation.
For your convenience and easy reference, a highlight of these requirements and the
following guidance are offered (see enclosed). You may find the regulations using the following

The Asheville Regional Office will be increasing the level of oversight, compliance
activities and enforcement relating to collections systems, therefore, we wanted to be sure you
are aware of the requirements for these systems. We will be performing NPDES Wastewater
Collection System inspections sometime in the near future.

As a result of reporting a sanitary sewer overflow (SSO) in the past you have been
issued a "Deemed Permit". The regulations that address this are 15 A NCAC 02T —
Waste Not Discharged to Surface Waters, which were implemented by the North Carolina
Environmental Management Commission on September 1, 2006 These regulations place
significant operation, maintenance, and reporting requirements on those entities that own
and/or operate a wastewater collection system with average daily flows of less than
200,000 gallons per day. This letter is provided as guidance to assist you in complying
with the new reporting and operation and maintenance (O&M) requirements, and to advise
you that you are subject to system review, inspections, and possible enforcement if the
system is not in compliance with the regulation.
Please be advised that the Asheville Regional Office will be performing NPDES
Wastewater Collection System inspections sometime in the near future. If this office has not
previously inspected your wastewater collection system and records of same, you should be
prepared to demonstrate compliance with all criteria listed above. In an effort to promote
compliance with the regulation and offer assistance, please see enclosed a copy of the 02T
regulations regarding deemed wastewater collection system O&M.
Also, please note the Asheville Regional Office has a WWTP Consultant on staff to offer
assistance to you in complying with the requirements of the regulations. If you decline
assistance, are inspected, and don't meet the requirements of the regulation, you will receive a
Notice of Violation (NOV) and will be subject to possible enforcement action.

(1) "Collection system" means a group of contiguous sewer systems that convey municipal
or domestic wastewater to a wastewater treatment facility or separately -owned sewer
system.
(2) "High -priority sewer line" means any aerial line, sub -waterway crossing, line contacting
surface waters, siphon, line positioned parallel to streambanks that are subject to eroding
in such a manner that may threaten the sewer line, or line designated as high priority in a
permit.
(c) Permit applications for the initial issuance of a collection system permit shall be completed and
submitted to the Division within 60 days of the collection system owner's receipt of the Division's request
for application submittal. The Division shall request the initial application submittal by certified mail.
Permit renewal requests shall be submitted to the Director at least 180 days prior to expiration, unless the
permit has been revoked in accordance with Rule .0213 of this Section. All applications must be submitted
in triplicate and made on official forms completely filled out, where applicable, and fully executed.
(d) Collection systems that have a design flow and convey an actual flow less than 200,000 gallons per day
shall be deemed to be permitted pursuant to G.S. 143-215.1(b)(4)e, and it shall not be necessary for the
Division to issue individual permits for the operation and maintenance of these systems and their associated
management programs provided that the following criteria are met:
(1) The sewer system is effectively maintained and operated at all times to prevent discharge
to land or surface waters, and any contravention of the groundwater standards in 15A
NCAC 2L .0200 or the surface water standards in 15A NCAC 2B .0200;
(2) A map of the sewer system has been developed prior to January 1, 2004 and is actively
maintained;
(3) An operation and maintenance plan has been developed and implemented;
(4) Pump stations that are not connected to a telemetry system are inspected at least three
times per week until July 1, 2000; thereafter, pump stations are inspected at least daily, as
defined in 15A NCAC 2B .0503(5), until July 1, 2001; and thereafter, pump stations are
inspected every day. Pump stations that are connected to a telemetry system are
inspected at least once per week;
(5) High -priority sewer lines are inspected at least once per every six-month period of time;
(6) A general observation of the entire sewer system is conducted at least once per year;
(7) Inspection and maintenance records are maintained for a period of at least threeyears;
and
(8) Overflows and bypasses are reported to the appropriate Division regional office in
accordance with 15A NCAC 2B .0506(a), and public notice is provided as required by
G.S. 143-215.1 C.
(e) The Director may, on a case by case basis, determine that a collection system should not be deemed to
be permitted in accordance with -this Rule and require the owner of the collection system to obtain an
individual collection system permit from the Division if:
(1) The owner of the collection system does not maintain compliance with the requirements
of Paragraph (d) of this Rule; or
J(2) The collection system is determined to be contributing to the impairment of surface
waters specified on the Division's list generated as a result of the Federal Water Pollution
Control Act (Clean Water Act) Section 303(d), 33 U.S.C. Section 1313(d).

We have found a construction company who gave us a' PrOPO'5'al to fix the sewer
in The Forest to MSD -standards. The developer, Joe Reynolds, has said in the
past that he cannot find anyone to do the work. Attached is a copy of the
proposal.
The developer is now saying he is only willing to Pay $30,000. We want to work
with you on a process to correct the violations. Let me know what we can do.

From manhole 13446 to manhole 13452: All frame,.covers and risers need
removed and replaced -per MSD specs. The inside of the manholes need to
grouted. The line segment should be cleaned and all debris removed. The 1
segment should. then be TVed to verify condition of line. Fix service line at A
13449.
MH -13452 to MH 13453: This line segment is full of roots and needs to be
replaced.
MH 1352 to MH 13551: All manholes need to grouted inside and grout work
trWerts. ripe is OK. Raise. MH .13551.
MH 13551 to next-MH downstream: This tine segment appears to connect to
paint different from what is indicated on the plat. Verify location and remap
accordingly.
Mil 13470 to MH 1.3471: This line segment needs to be located. The line
segment pould not be TVed and appears to be in a different location than
shown on the plat. Spme of the line will have to be replaced with DIP and
ripfrap work done along the creek. When located, this segment needs to i

The location of the existing pipe needs to be verified that it is actually inside
recorded sewer easement shown on the plat. Several areas will have to be

Dear Mr. Reynolds:
On August 20, 2003, Mr. Larry Frost and Mr. Roger Edwards of the Asheville
Regional Office of the Division of Water Quality conducted a non -discharge compliance
inspection of the privately owned -wastewater collection system serving the Forest in
Buncombe County, Water Quality Permit Number W00001272. During the inspection
observation of many of the manholes and exposed lines were made. A copy of the
inspection report is attached for your records. As a result of the observations made during
the inspection the following violation was confirmed: failure to operate and maintain a
permitted collection system.
Failure to Operate and Maintain
Permit Number WQ0001272 permit condition 3 states that" The facilities shall be properly
maintained and operated at all times." North Carolina Administrative Code 15A NCAC 02H
.0227 (d) states; that the following criteria must be met on all deemed permitted collection
systems:
(1) "The sewer system is effectively maintained and operated at all times to prevent
discharge to land or surface waters".
(2) "A map of the sewer system has been developed prior to January 1, 2004 and is.
actively maintained".
(3) "An operation and maintenance plan has been developed and implemented".

Discuss the above violations and how you intend to achieve compliance.
Finally, the Asheville Regional Office of the Division of Water Quality is sending a
recommendation for enforcement to the Director of the Division of Water Quality regarding
these issues and any future or continued violations that may be encountered. Your
response will be reviewed and will be forwarded to the Director with the enforcement
package for his consideration.

herewith Permit No. WQ0001272, dated June 23, 1989, to The Forest, A General Partnership for
the construction and operation of the subject wastewater collection extension.
This permit shall be effective from the date of issuance until rescinded, .and shall be
subject to the conditions and limitations. as specified therein.
If any parts, requirements, or limitations contained in this permit are unacceptable to
You, you have the right to request an adjudicatory hearing upon written request within 30 days
following receipt of this permit. This request must be in the form of a written petition, conforming
to Chapter 150B of North Carolina General Statutes,. and filed with the Office of Administrative
Hearings, P.O. Box 11666, Raleigh, NC 27604. Unless such demands are'made this permit shall
be final and binding.

wastewater into Buncombe County's existing sewerage' system, pursuant to the application received
February, 23, 1989 and in conformity with the project plan, specifications, and other supporting data.

This permit shall be effective'from the date of issuance until rescinded and shall be subject to
the following specified conditions and limitations:
I. This permit shall become voidable unless the facilities are constructed in accordance with
the approved plans, specifications and other supporting data.
2. This permit is effective only with respect to the nature and volume of wastes described in
the application and other supporting data.
3. The facilities shall be properly maintained and operated at all times.
4. The sewage and wastewater collected by this system shall be treated in the Metropolitan
Sewerage District Wastewater Treatment Facility prior to being discharged into the receiving
stream.
5. This permit is not transferable.
